香港的海事审判管辖权

根据香港高等法院法令第12条的规定,介绍了香港海事法院的管辖事项的范围、管辖权的行使方式、提出管辖权异议的理由,以及香港海事法院的收费标准等。     

Coping with an unjust fate: The case of structural unemployment

Becoming a victim of structural unemployment means suffering an unjust fate. The present research examines the cognitive reactions subjects use to protect their belief in a just world and the related effects on their actual well-being within a sample of unemployed blue-collar workers in East Germany (all female). Results showed that the belief in a just world was positively correlated with attributing one’s unemployment to one’s own behavior and negatively with asking “why me?”, but uncorrelated with subjects’ readiness to change into another profession in order to get employed. Just world belief and depression were negatively related for those who either avoided the “why me?” question or who found an answer to it; but just world belief and depression was positively related for those women ruminating about an unanswered “why me?”. Results are consistent with the idea that the belief in a just world plays a significant role in the unemployed person’s coping process.     

《毛泽东思想概论》中"两个建议"的史实质疑与论证

我国高等院校党史教材和国内诸多史书论著,普遍认定“毛泽东思想两个建议”的史实。通过对《毛泽东思想概论》、《彭德怀自述》等有关“两个建议”史实不同版本的比较论证分析,可得出“中央革命根据地第五次反‘围剿’战役后期的两个战略性建议,不是毛泽东提出来的”史实结论,否定国内史学界近半个世纪以来所认定的普遍观点。     

侦查教学贴近公安实践的思考

侦查教学贴近实践,是培养实战型人才的重要环节。侦查工作的实践性特点和现实斗争的需要,培养实战型人才的重任落在教育部门肩上。如何在教学中贴近公安实践,与采取的教学手段相互关联。对侦查教学进行改革,协调整合理论和实践课内容的成分,提高教师业务水平,汲取基层实践经验,发掘教师资源,是当前侦查教学中的关键问题。

试论知识产权犯罪被害机理研究方法

传统被害研究范式认为，犯罪之因和被害之果是一种有序的联系，在因果之间完全可以用逻辑推理作为沟通桥梁。但逻辑不是万能的，在刑事法领域中，刑事疑难问题单纯凭借对法规则的逻辑适用并不能得到令人满意的解决，还应当正式引入实证研究方法从被害人和被告人两个角度进行经验层面的研究。     

试论我国刑事拘传的立法完善

与国外一些国家和地区的立法相比,我国有关刑事拘传的规定过于简略.为规范执法,保障人权,应扩大我国刑事拘传的对象、明确拘传的情形、延长拘传的时限、规定拘传的间隔、统一拘传的令状、充实拘传的程序,将"侦查"中有关拘传的内容集中到"强制措施"中,以完善我国的拘传立法.     

Capital punishment, criminals and enemies

Right of life and life are different concept. The former is endowed w by state beforehand, which is proved through his behavior that he is deserved to own the right of life. The one who thoroughly offend the basic norm in the law is the enemy of our realistic world. If only the enemy still have danger to threaten the society, he should be executed to death penalty, and deprived of his life, but will not happen the problem of miscarriage of justice and inhumanity. The criminal’s behavior just only denies part of norm in the law, however, who still is mankind and should possess of mankind’s dignity, so we must abolish death penalty on them, miscarriage of justice is another reason of course. __________ Translated from Peking University Law Journal, 2005(5) (in Chinese) by Mi Zhibin     

论利益衡量方法在行政诉讼原告资格认定中的运用

行政诉讼原告资格制度的目的在于建立一种筛选机制,其实质体现了法官在决定是否给予司法裁判时的利益衡量,因此利益衡量方法是界定原告资格的根本方法。原告资格的核心是法律上的利害关系,包括合法权益和因果关系两个主要构成要件,界定原告资格需要对这两者运用利益衡量方法进行分析。利益衡量标准与社会需求密切相关,个案中法官进行衡量时需要对社会主流价值取向、社会整体的道德情感以及公共政策等社会需求因素加以考虑。     

论并案侦查的推理形式

类比推理是根据两个或两个以上对象在某些属性上相似,推出这些对象在其他属性上相似,但不排斥类比推理根据两个或两个以上对象在某些属性上相同,推出这些对象在其他属性上相同。类比推理是一种独立的推理形式。在侦查中,决定并案侦查的推理形式是类比推理,不是归纳推理。并案类比推理可分为相似补缺类比推理和相似归并类比推理。
