Third Party Participation in Investment-Environment Disputes: Recent Developments

This article outlines recent developments in investor–State dispute settlement related to the participation of third parties in arbitration. A particular focus is given to third party participation in disputes with a clear public interest based on the relevance of the cases to the protection of the environment, or sustainable development more generally. The benefits and drawbacks of third party participation and the relationship of participation to broader issues of transparency are also briefly discussed.     

Misremembering Events: Emotional Valence,Psychopathic Traits,and the Misinformation Effect

Past research has demonstrated increased susceptibility to misinformation under varying conditions, including negative emotional scenes. In addition, psychopathic traits have been associated with emotional deficits which may lead to differences in memory processing. The present study examined emotional valence and psychopathic traits in relation to the misinformation effect. Participants (n = 334) were exposed to emotional scenes (positive, neutral, negative), completed a measure of psychopathic traits (PPI-R), and were asked either misleading or nonleading questions. Accuracy and susceptibility to misinformation were assessed through a series of open-ended questions and accuracy scoring. Accuracy was highest for both emotional (60%) relative to neutral (53.9%) images. Memory differences in recall of negative versus positive scenes was evidenced dependent on attentional focus. Participants in the misled condition were less accurate in their recall overall, and recalled more misleading information (41.18% relative to 14.16%). In addition, individuals who received misleading suggestions were more likely to incorporate the major misleading detail into their memory for the negative scene. Psychopathic traits were not related to accuracy; however, those high in psychopathic traits tended to incorporate more misinformation into memory. Our results have important implications concerning how individuals remember emotional events, including people high in psychopathic traits, and follow up studies considering attention/motivation and misinformation are required.     

Detection of Gunshot Residue on Dark‐Colored Clothing Prior to Chemical Analysis

Detection of gunshot residue (GSR) is an arduous task for investigators. It is often accomplished with chemical tests, which can reveal elements and ions indicating the presence of GSR, but are likely to cause physical alteration to the pattern. In this study, the Spex Forensics Mini‐CrimeScope MCS 400, along with 16 accompanying wavelength filters, was applied to various GSR patterns and target types. Three dark shirt materials, four ammunition calibers, and eight ammunition manufacturers, along with the primer residue of the different manufacturer ammunitions were tested. Results indicate the alternate light source wavelength of 445 nm to be the optimal setting. In addition, target material plays a large role in the preservation of GSR patterns as particles burn. Furthermore, it can be extrapolated that residue, observed from a full round and firing distance of six inches, is mostly composed of unburnt gunpowder residue, not primer residue.     

Trends in Officer‐involved Firearm Deaths in Oklahoma from 2000 to 2015

The purpose of this study was to collect data and disseminate trends in officer‐involved firearm deaths in Oklahoma from 2000 to 2015. The Oklahoma Office of the Chief Medical Examiner (OCME) database was searched for civilian decedents with gunshot wounds inflicted by law enforcement officers and officer decedents with gunshot wounds inflicted by civilians. Five decedents were law enforcement officers, while 274 decedents were civilians. The number of civilian decedents throughout the study followed a quadratic trend. Civilian decedents were most commonly males (95%) between the ages of 20 and 39 (64%), had one or two gunshot wounds (46%), and had an increasing number of gunshot wounds over time. Postmortem toxicology testing most commonly detected ethanol, methamphetamine, cocaine, and PCP. Efforts toward increased tracking by various agencies and more scientific studies like this are needed to facilitate future analysis of trends in officer‐involved firearm deaths.     

Raising the Bar: Maximizing Engaged Student Learning Using the American Mock Trial Association Case State of Midlands v. Dylan Hendricks

Abstract

This short review demonstrates how the use of American Mock Trial Association (AMTA) case materials, both throughout intercollegiate competitions and in academic courses, can engage and invigorate students while teaching them crucial skills in a way that few other programs or activities can do. The AMTA case provided for the 2017–2018 academic year, State of Midlands v. Dylan Hendricks, offers a comprehensive introduction to the rules of evidence and crucial criminal law concepts while teaching students the importance of thorough preparation in a way that is difficult to do in a classroom setting. This case requires student attorneys to make difficult choices while preparing their case, witnesses, and evidence for trial. Arriving at an optimum strategy (or strategies) can only occur after critical and reasoned examination of each side of an often complex problem, thereby providing an excellent opportunity for students to use critical thinking skills and to analyze all sides of an issue and all potential outcomes of a strategy. Students must thoroughly study and understand the rules of evidence, rules of criminal procedure, and relevant statutory and case law, and be prepared to use all of these as part of a reasoned, logical argument at a moment’s notice. Overall, this is an exceptional case for skill-building and engaged learning, and can be a valuable tool for faculty and students alike.
