行政强制司法审查若干问题研究

如何确保人民法院的司法审查能够在《行政强制法》的规范下顺利地实施,是行政审判需要认真研究和解决的问题。人民法院对行政强制的司法审查要注意把握行政强制行为的基本特征、二重性以及基本价值,对行政强制行为要进行类型化处理,注意区分法律行为和事实行为,把握司法审查的内容和强度,处理好主从行为、先后行为以及行政强制权与相对人抵制权之间的关系,注意诉讼审查与非诉审查标准的区别。在强制拆迁中,尤其要把握好人民法院司法审查与行政机关具体实施之间的关系。     

2019年中国刑法实施报告

2019年是新中国成立70周年的伟大日子。70年来,在中国的刑事法治建设取得长足发展的同时,中国刑法学在始终恪守重视基础理论的总结、创新与完善的基础上,亦更加主动地回应社会现实关切的热点、疑点、难点问题,彰显出鲜明的时代特色,凸显出刑法积极参与社会治理的重要功能,弘扬了新时代我国刑法学鲜明的问题意识与自主意识。相较以往,2019年度刑事犯罪在涉众型、风险型、科技型等领域较为突出,呈现出涉案金额巨大、危害面广、手法多样且不断翻新等特点。2019年度刑法实施报告主要将以下七个板块作为研究重点:新中国成立七十年刑事法治和刑法理论的变迁与反思、正当防卫制度的适用与完善、"扫黑除恶"专项斗争、人工智能时代刑法挑战的前瞻应对、互联网金融领域腐败犯罪治理防范问题、认罪认罚从宽制度实体适用问题及民刑交叉、行刑衔接等问题。     

警察武力之善法良治——论警察武力法的正义价值标准

警察武力法的正义价值标准由标示正义价值方向的基本理念和标示正义价值尺度的基本原则两项基本要件分级承担并贯彻。中国警察武力法有:社会正义与法律正义有机统一、保权与控权有机统一和价值、规范、事实有机统一三个居位"法上之法"的基本理念和危害行为与武力行为法定、危害行为与武力行为相当、武力行为克减和多样化和正当程序四个居位"法上之法"的基本原则。上述基本理念和基本原则,对系统理解、把握中国警察使用武力的基本原则和构成要件、各种规范的内在关连性,以及构思未来的、"应然"的中国警察武力立法具有不可或缺的重要意义。     

艺术设计协同育人平台的建设与实践:以广东省外语艺术职业学院为例

针对广东省高职教育发展战略和珠三角文化创意产业需求,广东省外语艺术职业学院围绕提高创新能力这一核心目标,在艺术设计专业群进行试点,创建了艺术设计协同育人平台,经过探索与实践,提出了协同育人平台建设的路径与策略。     

浅析拐卖人口案件侦查之买方市场的防控

拐卖人口现象屡禁不止,根本原因之一是买方市场的存在及发展.本研究基于对拐卖人口买方市场存在发展的背景条件以及当前形势和防控难点进行分析研究,指出买方市场组成结构的复杂性与单方面打击不协调等问题.针对当前背景下采取系统作战方式应对拐卖人口新特点的重要性,通过咨询专家、文献研究以及与主要案发地区一线民警深入沟通,给买方市场防控措施提出相关建议,以期望对拐卖人口案件侦查有一定借鉴意义.     

论缓刑的法律性质--兼评缓刑考验期满后再犯罪成立累犯的合理性

缓刑在不同的刑事诉讼阶段所表现的主要特性是不同的,因而对其性质进行分阶段的界定也就有了现实的依据和合理性。从决定是否对犯罪分子宣告缓刑的意义上来说,缓刑有刑罚裁量的性质;从对犯罪分子具体适用缓刑的各项规定的意义上来说,缓刑又具有刑罚执行的性质。缓刑,兼具刑罚裁量和刑罚执行两重性质。在明确缓刑具有刑罚执行的法律性质的前提下,认定缓刑考验期满后再犯相应之罪的犯罪分子为累犯,就有了理论以及法律上的合理性。此种处置,从一般预防和特殊预防的角度来看,既符合中国社会重视行为人主观意志的现实,又能更好发挥刑罚预防犯罪的功能,也是符合我国现行刑事政策和法律规定的。     

French engagement versus British commitment. Was it interlingual miscommunication or political manipulation?

ABSTRACT

The efforts undertaken to establish the contemporary European Union started many years earlier. The history of establishing a pan-European organization is interesting not only for historians and economists but also translators and linguists as it is the history of interlingual communication (negotiations and agreements). One such negotiation was allegedly ineffective due to the difference in understanding the French term engagement and its English equivalent employed by translators and interpreters, that is to say the English term commitment. The authors aim at presenting the political background of negotiations and the social semiotic analysis of the terms in question in order to provoke the reader to find the answer to the question whether the negotiation was broken due to interlingual miscommunication resulting from erroneously chosen equivalent or it was destined to failure from the very beginning due to socio-political and economic interests of negotiating parties. In order to achieve that goal, the authors have analysed notes exchanged between the governments of France and Great Britain in course of negotiation. The history of negotiation and the linguistic analysis are combined to illustrate the complexity of meaning construction and the semiotic implications of the contextual dependence of meanings of terms and their dynamic evolution in time and space.     

The politics of landscape as ways of life in the ‘divided’ city: reflections from Mostar,Bosnia–Herzegovina

ABSTRACT

‘Divided’ cities – places of extreme exclusion and polarization – are sites where the paradox of both fragmentary and cosmopolitan capacity of the city comes to the fore. This article asks: What practices-in-landscape consolidate, construct and deconstruct the impression of a divided city? Drawing insights from the post-conflict Mostar, Bosnia and Herzegovina, the main argument I put forward is that urban infrastructures are a crucial medium through which social divisions and cohesions are performed and rearticulated on the ground. The article attends to the everyday of youth in Mostar turning to the politics of landscape as ways of life in the city.     

‘Without Education You Can Never Become President’: Teenage Pregnancy and Pseudo-empowerment in Post-Ebola Sierra Leone

ABSTRACT

This article analyses the emergence of ‘teenage pregnancy’ as a new policy focus in post-Ebola Sierra Leone and explores how Sierra Leoneans interpret the problem of ‘teenage pregnancy’. I argue that the new policy focus is not indicative of changing or new problems. Rather, ‘teenage pregnancy’ has created opportunities for donors and the Government of Sierra Leone to continue cooperation in gender politics. At the same time, Sierra Leoneans are clearly concerned about ‘teenage pregnancy’, and many agree with sensitization campaigns that responsibilize young women and girls while downplaying structural factors that render them vulnerable to arrangements involving transactional sex.     

政府与社会组织关系演进的历史逻辑

从总体性二元合一走向分化性二元合一,解决分化与耦合两个方面的问题,是中国政府与社会组织关系演进的总体态势。运用结构功能主义视角,可以发现,演进历经让渡与承接、规范与依附、激活与协同等阶段,由政府与社会组织的功能性界分,到基于责任结构整合的政会功能黏附,逐渐发展为基于全面结构整合的政会功能分化与耦合。演进的基本逻辑,是政府主导下功能演变与结构调整的互动,即由政府主导的演进轨道、由功能演变与结构调整互动而构成的演进机制。展望未来,分化性二元合一体系的完善,必须按照现代国家治理的要求,在政府与社会组织之间打造共建、共治与共享的结构功能系统,实现基于责任结构契合的功能目标一致、基于权力结构合理的功能形式耦合、基于利益结构规范的功能输出互益。
