家族企业的治理模式研究

许多学者分别从关系、能力或信任等不同角度对家族企业的治理模式进行了有意义的描述,但这些分析的视角往往比较单一,并不能很好地解释各种因素之间的联系,与家族企业的实际运作模式并不完全相符。实际上,关系、能力与信任都会对家族企业的治理模式产生影响,且这些因素是相互作用的,综合地对企业的用人制度和管理方式产生影响。能否获得信任是家族企业人员能否获得某个岗位的重要影响因素,而关系和能力又是能否获得信任的重要影响因素。     

What Foster the Climate for Merit?: Test of a Mediation Model

ABSTRACT

The failure of performance management in the public sector can be conceived as the failure to create the right climate for merit. This study proposes a mediation model explaining howorganizational climate for merit can be fostered. The analysis of the 2015 Federal Employee Viewpoint Survey reveals that constructive use of effective performance feedback and encouraging participation will help create a climate for merit and that such associations were mediated by organizational justice perception and trust toward their supervisor.

作为公众与政府良性互动的集中体现，政治信任是国家政治体系存续和发展的重要保障，它为我们提供了观察治理实践以及国家与社会间关系的洞察力。农村稳定是农村发展和社会稳定的基础。因而传统政治文化的改造，基层政府绩效的评估，村级治理主体主人翁意识的培育、农村制度建设的加强以及基层政治腐败的防治，均是农村维稳中必然的路径选择。当前我国农村维稳主要存在着参与危机、信任危机、相对剥夺感和群聚性事件等困境。

This article analyses the cohesion of Addiopizzo’s anti-racketeering campaign in Palermo, Sicily. By supporting entrepreneurs who refuse to pay for protection and by encouraging consumers to support these companies through their consumer power, Addiopizzo has mobilised about 900 companies and 11,000 citizens. Taking social capital theory as a point of departure, this article explores the values of trust and norms of reciprocity among entrepreneurs who joined Addiopizzo’s anti-racketeering campaign. In addition, it analyses their solidarity with colleagues who are victims of extortion. Shared values express a stronger commitment to a movement, reinforce internal solidarity, strengthen the collective identity and reduce the risk of free riders and dropouts. The article reveals not only similarities but also important differences between various groups of joiners. The analysis builds on a unique data-set consisting of questionnaires collected from 277 entrepreneurs who joined the campaign between 2005 and 2011.

明确“背信损害上市公司利益罪”的立案追诉标准——从明确概念角度分析

背信损害上市公司利益罪是一个新类型的罪名,虽然刑法增设近5年的时间,但由于罪名相对陌生,司法实践中,对本罪的理解和适用,尚处于探索阶段。本文仅以2010年5月18日最高人民检察院、公安部出台的《最高人民检察院公安部关于公安机关管辖的刑事案件立案追诉标准的规定（二）》（以下简称《立案追诉标准（二）》）中涉及到的相关概念为切入点进行展开分析,以明确背信损害上市公司利益罪立案追诉标准,从而加深实践中司法人员的感性认识。     

Winds of Democracy Sweep the Country

NOWADAYS in China anyone–man or woman,urban or rural resident–can make their voice heard.They can vote for the representative they trust,assert their legitimate rights,and exert influence within their community or social group.This situation supersedes the past one where fixed mindset prevailed of unquestioningly obeying leaders and excessive caution in words and actions.Democracy at the grassroots level in China is reflected in a span of processes that include authorization,decision-making,participation,deliberation and supervision.They constitute a complete structure and system whose social function becomes steadily more important.Democracy at the grassroots level is an important part of people’s democracy in China.Its expansion in scope and depth consolidates the foundations of the country’s economic and social development.It also signals proactive reforms to China’s political system.     

我国单一背信罪的立法完善构想

建议在我国刑法中增设单一背信罪,并就罪刑条款、构成要件进行设计。在法定刑中建议不宜设置死刑,以自由刑为主,财产刑并用。在犯罪构成要件中建议,单一背信罪侵犯的客体是复杂客体;其客观方面表现为:行为发生在为他人代理事务或履行职务的过程当中,行为人为自己或第三人牟取利益而故意实施了背信行为,其行为给委托人造成损害;犯罪主体是特殊主体,是为他人处理事务的人,即受托人;主观方面只能是直接故意,过失不构成本罪。     

Is Citizens’ Trust Escalating the Effect of Sound Governance on Citizens’ Satisfaction in Ethiopia?

ABSTRACT

In the context of widespread criticisms to good governance, sound governance is proposed to be a viable alternative. This study examines the effect of sound governance on citizens’ satisfaction with the mediating role of citizens’ trust in the context of Ethiopia. Using a concurrent mixed method design, data were collected from eight key informant interviews besides 175 respondents through questionnaire. The results show the positive link between sound governance, citizens’ trust, and satisfaction. It also reports a partial mediating role of trust into the relationship between sound governance and citizens’ satisfaction.
