论黑社会(性质)组织的特征与形态

我国《刑法》第 2 94条规定了“黑社会性质的组织”的概念 ,在 2 0 0 0年的相关司法解释中又概括了黑社会性质组织的特征 (“四特征说”) ,但对这个概念学界始终有较大的争议。一是因为国际上没有“黑社会组织”这一称谓 ,通用的是“有组织犯罪集团” ;二是由于这一提法引起了我国内地究竟有没有“黑社会组织”的疑问。黑社会性质组织与黑社会组织到底是什么关系 ,有何区别 ,在法律上怎样表述更为确切 ,文章从研究黑社会 (性质 )组织的特征与形态入手 ,对上述问题提出了一些看法     

When to Tell? : Disclosure of Concealable Group Membership,Stereotypes, and Political Evaluation

Although their group membership is normatively irrelevant to vote choice, members of politically underrepresented groups (e.g., women, nonwhites, and gays and lesbians) are often evaluated through the prism of their group memberships and related stereotypes when competing for elective office. Because membership in groups defined by gender, race, or ethnicity is easily perceptible, women and nonwhite candidates may have little control over the political effects of their group membership. Membership in groups defined by a candidate's sexual orientation is concealable, in contrast, and thus potentially gives gay and lesbian candidates some control over the impact of their homosexuality and accompanying stereotypes on voters' responses. Using an experimental design, I examine the relationships between timing of group membership disclosure, group stereotypes, candidate sex, and political responses to gay and lesbian candidates for office—taking into consideration voters' attitudes toward homosexuality and their sex.

综述了近年来有关心脏性猝死的分子生物学和电生理学的研究进展,着重讨论了心震荡、先天性长QT间期综合征和Brugada综合征,可能诱发致死性心律失常,发生心脏性猝死。这些功能性病症死亡常可导致病理解剖时无明显客观器质性病理改变。提示法医和病理工作者在遇到阴性解剖猝死时,应注意了解猝死的诱因、继往病史和家族病史,注意排除可能存在的这些病症。     

中国"社会中间人群"的特点与社会稳定

中国在迈向现代化的进程中 ,伴随社会转型出现了现代社会的结构变化。其重要表现就是“社会中间人群”的形成和凸现。社会中间人群的存在 ,有效地防止了社会两极分化 ,极大地减轻了社会不同阶层之间的相互摩擦和利益碰撞 ,削减了社会张力。社会中间人群的数量变化直接影响着社会稳定。在中国未来的发展中 ,社会中间人群将会是一个基本的社会力量     

抗Le~a和抗Le~b血清的研制

利用进口抗Le~a、Le~b血清筛选OLe(a+b-)和OLe(a-b+)型人,测定其唾液中Le~a和Le~b型物质含量,择其型物质含量高者唾液,用家兔和山羊免疫,合格后采全血,分离血清,用O、A、B型红细胞吸收、除去种属及α和β等凝集素。再用O型Le非相应型红细胞吸收,精制出含不完全抗体的抗Le~a和抗Le~b血清。该血清对Le相应型红细胞均产生明显凝集反应,而不发生非特异的交叉凝集反应。经过盲测鉴定,17份红细胞的Lewis型测定完全准确。制备的抗Le~a和抗Le~b血清在效价和特异性方面达到了引进的同种血清水平,填补了我国抗Le~a、抗Le~b血清制造的空白。     

肾上腺结核猝死的法医学鉴定

通过两例肾上腺结核猝死的案例观察发现：肾上腺和肾上腺以外器官的结核病变均表现为不典型的慢性陈旧性的病理学特征。提示在法医学鉴定中,对患过结核病和“不明死因”猝死尸体剖验时肾上腺的组织病理学检验尤为重要     

加拿大的警务工作及对我们的启示

加拿大的警察体制主要沿袭英国的体制。加拿大对群体性事件的处置非常注重建立高效、严密的指挥系统,特别重视风险评估和预案的制定。加拿大的警务工作给我们许多的启示:我们要深化对群体性事件的认识和理解,建立、完善预防和处置群体性事件的体系;要进行群体性事件的风险评估并科学地制定预案;要强调处置群体性事件的专业化和专门化,处置群体性事件战术的运用要规范、实用;要充分发挥我国群众基础好的优势,尽快制定《紧急状态处置法》,为处置群体性事件提供法律依据和法律手段。     

企业财务决策群体成员构成因素及建议

企业的财务决策重要而复杂,为了提高其正确率,规避其风险,企业财务决策必须实行群体决策方式。群体大小、成员的年龄和差异性等群体构成特征是影响企业财务群体决策绩效的重要因素。我国企业财务决策群体成员的构成,应结合企业实际选择合适比例的财务主体,根据决策内容确定决策群体的合理人数,确定合理的财务决策人员的年龄结构,适度加大财务决策群体成员的差异性和互补性,使结构优化。     

Careless with Our Democracy: Group Think and Voting Reform

The Representation of the People Act 2000 introduced what has come to be known as 'voting on demand'. In the process it paved the way for an absentee ballot system in Britain that would, in the words of the judge who heard two extraordinary electoral fraud cases in Birmingham in February and March 2005, disgrace a banana republic. Flaws in the policy making process that preceded the largely uncritical acceptance of universal access to postal votes were also exposed by failures to respond quickly to allegations of fraud and to detailed Electoral Commission recommendations aimed at improving ballot security. These failures raise serious questions about the prevalence of 'group think' in Whitehall and Westminster. The narrowness of Labour's General Election victory in votes, though not in seats, means that doubts about the integrity of Britain's voting arrangements threaten to reinforce a general loss of confidence in British politics.
