Ethnische Ressourcen: Das Beispiel der Bilingualität

Taking bilingualism as an example, this contribution addresses the hypothesis that ethnic resources play an important role for the integration of migrants. This assumption is particularly prevalent in more recent concepts of the sociology of migration like, for example, in the concept of “segmented assimilation”. We will address four different questions: the importance of mother tongue skills for school achievement, the effects of mother tongue education programs on school achievement, the impact of mother tongue skills on labour market success in general and then particularly in Canada as a frequently cited example for a country pursuing an “adequate” language and integration policy. The evidence suggests that mother tongue skills (as well as inner-ethnic relations) virtually never display empirically provable effects on educational and labour market success. At least regarding processes of language acquisition and its consequences, the concept of intergenerational absorption through (linguistic) acculturation is still valid, which also holds for Canada.     

“Critical Empiricism” in American Legal Studies: Paradox,Program, or Pandora's Box?

Death in inverted head position

A 56 year old man was found suspended in a sack in a head down position. Circumstances and autopsy findings are discussed. The leading pathophysiological mechanisms causing death are thought to be asphyxia due to compression of the chest and insufficient blood supply to the heart due to the head down position. The pathophysiological dysregulation of circulation in a head down position is discussed.     

Institutionalizing Industry: The Changing Forms of Contract

A replication of Macaulay's 1963 study of Wisconsin manufacturers shows that manufacturers are using a new type of contract to govern changed transactions and to establish new form of industrial organization. This article seeks to specify these changes and to demonstrate their theoretical significance by constructing an empirically and theoretically informed analytical framework. This framework establishes relations of meaning between discrete contracts, job shop production, and classical contract law; between openterm contracts, mass production, and neoclassical contract law; and between long-term agreements, flexible production, and a "shadow" relational contract law. It demonstrates that long-term agreements constitute a new device for governing exchange, that they are part of a broader change from mass production to flexible production, and that their distinctive features are not recognized by neoclassical contract law.     

Bank power in West Germany revised

This article examines the empirical and theoretical validity of the power of banks over industry in West Germany. An outline of the historical development, structure and institutions of credit in the Federal Republic is followed by discussion of the three alleged factors behind the banks' power: the functional linkage of bank and industrial capital; property rights and ‘personal influence’; the planning and economic guidance capacities of the banks. Finally, it is argued that the thesis of bank power in Germany, in the light of empirical evidence and theoretical reflection, should be somewhat more differentiated.
