构建现代职业教育体系既是一个基本理论问题,也是一个重大现实问题。应当立足时代、把握国情、结合实际,对当今世界有代表性的职业教育体系进行正确比较,同时认真总结我国近现代关于职业教育体系建设的实践历程,以我为主,为我所用,为探索构建中国特色、世界水准的现代职业教育体系提供有益参考和科学借鉴。

Consumer Redress Legislation: Simplifying or Subverting the Law of Contract

The growth of statutory consumer protection regimes in modern commercial societies has the potential profoundly to disrupt the private law landscape. Such schemes aim to increase access to justice for consumers by offering simplified and clear suites of rights and corresponding remedies. In so doing, however, they affect core areas of private law rights and remedies, and may come to undermine or replace existing contractual principles and policies. The result could be an incoherent system of private law with different principles and rules applying to commercial and consumer transactions. Coherence in the law requires that lawyers abandon their traditional ‘oil and water’ attitudes to legislative schemes and confront directly the interactions between these two bodies of law. This paper engages in that enquiry by considering the relationship between the relatively new consumer redress provisions in the Consumer Protection from Unfair Trading Regulations 2008 and general law principles.

个人所得税是对个人取得的各项应税所得征收的一种税,是直接对自然人征收,是一种典型的直接税,其税负负担由纳税人直接承担而不能转嫁,对纳税人的收入和纳税人的生活影响很大,因此个人所得税与广大老百姓的利益密切相关。近年来,个人所得税的纳税筹划成为热门话题,本文以普通纳税人的角度,根据个人所得税的现实情况,分析个人所得税纳税筹划的法律平台和空间以及纳税筹划的技巧。     

Overview of: “The Impact of Drug Market Pulling Levers Policing on Neighborhood Violence: An Evaluation of the High Point Drug Market Intervention”

Research Summary Pulling levers policing draws upon the focused deterrence framework, which has shown considerable promise when directed at youth, gun, and gang offenders. However, much less is known about the viability of pulling levers when applied to different contexts as well as to diverse groups of offenders. We examine the High Point (North Carolina) Drug Market Intervention (DMI), the first site to use pulling levers as a place-based policing approach to disrupt a series of open-air drug markets across the city. Eleven years of longitudinal data are analyzed by using difference-in-difference panel regression analyses combined with finite mixture estimation as a means to test for divergence in violent crime patterns. Several key, although inconsistent, findings are presented. First, we found a statistically significant reduction in violent offenses in specific high-crime places (i.e., high-trajectory census blocks) located across the different targeted neighborhoods compared with the remainder of High Point, and relative to comparable nontargeted areas. Second, the citywide violent crime rate actually increased after a series of interventions unfolded, which may suggest limitations with the approach. Finally, trend analyses indicated the strategy had different levels of violent crime impact throughout unique geographic contexts. Policy Implications Rather than arresting every offender identified as having participated in illicit drug trafficking across various geographic contexts within the city, officials in High Point decided to invite low-risk drug offenders to community notification sessions in order to change their perceived risk of punishment as well as to mobilize community members across the different targeted neighborhoods. The suggestive evidence of potential, although limited, violent crime impact illustrates that this type of policing strategy may hold considerable promise. This interpretation gains credence when considered with prior evaluations of the DMI approach that illustrated the potential for reducing drug-related crime and in light of reports of improved police–community relations. The inconsistent findings across all locations and the overall city increase in violent crime toward the end of the study period, however, raise several concerns when interpreting study results. Additionally, our findings suggest that further replications should include systematic problem-identification, process measures, and more precise research designs.     

Self-control, Victimization, and their Influence on Risky Lifestyles: A Longitudinal Analysis Using Panel Data

This research expands past investigations into the influence of low self-control as a risk factor for criminal victimization. Specifically, we consider two questions: (1) whether low self-control at one point in time can predict future victimization, and (2) whether victims alter lifestyle choices (like their own delinquency and contact with delinquent peers) in response to their earlier victimization. We answered these questions using three waves of adolescent panel data from the evaluation of the Gang Resistance Education and Training program. Our results support the predictions of self-control theory, showing that low self-control measured at an earlier time is associated with later victimization, even after controlling for past victimization, delinquency, social bonds, and delinquent peer contact. Likewise, self-control appears to influence the relationship between earlier victimization and later lifestyles.
