Isotope evidence to link a suspect with a pipe bomb multimurder in Austria 1995

A bomb attempt in Oberwart, Austria, on February 4, 1995, was the culmination of several pipe and letter bomb attempts mainly in Austria. The pipe bomb had been mounted on a self-made gypsum (plaster of Paris) pedestal and exploded when touched, killing four persons. With a level of 200 tritium units (TU), the water extracted from the gypsum pedestal was unusually enriched in tritium (3H) compared to an environmental level of about 20 TU at that time. Investigation of the 3H content of air moisture in the living room of an arrested suspect showed values of about 1000 TU (normally, 50 TU is not exceeded). Additionally, water used as sealing liquid in a glass with nitroglycerine found in the living room was also significantly enriched in 3H (>400 TU). The living room therefore offered the high 3H level environment necessary to lead to elevated 3H concentrations in the gypsum pedestal.     

The Fallout to the Guide to the Proposed Basin Plan

The political fallout from the release of the Guide to the Proposed Basin Plan in the Murray‐Darling is illustrative of the difficulties associated with reallocating water resources in this context. The response of Minister Burke has been somewhat predictable, with a resurgent interest in public subsidy of irrigation infrastructure evident. This article is used to examine the policy background to the Guide and critically consider further subsidy of irrigation infrastructure. The article concludes that infrastructure investment at the expense of the public purse will fail to deal with the problems at hand and generate a plethora of additional future problems.

论我国水资源的所有权客体属性及其实践功能简

水资源的日益重要性使其在法律上逐渐与土地资源分离,成为独立的所有权客体,且不悖于所有权客体特定性原则。在比较罗马法中的共用物、法国的公产、德国的公物及日本的公用物、公共用物等公共物品类型的基础上,应将我国的水资源界定为公共用物并为其选择所适用的法律规则。水资源公共用物的定性不仅有利于彰显水资源负载利益的全民性,将其与满足行政目的的公用物相区分,而且为理顺水资源由全民所有、宪法上国家所有至民法上国家所有等所有权类型的转化路径,直到为人人平等享有用水机会创设的水权制度提供了深层理论基础。     

Prediction of Projectile Ricochet Behavior After Water Impact*

Abstract: Although not very common, forensic investigation related to projectile ricochet on water can be required when undesirable collateral damage occurs. Predicting the ricochet behavior of a projectile is challenging owing to numerous parameters involved: impact velocity, incident angle, projectile stability, angular velocity, etc. Ricochet characteristics of different projectiles (K50 BMG, 0.5‐cal Ball M2, 0.5‐cal AP‐T C44, 7.62‐mm Ball C21, and 5.56‐mm Ball C77) were studied in a pool. The results are presented to assess projectile velocity after ricochet, ricochet angle, and projectile azimuth angle based on impact velocity or incident angle for each projectile type. The azimuth ranges show the highest variability at low postricochet velocity. The critical ricochet angles were ranging from 15 to 30°. The average ricochet angles for all projectiles were pretty close for all projectiles at 2.5 and 10° incident angles for the range of velocities studied.

对我国《水法》关于水资源流域管理规定的思考

2 0 0 2年《水法》确立了水资源流域管理制度 ,设立了流域管理机构。本文认为《水法》对流域管理机构的规定在实践中难以真正落实流域管理制度 ,将导致流域管理机构的管理效果不显著 ,影响水法对正义价值的追求。建议建立健全具有权威性和独立性的科学的流域管理机构体系 ,强化流域水资源的宏观管理 ,弱化微观管理 ,增强服务功能。

在水资源日益紧缺的客观形势下,我国需要建立市场机制的水资源有偿使用制度。水权制度是水资源有偿使用制度的前提和基础,而《水法》从法律上确立了水资源的有偿使用制度。在完善水资源费征收管理制度中,水资源价格是水资源配置市场化的基础和条件。水资源的开发利用要与生态环境保护相结合,做到节约用水和生态用水。
