WTO背景下的政府职能观

加入WTO ,加快了中国经济与世界一体化的进程。政府对经济和社会的管理在观念、体制和行为方式上需要做必要的调整。确立新形势下的政府职能观 ,改革和转变政府职能 ,必须遵循WTO规则。     

论行政不作为的国家赔偿责任

行政不作为是相对于行政作为而言的一种违法行政行为。行政不作为侵犯公民、法人和其他组织的合法权益造成损害的 ,国家应当承担赔偿责任。但我国现行《国家赔偿法》对行政不作为的国家赔偿责任没有做出明确规定 ,一定程度上影响了行政相对人的合法权宜。因此 ,应界定行政不作为的含义 ,明确国家对行政不作为承担赔偿责任的必要性及构成要件 ,进一步完善国家立法。     

土地利用分区管制论略

土地利用分区管制制度是一种质量与数量相统一的管理方式。与土地总量控制相比具有市场弹性,与土地用途管制相比亦有优点,因此,应当成为我国土地利用的管理方式。实行土地利用分区管制要遵循可持续发展的原则、土地集约利用的原则、综合效益原则、耕地特殊保护原则,并从丰富土地利用规划内容、创新土地利用规划方法与技术、协调不同土地利用规划功能和加强土地利用规划的实施管理等方面完善土地利用规划体系。     

Public Value Management: A Case Study of Transitional Change in Disability Sector Reform in Western Australia

This paper contributes to the study of public value management (PVM). PVM is distinguished from other approaches to public administration in its focus on establishing community networks and collaborative capacity building for the creation of public value. We explore PVM through a case study of a public–community sector partnership strategy called the positive behaviour framework (PBF), a state government initiative designed to transform services for people with disabilities. The development and implementation of the PBF is analysed via a transitional change or ‘sector awareness’ model. Each phase of the model is illustrated through ‘positive stories’ that depict key moments in the change process and in the activities that public sector managers employed to raise awareness, build capacity, and promote collaboration. We discuss the implications of the study for disability sector change management and for the further study of the PVM approach to public sector administration.     

道路交通事故死者MSCT扫描与尸体解剖结果的比较

目的使用多层螺旋CT(MSCT)对道路交通事故中死者的损伤进行观察分析,探索MSCT在道路交通事故鉴定中的应用价值。方法对10例道路交通事故死亡者进行全身MSCT扫描,随后进行系统尸体解剖,并将两者的结果进行对比,分析两者在获取交通事故损伤信息方面的优点和不足。结果 MSCT可以清晰显示身体各部位骨折三维形态特征,并可检查到全身各部位的积气,相对于尸体解剖优势明显;但对于器官和软组织损伤的检测,MSCT的分辨率有限。结论对于道路交通事故死者,确定死亡方式和死亡原因的最好方法是联合进行MSCT检查和尸体解剖。     

An information network of officials? Dissecting the role and nature of the network of parliamentary representatives in the European Parliament

Enhancing the role of national parliaments in the European Union’s decision-making process has for some time been a popular way in which policy-makers have sought to address legitimacy problems in the European Union, the Early Warning Mechanism being only one example. In response to these developments, an increasing number of scholars have addressed the question of how parliaments make use of these powers in practice. An important dimension of the process – the role of parliamentary officials in parliamentary scrutiny and control – has so far been neglected in the literature. Against this background, this article examines the role of the representatives of national parliaments in the European Parliament with the aim of understanding the role and the nature of this ‘bureaucratic network’. While falling short of an epistemic community, these officials play an important role in enabling parliamentary scrutiny through the dissemination of information.     

行政法治文化之功能分析——以与依法行政的关系为视角

我国政府大力推进的依法行政,虽然进入了新的发展阶段,但仍存在诸多问题。这与行政法治文化的不成熟不无关系。深刻认识成熟的行政法治文化之于依法行政的功能,不仅利于拓展行政的类型、丰富依法行政的内容,完善依法行政的具体方式,而且是整合行政过程中各方主体行政观念的宏观方法论。成熟的行政法治文化的社会化,决定着和谐行政秩序的生成。     

影响道路交通安全的若干因素

文章以2007年辽宁省本溪市明山区所发生道路交通事故的统计数据和典型案件为例,结合该区的具体情况分别从参与交通活动的人员、车辆、道路以及交通环境四方面要素,分析了影响交通事故发生的主要原因,提出了预防交通事故发生的几点意见,以确保道路交通安全。

道路交通事故鉴定在交通事故处理中,起着至关重要的作用。怎样认识交通事故鉴定的类型,是当事人及事故处理人员非常关切的问题。文章依据法律法规的规定,系统地论述了我国现阶段的交通事故鉴定的类型及鉴定人知识的构成类型。
