在低碳生活方式越来越成为社会共识的背景下,自行车骑行已迅速成为时尚旅游的新趋向,但我国在这方面的研究与投入几近空白。针对目前存在的问题与未来发展,相关部门应迅速推出切实可行的管理服务措施。     

论授益行政与损益行政诉讼中被告逾期举证后果之差异及完善

在行政诉讼被告无正当理由逾期举证的情况下,合理有效的法律后果有助于规制被告的违法诉讼行为。但是,相关立法混淆了损益行政行为与授益行政行为的差异性。两类性质不同的行政行为在被告违反举证期限的法律后果上理应有所区别。《关于审理行政许可案件若干问题的规定》第八条只对行政许可诉讼作出了不同的安排,亟待完善。

Comparative Implementation Research: Directions and Dualities

Abstract

The study of policy implementation developed steadily and considerably in the 1970s and 1980s through two generations of research. Since then progress towards a more rigorous scientific “third generation research paradigm”, assumed to be crucial for further theoretical development, has been much slower and more uneven. Comparative studies figure prominently in this respect. On one hand they are strongly encouraged but on the other they are difficult to conduct according to best practice advice in the textbooks. Comparative implementation research is the theme of this special issue. In this Introduction the articles included are presented, focusing on how they deal with some of the issues posed by the norms of a rigorous “third generation” approach. Reasons for the state of affairs in implementation research are discussed. Some inherent dualities and tensions in contemporary comparative implementation research are identified as particular challenges.     

Lived citizenship as the locus of political agency in participatory policy

Participatory policies seeking to foster active citizenship continue to be dominated by a territorial imagination. Yet, the world where people identify and perform as citizens is spatially multifarious. This article engages with the tension between territorially grounded perceptions and relational modes of practicing political agency. Studying empirically the Finnish child and youth policies, we address jointly the participatory obligations that municipalities strive to fulfill, and the spatial attachments that children and young people establish in their lived worlds. To this end, we introduce the concept of lived citizenship as an interface where the territorially-bound public administration and the plurality of spatial attachments characteristic to transnational living may meet. We conclude by proposing a re-grounding of lived citizenship in both topological and topographical terms as an improvement in theoretical understanding of mundane political agency and as a step towards more proficient participatory policies.     

内蒙古科尔沁非物质文化遗产法律保护的模式研究

内蒙古东部地区科尔沁非物质文化遗产保护的核心问题在于确立科学的保护模式和落实有力的保护措施,通过确认、立档、研究、保存、传承等措施,尊重历史的原汁原味生态环境及技能的价值;通过宣传、弘扬、传承和振兴等举措,重塑当代人的行为,建构保护科尔沁非物质文化遗产的科学模式。我们应以立法保护、行政保护和社会保护的系统工程,确立完整、规范的法律保护体系,特别是注意运用少数民族文化发展权,强化非物质文化遗产的地方性法规建设,在建设和振兴中国东北的过程中为科尔沁非物质文化遗产保护工作做出当代人的努力。     

我国宗教事务管理立法实施状况调查

经过改革开放30年来的大力发展,我国宗教事务实现了从政策主导向依法管理的转变,初步形成了有关宗教事务管理的法规规章体系。文章采取立意抽样的方法,通过较大规模的问卷调查和多场与爱国宗教界人士座谈,力求客观、全面地把握我国五大宗教教职人员、信教群众以及普通非信教群众对当前我国宗教事务管理立法实施状况的评价,从而为宗教事务管理工作的优化以及将来宗教事务基本法律的制定提供参考。最后就当前存在的问题与对策进行了详尽的阐述。
