Five years after the Arab Spring: a critical evaluation

A new political geography has emerged in the Middle East and North Africa (MENA) after the Arab Spring. The transformative impact of the popular upheavals appeared to put an end to long-term authoritarian regimes. Today, the region is far from stable since authoritarian resilience violently pushed back popular demands for good governance and is pushing to restore former state structures. However, the collective consciousness of the popular revolts endures, and a transformative prospect may emerge on the horizon. The chaotic situation is the result of an ongoing struggle between those who seek change and transformation and others in favour of the status quo ante. A critical evaluation of the Arab Spring after five years indicates a continuous process of recalculation and recalibration of policies and strategies. There are alternative routes for an eventual settlement in the MENA region, which are in competition against both regional and transregional quests for a favourable order.     

The partisan–professional dichotomy revisited: Politicization and decision‐making of senior civil servants

Politicization has an ambivalent reputation among public administration scholars. While considered an effective instrument to safeguard political control over ministerial bureaucracy, partisanship of senior civil servants is likewise associated with patronage and is deemed detrimental to professionalism and meritocracy. To scrutinize this contradiction, the article examines how the party‐political background of senior civil servants influences their decision‐making behaviour. Two theoretically derived conceptions of loyalty are therefore put to the test: responsiveness and responsibility. Effects are captured by using the vignette technique in 40 in‐depth interviews with former senior civil servants from ministerial departments at federal and state level in Germany. The results are surprising in so far as they reveal that politicized senior civil servants act neither more responsively nor less responsibly than their non‐politicized peers. These findings challenge common assumptions and call for a more refined analysis of the conditions under which politicization leads to negative effects.     

Territorial reforms in Europe: effects on administrative performance and democratic participation

Territorial reform is the most radical and contested reorganisation of local government. A sound evaluation of the outcome of such reforms is hence an important step to ensure the legitimation of any decision on the subject. However, in our view the discourse on the subject appears to be one sided, focusing primarily on overall fiscal effects scrutinised by economists. The contribution of this paper is hence threefold: Firstly, we provide an overview off territorial reforms in Europe, with a special focus on Eastern Germany as a promising case for cross-country comparisons. Secondly, we provide an overview of the analytical classifications of these reforms and context factors to be considered in their evaluation. And thirdly, we analyse the literature on qualitative performance effects of these reforms. The results show that territorial reforms have a significant positive impact on functional performance, while the effects on participation and integration are indeed ambivalent. In doing so, we provide substantial arguments for a broader, more inclusive discussion on the success of territorial reforms.     

Anthropological stranger: the intellectual trajectory of Hortense Powdermaker

This article investigates the life and works of Hortense Powdermaker (1896-1970). In contradistinction to the intellectual climate of her times, Powdermaker's intellectual trajectory can be characterised as eclectic, dynamic and forward thinking. Spanning nearly four decades, Powdermaker's academic career was dedicated to developing a distinct ‘anthropological vision’. Yet, although she conducted studies of culture and society that transcended structures of orthodoxy and charted alternative theoretical and methodological terrain, in turn establishing herself as a pioneer of contemporary anthropological thought, Powdermaker's work has failed to gain incorporation into wider disciplinary research agendas. Set within a sociology-of-intellectuals framework, it is argued that Powdermaker occupies a peripheral position in the history of anthropology – a position which does not adequately reflect the significance of her work – and that Powdermaker's greatest intellectual contribution was her innovative epistemology and sophisticated ‘anthropological vision’. Nonetheless, as a result of the powerful traditions and orthodox schools of thought which reigned supreme in mid-century anthropology and sociology, she was unable to exert any enduring influence on British or American social thought.     

Death due to unusual position of the body--an explanationfor the consequence of reduced venous reflux to the heart

The article describes the case of a 29-year-old woman who was found dead in her apartment on a bar stool with the body being maximally retroflected in the lumbar region, the head hanging down and the feet and hands barely touching the floor. On external inspection of the body the cuff-like distribution of hypostasis on the forearms and lower legs was consistent with the position in which the body was found. There were no signs of foreign intervention. At autopsy massive congestion was found in the internal organs as well as pulmonary and cerebral edema. In the ventral region of the lumbar intervertebral discs superficial hemorrhages were detected. The alcohol content was 3.40 per thousand in the blood and 4.43 per thousand in the urine. As the essential pathogenetic mechanisms responsible for death reduced venous reflux to the heart in combination with postural asphyxia and the influence of alcohol are discussed.     

NEW FEDERALISM, OLD REMEDIES, AND CORRECTIONS POLICYMAKING

Corrections litigation is changing, but new case law does not authorize a wholesale cutback of prisoner constitutional rights. Supreme Court cases urge a return to traditional compensatory damages as the remedy for unconstitutional acts and conditions. Monitoring of state correctional performance by federal courts is disfavored. The author believes that basic rights of prisoners will remain protected, but that systematic planning and exemplary programs will erode. Under the money damages model, legal reform should thus urge waiver of the state sovereign immunity provided by the Eleventh Amendment.     

A case of sudden cardiac death in connection with Salmonella typhimurium infection

A case of fatal myocarditis in a 24-year-old otherwise healthy man is described. It was possible to cultivate Salmonella typhimurium from the alimentary tract, the blood, the liver and skeletal muscles. The possibility of a solitary myocarditis with fatal outcome due to Salmonella typhimurium infection is discussed. Such a case seems not to have been mentioned previously in the literature.The problems concerning the statistical registration of such a death are briefly discussed.     

Legal outcomes and legal agents

Although a number of theories of law stress the importance of examining the characteristics of deviance processing agents for understanding criminal sanctioning, empirical studies have generally neglected these variables. Using data from a sample of convicted felons, this study looks at (1) both the additive and interactive effect of the probation officer's gender on sentencing recommendations accorded male and female offenders and (2) whether the social and political context, measured by the time span 1965–1980, alters any noted dyadic effects. The results indicate that both male and female officers recommend that female offenders receive the less severe sentences. Moreover, the context in which these recommendations are made has almost no appreciable effect. The implications of the findings for both the available theoretical frameworks and policy considerations are discussed.
