Developing and Testing a Soil Property Database for Forensic Applications in Southern California

The research sought to develop and test a forensic database of surface soil variability within previously mapped geologic and soil units in southern California. This type of database could be used to link suspects to crime scenes or determine source locations of soil sample evidence. Variability was evaluated using (i) color, (ii) magnetic susceptibility, and (iii) particle‐size distribution. Soil properties were analyzed for their ability to discriminate source areas using stepwise discriminant analysis. The percent correct predictions for geologic unit groups ranged from 30% to 100%. A blind study experiment matched four of the 18 samples to their unit of origin with the first choice by stepwise discriminant analysis, and eight were matched as second and third choices. The probability of selecting the appropriate unit of origin increased by 54% over random chance and eliminated as much as 99% of the field area as a potential search location.     

The information infrastructures of 1985 and 2018: The sociotechnical context of computer law & security

This article identifies key features of the sociotechnical contexts of computer law and security at the times of this journal's establishment in 1985, and of its 200th Issue in 2018. The infrastructural elements of devices, communications, data and actuator technologies are considered first. Social actors as individuals, and in groups, communities, societies and polities, together with organisations and economies, are then interleaved with those technical elements. This provides a basis for appreciation of the very different challenges that confront us now in comparison with the early years of post-industrialism.     

行为的异质性对税法规制的影响及其缓释思路——一种“能力——行为”的分析范式

税法上的"行为"范畴存在高度的异质性,建构统一的"财税行为"概念较为困难。税法领域,不同主体从事的行为性质各异又相互依存,均产生法效果,并需要接受税法的评价和规范;即便是形式上相同的税法主体,由于能力等因素的差异,外在的行为同样呈现突出的异质性。两个层面的异质性对于税法功能的发挥均产生一定影响,须于制度设计时有的放矢、妥为回应。在完善个人所得税制、藉此发挥分配规制的功能时,即应重视税法上行为的异质性,将纳税人的博弈行为纳入决策依据;区分博弈行为的不同层类,循"能力——行为"逻辑脉络辨证施治;同时关注纳税人之间因能力差异引致的行为分殊,在改进征税模式等核心税制时,俱应强调理论和实践的融通。

Child-related leave and women’s labour market outcomes: towards a new paradigm in the European Union?

The current European Union (EU) legislative framework on child-related leave is facilitating an imbalance in the take-up of leave by women over men. There is a consolidated EU right to maternity leave for mothers but there is no parallel EU right to paternity leave for fathers. The EU right to parental leave is for both working mothers and fathers, but its design does not encourage an equal take-up by women and men. The aim of this article is to gain insight into the effects of child-related leave on women’s labour market outcomes. On the one hand, it reviews and analyses economic literature which points to the adverse consequences of leave on women’s earnings, and even on women’s labour market participation when the absences from work are very prolonged. On the other hand, it underlines the new direction followed by the European Commission towards greater equality between men and women at home and at work.

目的 建立家兔氰化钾灌胃给药致死动物模型,研究氰化物代谢物2-氨基噻唑啉-4-羧酸(ATCA)在家兔体内的死后分布规律.方法 雄性家兔7只(体重约2.0kg～2.5kg)经口灌胃2LD50(10mg/kg)氰化钾水溶液,观察家兔反应,待家兔呼吸、心跳和反射全部消失后立即对家兔进行解剖取心、肝、脾、肺、肾、脑、睾丸、胃壁...     

组织RNA检测用于死亡时间推断的研究进展

近几年来利用RNA的降解程度来推断死亡时间已逐渐成为法医学研究热点.本文复习相关研究文献,对大鼠不同组织(脑组织、心脏组织、肝脏组织和肾组织等)中RNA在推断死亡时间的具体应用方法做出总结,归纳出不同组织中的各类RNA在推断死亡时间方面的适用范围,以及对此种方法在推断死亡时间的过程中产生的问题及可行性的解决方法.     

中国税权重构的法律思考

税权是分税制财政管理体制法的核心内容。我国于 1994年实行分税制财政体制 ,对税权进行了配置 ,但从多年运作的情况看 ,这种税权配置存在不少问题。就中国税权的重构作了一些初步探讨 ,并建议赋予地方以适当的税收立法权 ,合理划分税种 ,使地方政府的事权与财权相统一。

农村金融市场的监管是涉及到建设社会主义新农村和构建和谐社会的重要问题,目前农村金融市场的混乱导致农村的经济发展在源头上缺乏动力,外资的注入更使得农村金融市场迫切地需要选择经济法的路径进行监管。
