Abstract. The paper examines the current discussion in liberalism around the issue of the "neutrality" of the state. It scrutinizes the "political liberalism" defended by John Rawls and Charles Larmore and shows that the consequence of their approach is to evacuate the dimension of "the political" from the idea of a well-ordered society. By presenting the exclusions existing in their model of liberal society as the product of free agreement resulting from rational procedures, "political liberals" offer us a picture in which antagonism, violence and power have only disappeared because they have been made invisible. The consequence is to leave liberalism unable to conceptualize power and antagonism. The paper concludes that there cannot be such a thing as a "neutral justification of the neutrality of the state" (Larmore 1987) and that a pluralist perfectionist perspective like the one proposed by Joseph Raz offers a more adequate way to envisage the specificity of modern pluralist democracy.  相似文献

This article makes a further contribution to opening the ‘black box’ of micropractices in ministry–agency relationships. We argue that the mechanisms that come into play in the course of institutionalizing agencification reforms – such as renegotiating mutual roles and rules in ministry–agency interactions – are only poorly covered in the existing literature. To adequately address the negotiated and contingent nature of de facto agency autonomy and political control, we develop an interpretive approach based on the concept of ‘boundary work’. The empirical focus is on ministry–agency interactions at the science–policy nexus in the contested policy field of food safety. By studying actors' stories about the institutionalization processes following the fundamental reorganization of the German food safety administration in the wake of the BSE crisis from a longitudinal perspective, we show how actors manage boundary conflicts via increasingly differentiated backstage coordination.  相似文献

In this paper, results are introduced of an empirical study which investigated the practice of occupational health and safety regulation in two countries, Great Britain and West Germany. The analysis concentrates on the specific relationship that regulatory agencies and the concerned interest groups, employers and trade unions, develop in the two stages of policy formulation and implementation of health and safety regulation. Results show that interest groups actively participate in the regulation-making systems in both countries. Their policy pursued in this process is influenced and mediated by their actual resources as well as by individual views and assessments of each side's representatives. In Germany, a strong fragmentation with numerous private and quasi-governmental bodies entitled to formulate standards makes it difficult for the interest groups to concentrate on the competent and important committees. In contrast, we find a clearer responsibility of bodies and committees in the case of Britain. In both countries, enforcement policy prefers an advisory and persuasive style even though the legal backgrounds are quite different.  相似文献

In this study, we investigate who would vote ‘none of the above’ (NOTA) if this were available on the ballot paper using original data from eight European countries. In particular, we examine whether NOTA would be used by abstainers and voters to protest within the electoral process. We also test whether socioeconomic factors and specific and diffuse support for democracy and its institutions correlate with a NOTA vote. We find that having NOTA on the ballot would reduce invalid balloting more than abstention and much more than protest party voting. Our results also suggest that NOTA is related to socioeconomic status, political interest, political knowledge and distrust in political institutions and authorities, but not to broadly undemocratic attitudes. These findings have important implications for our understanding of the increasingly large amounts of abstention and invalid voting, as well as the growing distrust of political institutions, in democratic countries. They also hold lessons for electoral reformers.  相似文献

The article summarises key aspects of government intervention in the British film industry since the election of a Labour government in 1997. The process of amalgamating a variety of existing institutions (including British Screen, the British Film Commission and the Arts Council's Lottery Film Department) into the new UK Film Council is described and the implications for developments in the English regions is considered. The issue of the continuing American dominance of the industry is explored and this is related to the contentious concept of an economically 'sustainable' domestic industry. In conclusion it is proposed that more careful attention be given to the cultural and educational implications of current policy.  相似文献

abstract This article asks whether attempts to achieve gender equity in the workplace are limited by globalization. On the one hand, globalization has been seen to curtail ambitions for equity in employment because of the increased power of global capital as compared with labor, including within the state. On the other hand, there are two counter tendencies. One is the modernization of the gender regime, which has restructured gender inequalities and developed new political constituencies among women, and the other is the development of new polities, in particular the European Union, in response to the perceived challenge of globalization. I investigate the impact of these crosscutting changes on policies aimed at gender equity in the workplace in the UK. I consider data on changes in gender equity in the workplace and developments in employment policy, especially increased education and the changing regulation of working time and equal opportunities policies. The article concludes that globalization does not lead to the weakening of all polities, that the EU has become increasingly powerful in the context of globalization, and that despite the weakening of labor, the increased education of women and the increased articulation of women's political voices has led to improvements in some dimensions of the position of some women in employment.  相似文献

In the course of the legislative process, legislators choose how much policy discretion to delegate to the executive branch. Uncertainty about policy outcomes and bureaucratic intentions weighs heavily in such decisions. In Brazil, executive control over the budget creates uncertainty about the availability of discretionary spending, which results in comparatively high levels of delegation in the legislature's direct‐spending decisions. I demonstrate that sidelining the legislature from the budget in order to insulate government spending from political pressures diminishes the value of legislative work in Brazil and reinforces historical patterns of policymaking centered on the federal executive.  相似文献
