由于职工体育社团组织大多数脱胎于计划体制,表现出缺乏自主性的"先天不足"。半官半民的身份限制了组织独立运作的能力,妨碍了其发挥补充"政府"与"市场"盲点的作用。所以在现阶段,政府与社团组织在职能上会产生重叠。但随着改革的深入,体育社团组织的社会空间也将随之不断调整扩大,并通过外部监控、内部自律,建立起社会化服务模式。  相似文献

现行职能管辖立法规定本身存在的缺陷,是直接导致职能管辖异议的主要原因.现行的职能管辖概念实质上不是关于职能的分工管辖问题,而是刑事诉讼启动程序问题,自诉案件的启动主体是自诉人而不是法院.解决刑事职能管辖异议问题,应当从纠正职能管辖不当定义出发,还刑事诉讼启动程序本来之面目.  相似文献

With drug-related violence reaching record levels in Mexico, there has been growing debate over its causes. US and Mexican officials blame many factors, including problems with their strategy in the drug war, fighting among cartels, corruption in police forces, an ineffective legal justice system and US drug demand. In this paper, I argue that the Mérida Initiative, a multi-billion dollar programme of US assistance, is an important additional factor. Drug-related violence increased in the years after the implementation of the Mérida Initiative, declined when Mexican officials paused new programmes in 2012 and increased again as US and Mexican officials implemented new Mérida programmes in the following years. Over the same time period, drug-related homicides and complementary counternarcotics assistance from the US Department of Defense are positively correlated. Using US records, I show that US officials have been willing to overlook the growing violence because they have been more focused on achieving their economic and strategic objectives. I conclude that their actions have played a significant role in increasing drug-related violence while starting an ominous new phase of US imperialism in Mexico.  相似文献

Transnational policy networks (TPNs) are attracting greater scholarly interest given their impact on the contemporary conduct of international affairs. While this has been a welcome development for International Relations scholars and provided some preliminary insights, there is a need for more scholarly studies of TPNs that delve into specific issue-areas on a comparative basis. The paper addresses the above need by providing analyses of the role of European Union (EU)-based actors – the European Commission, member states, civil society organizations, and firms – in regulatory frameworks on conflict-prone natural resources such as oil, diamonds, coltan, tin, tungsten, and gold. To that end, the paper draws upon participant observations, interviews with state and non-state actors, and access to primary documents in order to provide a comparative examination of EU-based state and non-state actors within the Extractive Industries Transparency Initiative and draft EU legislation that seeks to prevent the trade of conflict-prone minerals.  相似文献

ABSTRACT

This article argues that resilience programmes in conflict-affected areas of limited statehood could be understood as much as an effort to equip vulnerable populations with tools to mitigate the effects of poverty, discrimination, lack of opportunities and manage gender inequalities than as an opportunity for the international community to prolong their interventions, consolidate local partnerships and sustain hope. We demonstrate our argument through an examination of the implementation in post-UNMIL Liberia of the ‘Spotlight Initiative’, a new multi-year multi-million programme of the European Union (EU) and the United Nations (UN) focused on the complete elimination of harmful practices and violence against women.  相似文献

欧亚大陆北部和中部的国家(包括欧亚地区最大的经济体俄罗斯和哈萨克斯坦),都认识到“一带一路”倡议的潜在价值。几年来,这些国家逐渐接受“一带一路”倡议各方面内容,期待增加欧亚地区交通基础设施投资并扩大运输量。欧亚地区交通运输量增加不仅能带来丰厚的利润,还能改善欧亚地区内部的互联互通。本文通过估算跨欧亚大陆过境运输量,分析欧亚地区北部和中部国家对“一带一路”倡议及自身利益的认知,以及相关国家对目前和未来的担忧,进而提出既对“一带一路”倡议更有价值又能促进欧亚地区北部和中部国家国际经济和制度能力提高的建议。  相似文献

The dominance of social science research in the debate over the Bush Administration’s Healthy Marriage Initiative may explain why questions regarding the proper role of government in regulating adult intimacy have received little attention. Social science research focuses on outcomes such as well-being and health. In contrast, rights-based legal theory considers whether state action undermines the rights of individuals. In this article, I intend to shift the debate over marriage promotion policy from questions of child well-being to questions of individual rights. I will ask the following questions: Do individuals have a liberty interest in making their own choices about intimate relationships, such as marriage? Do federally-financed (and frequently state-run) marriage programs compromise this liberty interest? Are there any constitutional grounds for objecting to marriage promotion policy?  相似文献
