Law schools are seeking ways to familiarize family law students with exciting new professional roles arising in connection with family court reform. This article describes the family law externship program at William Mitchell College of Law which includes a classroom component allowing students placed in different practice settings to compare and contrast their experiences. A sensitive analytical method was developed for quantitative analysis of delta(9)-tetrahydrocannabinol (delta(9)-THC), 11-nor-delta(9)-tetrahydrocannabinol-carboxylic acid (delta(9)-THC-COOH), cannabinol (CBN) and cannabidiol (CBD) in human hair. The identification of delta(9)-THC-COOH in hair would document Cannabis use more effectively than the detection of parent drug (delta(9)-THC) which might have come from environmental exposure. Ketamine was added to hair samples as internal standard for CBN and CBD. Ketoprofen was added to hair samples as internal standard for the other compounds. Samples were hydrolyzed with beta-glucuronidase/arylsulfatase for 2h at 40 degrees C. After cooling, samples were extracted with a liquid-liquid extraction procedure (with chloroform/isopropyl alcohol, after alkalinization, and n-hexane/ethyl acetate, after acidification), which was developed in our laboratory. The extracts were analysed before and after derivatization with pentafluoropropionic anhydride (PFPA) and pentafluoropropanol (PFPOH) using a Hewlett Packard gas chromatographer/mass spectrometer detector, in electron impact mode (GC/MS-EI). Derivatized delta(9)-THC-COOH was also analysed using a Hewlett Packard gas chromatographer/mass spectrometer detector, in negative ion chemical ionization mode (GC/MS-NCI) using methane as the reagent gas. Responses were linear ranging from 0.10 to 5.00 ng/mg hair for delta(9)-THC and CBN, 0.10-10.00 ng/mg hair for CBD, 0.01-5.00 ng/mg for delta(9)-THC-COOH (r(2)>0.99). The intra-assay precisions ranged from <0.01 to 12.40%. Extraction recoveries ranged from 80.9 to 104.0% for delta(9)-THC, 85.9-100.0% for delta(9)-THC-COOH, 76.7-95.8% for CBN and 71.0-94.0% for CBD. The analytical method was applied to 87 human hair samples, obtained from individuals who testified in court of having committed drug related crimes. Quantification of delta(9)-THC-COOH using GC/MS-NCI was found to be more convenient than GC/MS-EI. The latter may give rise to false negatives due to the detection limit.  相似文献

This paper analyses the parliamentary debates over two key pieces of legislation on family law approved in Chile between 1994 and 2004. The aim is to identify the discursive representations on gender and family predominant in these debates. These representations and the way in which they were negotiated in Congress, it will be argued, were a key factor in determining the approval and final text of each of the bills examined. When women's demands for greater autonomy were in tension with prevalent ideas on the traditional, hetero-normative family, such tension was resolved in favour of the latter as the discursive category that allowed negotiations to progress. As a result, although the new legislation brought about positive change, it did retain the ideal of the traditional, sanctioned-by-marriage family at its basis, and as the one the State should protect. Methodologically, this paper is based on the qualitative analysis of 4000 pages of parliamentary debate and in-depth interviews with legislators and government officials directly involved in the debate on each of the laws examined here.  相似文献

A prosecutorial organ is always in charge of the investigation and prosecution of crime, which makes this institution a key gatekeeper to the courts. Empowered with prosecutorial discretion, a prosecutorial organ dictates what, when, and whom to prosecute. The institutional design of the prosecutorial organ varies across time and across countries, which raises an important, yet quite understudied question: Does institutional design matter for how states respond to human rights violations and, if so, how? In this article, I develop a theoretical framework that highlights the importance of prosecutorial independence and prosecutorial accountability. I argue that understanding the factors that impact the use of prosecutorial discretion in human rights cases can potentially provide a more complete understanding of why and when states fail to investigate, to prosecute, and to punish human rights violations committed by state agents.  相似文献

Methanol is a potent neurotoxic substance that causes severe metabolic acidosis and serious neurological disorders. Most of the cases are accidental exposures to drinking beverages contaminated with methanol. There are few articles reporting pure methanol intoxication; however, it is well known that small quantities of pure methanol causes blindness and death, the minimum lethal dose being 50-100 ml.A case report is presented of a 67-year-old woman, who committed suicide by ingestion of 500 ml of absolute methanol. Despite symptomatic and supportive intensive care, the woman died 23 h after hospital admission due to metabolic acidosis and multiple organ dysfunction syndrome. A complete medico-legal autopsy was performed. Grossly, there was complete detachment of the oesophagus mucosa and brownish discolouration of the gastric mucosa. Histological findings showed diffuse haemorrhagic necrosis of the stomach mucosa and intense acute inflammatory infiltration of the lamina propria. To our knowledge, this is the first autopsy report of such severe digestive injuries. A discussion and review of the recent literature on the subject are given.  相似文献

This article explores the reconfiguration of social citizenship, or 'market citizenship', underway in Chile, as one crucial dimension of the refashioning of state institutions along neo-liberal lines in Latin America. It focuses on the 'civilizing' dimension of social citizenship, as an instance of the state's involvement in the regulation of subordinate populations. Specifically, the article studies the case of new social policy aimed at poverty alleviation. Inspired by Michel Foucault's late work but moving beyond it, it examines institutional transformation as on-the-ground practices through which policies take effect and sees 'market citizenship' as emerging from the rearticulation of the efforts of myriad individuals located at different levels of government, 'civil society', and poor and working-class communities. In this process, state agents are translators on the one hand of official documents into instances of participatory learning and empowerment, and on the other of people's realities into instances of documentary categories of poverty. This cultural-political transformation of neo-liberal modernization in Chile and beyond is potentially radical, and we need to ask: to what extent will the new market terms of belonging in the national community, which increasingly permeate private and public actions and discourse, change the very material and cultural contexts in which people's lives and struggles are framed?  相似文献

Is the authoritarian potential of policy elites a mortal threat to the consolidation of democracy in Latin America? This article suggests that in the context of democratic transitions, significant variations may exist in the performance of technocratic roles. In most countries in the region, elected governments faced the crisis of the 1980s by retaining markedly technocratic and exclusionary styles of policy-making. In Chile, a highly technocratic form of authoritarianism was succeeded by a novel pattern of pragmatic cooperation between technical and political elites. Democratic institutions were reestablished while a strong economic team enforced coherence and continuity in economic policy. Historical and institutional factors are used to show that Chile may now be nearer the democratic pole than other “hybrid” democratic-authoritarian regimes in the region.  相似文献
