中国特色社会主义理论向实践转化的评估体系的构建

构建中国特色社会主义理论向实践转化的评估体系,是有针对性地推进马克思主义中国化时代化大众化的现实需要,也是保证和提升马克思主义中国化时代化大众化的实践路径与制度创新研究的客观需要。     

法的现代性：一个虚构的理论神话

在当代中国，法的现代性理论虽然已成为一个引入注目的学术板块，但是，有两个方面的问题需要再审视。一方面，从现代性本身来看，它其实是一个虚构、虚拟的概念，而且已经异化成为一个符号化的图腾。另一方面，从现代性与中国法律、中国法治的关系来看，在历史上，法律移植虽然持续不断，但百年中国的法律移植与现代性无关；20世纪80年代以来，现代性虽然有力地塑造了中国的法学理论，但它对当代中国法治实践的塑造能力相当微弱，真实生活中的法律与法治只能按照实践本身的逻辑来演进，现代性不足以牵引中国法治实践的方向。这两个方面表明，虽然现代性这个词的价值与意义不容全部抹杀，法的现代性理论依然只是一个虚构的理论神话。     

Negotiating peace in Kosovo

We systematically analyze and forecast key developments before and during the Kosovo Crisis. Prior to the air campaign, we anticipated the breakdown of negotiations at Rambouillet and the subsequent initiation of hostilities. Without Russia as a mediator, we predicted that Milosevic would engage in military activity and strengthen his domestic control. As the war was being waged, we took a second look at settlement opportunities. Russia was identified as the key mediator needed to reach a settlement We show that a European‐led settlement offered promising prospects for peace. Finally, we demonstrate that the settlement achieved after the air war was not much different than the settlement that could have been achieved at Rambouillet The settlement on Kosovo offers only short‐term stability. To gain long‐term stability, the Serbians must either agree to the existing ethnic makeup in Kosovo or allow it to be partitioned. Otherwise, conflict in this region will likely revive.

我国党文化世俗化的理论建构

我国党文化世俗化是党文化揭开其神秘面纱,日益走向公民社会、世俗社会之中的过程,其在主体构成上通常包括党的思想文化、政治文化、组织文化、领导文化、执政文化的世俗化等基本内容。推进我国党文化世俗化有助于巩固党的领导地位、检验党文化的优劣性、完整展示党的性质、宗旨和任务。为推进党文化世俗化,在策略路向上要坚持做到:着力推进中国化、时代化的马克思主义之大众化进程,将党文化融合到建构完善实践社会主义核心价值体系之中,发挥党文化对社会文化的影响示范效应,以建设学习型政党,促进学习型社会建设。     

Coming to Grips with Realism

Retrieving Realism renders the joint philosophical goals of Hubert Dreyfus and Charles Taylor into what is probably their final and most concise form. It has two main objectives: first, it aims to deconstruct the mediationalism that undergirds Western philosophy, and second, it endorses contact theory, or embodied/embedded coping, as an alternative. In this essay, I present the book’s most salient themes and reveal areas that are ripe for further philosophical consideration. I also direct the reader to the work’s genuine ontological challenge: how to come to grips with contact theory beyond the borders of epistemology.     

公安学、警察学及其相互关系

公安即社会安全 (Socialsafety) ,是指人类社会的安全、稳定和秩序。公安学 (Socialsafetytheory)是关于人类社会安全问题的学问 ,研究什么是人类社会的安全 ,为什么人类社会会出现安全问题 ,怎样才能实现人类社会的安全 ,其主要范畴有安全、稳定、秩序和与之对应的战争、动乱、恐怖、灾害等。警察是指对人类社会的安全、稳定和秩序的守护 ,即对于侵害社会安全的事物的预防、察知、警报和即时抗击。警察学 (policetheory)是关于如何预防、察知、警报和即时抗击侵害社会安全的事物的学问 ,研究什么是警察 ,为什么要警察 ,怎样警察 ,其主要范畴有警察、安全、危害、犯罪等。公安学与警察学是两个区别很大的学科 ,但两者间的联系也不能忽视。     

中国引渡立法的若干理论问题

引渡法不是基本法。引渡法具有部门法的性质 ,是由一系列针对引渡事项的程序规则组成的法律 ,属于特殊程序法 ,又是解决国际刑事司法协助问题的专门法。引渡的性质是国家之间进行合作的一种形式 ,是国家实现司法主权的体现 ,仍然属于刑事法律范畴的事务。在我国引渡法中运用政治犯罪不引渡原则。引渡法中的裁定权主要有两类 :即行政裁定权和司法裁定权。我国采用行政审查和司法审查模式是可行的方案。在引渡法中引入人权保障的观念是现代引渡法发展的一个重要方面     

Human Security and Constructivism

This article explores the concept of "human security" as an academic and fledgling policy movement that seeks to place the individual—or people collectively—as the referent of security. It does this against a background of evolving transnational norms relating to security and governance, and the development of scientific understanding that challenges orthodox conceptions of security. It suggests that human security is not a coherent or objective school of thought. Rather, there are different, and sometimes competing, conceptions of human security that may reflect different sociological/cultural and geostrategic orientations. The article argues that the emergence of the concept of human security—as a broad, multifaceted, and evolving conception of security—rreflects the impact of values and norms on international relations. It also embraces a range of alliances, actors, and agendas that have taken us beyond the traditional scope of international politics and diplomacy. As a demonstration of change in international relations, of evolving identities and interests, this is best explained with reference to "social constructivist" thought, in contradistinction with the structural realist mainstream of international relations. In a constructivist vein, the article suggests that empirical research is already building a case in support of human security thinking that is, slowly, being acknowledged by decision-makers, against the logic of realist determinism.     

Jewish joke telling in Muttersprache Mameloschn: performing queer intervention on the German stage

This essay explores the central role of Jewish joke telling in Sasha Marianna Salzmann’s play Muttersprache Mameloschn (first performed in 2012). Subversively revealing the problematic of essentializing cultural, national, and even sexual identity, Jewish joke telling figures as a performance of social and political resistance and disidentification in this play. Engaging with Jack Halberstam’s queer epistemology of failure and José Esteban Muñoz’s theory of queer disidentification, I propose that the act of Jewish joke telling by a young lesbian plays out as a new queer project of intervention in this play that confronts both antisemitism and culturally positioned sexual hegemony.
