从审美功能到社会功能:物质材料、展演及消费者——以加拿大因纽特人的雕刻艺术为例

艺术品作为艺术家"意识延伸"的一部分,具有某种能动性。即,艺术被创造的目的是要服务于社会关系网络。艺术品不仅仅要表现其样貌与风格所传达的意义,更为重要的是要表现其在创作过程中所包含的社会文化意义。从这个意义上讲,艺术除了美感以外的能动性,超越了纯艺术与工艺品、个人与社会的界限。因此,在对人类的审美和艺术的研究中,最需要关注的不仅仅是审美和艺术本身,而是在创作过程中,艺术品所表现的社会文化内涵。     

浅谈当代语境中动画的美学特征

当今社会已进入视觉文化占主导的时代,人们的思维方式和审美方式也随之改变,动画已成为当代最重要的艺术形式之一,其所拥有的属性和领域越来越宽泛,当代动画也随之出现了媒介化、真实化、奇观化、狂欢化等新的美学特征,这些美学特征,为我们进一步研究和探讨动画美学提供了新的角度。     

版权法保护技术措施的正当性

为了实施《世界知识产权组织版权条约》中有关保护技术措施的规定，我国与许多国家的版权法均同时保护旨在防止未经许可观赏文艺作品或运行计算机软件的“接触控制措施”和旨在防止未经许可复制、传播作品等版权侵权行为的“版权保护措施”。但版权法保护“接触控制措施”的正当性存在极大争议。不应以“接触控制措施”能够直接保护“复制权”(防止“临时复制”)和“接触权”以及间接保护版权作为版权法对其加以保护的正当性基础。因为中国版权法不承认“临时复制”为复制行为，也根本不存在所谓的“接触权”，并且只有部分“接触控制措施”能够间接保护版权。版权法保护“接触控制措施”的正当性在于其可保障作者等权利人在版权法中的正当利益，即从他人对作品的利用中获得合理报酬。根据这一正当性理论，如果某种“接触控制措施”无法保障权利人在版权法中的正当利益，版权法就不应对其加以保护。

随着经济的知识化与全球化,企业竞争的核心已围绕着技术创新展开。民营企业进一步生存和发展的根本出路在于通过技术创新拥有和行使知识产权。本文通过对＂正泰诉施奈德＂案例的思考,分析了知识产权对民营企业技术创新的价值,知识产权与技术创新的结合,探讨了技术创新导向下民营企业如何制定和应用知识产权战略,分析了浙江省地方立法对民营企业技术创新的知识产权保护措施。

技术创新乘数效应是一个有待拓展的重要理论命题。考察技术创新乘数效应的内在运行机理可以发现,技术创新乘数效应是通过规模经济、范围经济、联结经济和速度经济等形态生成的,并与福特制、丰田制和温特制等组织载体相耦合。因此,中国应通过多种路径为充分发挥技术创新乘数效应创造条件。

韦勒克的文学本体观

韦勒克力图将文艺社会学、形式派美学、结构主义美学、符号论美学、现象学美学融合起来,把文学外在的社会生活、意识观念方面同作品自身内在方面结合为一个符号和意义多层结构的整体,以克服文学内容与形式二元的对立,但是他并没有把它们真正有机地融合起来,骨子里仍然是形式本体的观念支配着.     

The fiction of female dependence and the makeshift economy of soldiers,sailors, and their wives in eighteenth-century London

Using accounts from the Old Bailey Proceedings, this article examines the economic side of military marriages in eighteenth-century London, outlining a fundamental disjuncture in eighteenth-century attitudes to working wives. While all wives were expected to work, state and parish records of military wives repeatedly stress their total dependence on men's wages and bounty money. In actual fact, soldiers, sailors and their wives made use of a much wider range of survival strategies. By stealing, taking odd jobs, pawning goods, and accepting aid from kin or friends, both husbands and wives might significantly augment military pay and/or poor relief.     

“The Mother of Reason and Revelation”: Benjamin on the Metaphysics of Language

This paper is a reconstruction of Walter Benjamin's philosophy of language, especially as it expressed in 1916's “On Language as Such and the Language of Man”. I read Benjamin's theory as a contribution to what Charles Taylor has called the “expressivist” tradition that includes eighteenth century thinkers like J.G. Herder and J.G. Hamann. Hamann's work and his interpretation of the theological concept of condescension are of particular importance. Although Benjamin's views are often regarded as impenetrable or mystical, they are relevant to and, in part, motivated by concerns of more mainstream twentieth century philosophy of language, in particular Russell's paradox. His “metaphysics of language” understands reference or designation, central to analytic theories of meaning, as derived from a more fundamental, aesthetic meaning.     

Pulses from the multitude: virtuosity and black feminist discourse

Using a dialogic format this conversation between two authors uses political theorist Paolo Virno's conception of the “multitude” to examine and compare two different arenas of black feminist protest that took place on social media in the latter half of 2013. As a performative article, it offers historical and theoretical background to the terms “multitude,” “public intellect,” and “virtuosic labor” in racialized capitalist formations, situating them to provide an alternative to the power of the State – an alternative that unlike the State does not claim to confer rights. The article looks at the Facebook response to a call from the Crunk Feminist Collective to white feminists to speak out on the verdict exonerating Trayvon Martin’s killer and offer counter images to those that describe Martin's killing as justified. It then looks at the public dialogue around the applicability of the term “feminism” to Beyoncé's self-titled “visual album.” Through aesthetic inquiry, the authors look at the form these examples of protest take to situate and propose the active viewing of these aesthetic forms by others on social media, as well as by the authors of this article, as a kind of virtuosic labor. The article concludes with a series of poems created using the “cut-up” technique designed to transmit feeling through subjective action and a task manifesto for white feminists to use as a guide.
