国际直接投资(FDI)动因的理论综述

20世纪初以来有关国际直接投资动因研究的理论成果可以分为三个阶段:20世纪60年代以前的国际资本流动理论,解释了利率差异引致的资本跨国流动;20世纪60年代—80年代初的国际直接投资理论,分别从微观、宏观层面阐述了企业跨国经营的成因;20世纪80年代以来的理论新进展,进一步讨论了垂直型FDI和水平型FDI的产生动因。这三个阶段的理论都解释了发达国家FDI的动因,关于发展中国家FDI和发达国家之间垂直FDI的原因还需要进一步的探索。

The Political Economy of U.S. Direct Investment in East Asian NICs, 1966–2000

This paper examines the role of FDI from the United States in the economic performance of East Asian NICs for 1966–2000. To this end, we draw our argument of the role of FDI from the modernization–dependency debate. Then, we test the economic effects of U.S. direct investment on economic growth in East Asian NICs using a neoclassical production function model that captures the economic impacts of both foreign and domestic investment on economic growth. Our empirical results show that U.S. direct investment has a positive and significant effect on economic growth in East Asian NICs.     

广西北部湾经济区主要产业投资计划及企业资金紧张的对策分析

本文分析了企业资金紧张的六个方面原因,根据不同原因提出不同对策。同时在产业投资计划的大背景下,分析了不同产业的企业融资的情形。资金密集型大企业其融资对策多;对于劳动或技术密集型中小企业融资,金融业要坚持择优扶强、优胜劣汰的原则,支持本地优势企业的创新与发展,并注意控制风险。由于劳动密集型中小企业是解决就业的主力军,同时受到工资不断上升的硬约束,金融政策及其他政策的扶持十分必要。     

The Politics of Foreign Direct Investment in Authoritarian Regimes

While political scientists find that democracy reduces political risk, little scholarship analyzes how authoritarian regimes attract foreign direct investment (FDI). This article argues that while authoritarian countries are generally risky, this risk can be minimized when authoritarian regimes are constrained from both “above” and “below.” Signing international investment treaties are critical for authoritarian countries to signal a commitment to FDI-friendly policies. However, only authoritarian signatories that allow some degree of public deliberation in their policymaking are then constrained from deviating from the policies of the international investment treaties. Panel statistical regressions and a case analysis support the hypothesis.

克拉斯诺亚尔斯克边疆区是俄罗斯重要的矿物资源基地之一。其丰富的燃料动力资源和矿产资源对国内外的投资者吸引力很大。该边疆区还是西伯利亚地区的科研中心,拥有高科技的智力创新潜力。区内还有大型出口企业,国际市场对谊地区出口商品的需求量多年来一直是稳增不减。所有这一切都为吸引外资开发该地区的自然资源,进而与毗邻地区共同参与经济全球化提供了有利的条件。     

中外双边投资条约中经济主权问题研究

本文对经济主权的实质、内容和特征进行探讨 ,并从中外双边投资条约的内容入手 ,对我国坚持经济主权原则之体现和弊漏作出分析 ,提出经济主权之实现应注意的问题。     

Research Note: Terrorist Groups as Business Firms: A New Typological Framework

Existing typological frameworks do not adequately categorize terrorist groups by their operational characteristics. We propose a new framework which compares terrorist groups to business firms. In our framework, terrorist groups are mapped on two axes: centralization of resources and centralization of operations. We separate terrorist groups into four typologies echoing familiar business arrangements: Hierarchy, Venture Capital, Franchise, and Brand. Responses to each typology are briefly sketched out. We conclude by analyzing the changes in Al Qaeda over the last two decades in the context of our framework. We close by proposing appropriate policy responses to combat Al Qaeda in light of its current Brand typology.     

地方政府投融资平台公司债务风险治理的私法向度简

地方政府投融资平台公司的设立是政府的一种行政私法行为,即行政主体为了达到公法上的目的而从事的私法活动。投融资平台公司功能的充分发挥吁求政府进行弱行政化治理,赋予平台公司更多的市场自主性,促使投融资平台公司在参与市场竞争以及承担政府职责之间寻得平衡。国发[2010]19号文件创设了清理地方投融资平台公司的有益机制。借由公司法以及担保法等民事立法向度,我们可以寻觅到治理地方政府违规担保、债务主体不明、滥发企业债券、混淆企业债务与政府债务等问题的路径,进而构建防治债务风险之体系。     

外商隐名投资纠纷的司法困局——以一起行政诉讼为切入点

《关于审理外商投资企业纠纷案件若干问题的规定(一)》针对外商隐名投资纠纷的处理确立了新的制度,明确在获得审批机关同意等条件下司法机关可以作出确权判决,其实质是将外资审批机关的外商准入审查引入民事诉讼程序,实现行政权与司法权在这类案件中的相互配合。然而司法实践却暴露了诉讼过程中当事人对审批机关的异议机制缺失的新问题。司法机关审理外商隐名投资纠纷的困局,根本上是由我国实行外商准入审批制造成的,审批制向备案制的转变将从根本上解决此类案件的司法困局。
