This article investigates the role of transgovernmental networks of national regulators in addressing collective action problems endemic to international cooperation. In contrast to recent work on transgovernmental actors, which emphasizes such networks as alternatives to more traditional international institutions, we examine the synergistic interaction between the two. Building on the broader premise that patterns of “dual delegation” above and below the nation‐state enhance the coordinating role of networks of national agencies in two‐level international governance, the article examines the formal incorporation of transgovernmental networks into European Union (EU) policymaking. The focus on authoritative rule‐making adds a crucial dimension to the landscape of EU governance innovations while connecting to the broader study of transgovernmental networks in international governance. The article develops an analytical framework that maps these incorporated networks across different sectors in terms of function, emergence, and effectiveness. Two case studies of data privacy and energy market regulation are presented to apply and illustrate the insights of this mapping.  相似文献

This article focuses on new patterns of territorial governance in the aftermath of the 1982 decentralization reforms in France. The traditional "cross regulation" model developed by the Crozier school is wrong to assume culturally grounded stalemate and to suggest that local political power is nothing more than the informal access of local elites to national policymaking. Analyzing the policy of technopoles or science park development, both nationally and by way of detailed local case studies of Montpellier and Rennes, we demonstrate that, on the contray, French local and regional authorities have risen progressively to independent loci of governmental power and policymaking. Local policy initiatives are, however, embedded in a multi-level institutional fabric ranging from the local to the European level. These developments in center-periphery relations need to be placed into the context of the general decline of the traditional French public policy model, which has been stiffly challenged by the norms of market, Europe and subsidiarity. In conclusion, a comparative and interorganizational perspective suggests that France is moving toward a territorial system increasingly characterized by the dynamics of intergovernmental conflict and cooperation and best described as "quasi-federalism in unitary disguise."  相似文献

In this conceptual article, we explore mechanisms of conflict management in European Union (EU) regulatory policy‐making. We build on J.G. March's distinction between aggregation and transformation as the two strategic options to deal with inconsistent preferences or identities that are at the source of social conflict. While this distinction is helpful in mapping conflict management mechanisms, the rigid association of these two options with the rival paradigms of rationalism and constructivism respectively has led political scientists to neglect conflict management strategies that work at the edges of aggregation and transformation. We show the potential of these latter strategies as intelligent ‘in‐action’ hybrids that emerge from ground‐level policy‐making praxis of actors navigating a complex institutional and policy environment. Specifically, we discuss five strategies: issue‐based aggregation; arena‐based aggregation (arena‐shifting and arena‐creation); socialization; re‐framing; and proceduralization, their underlying mechanisms and related scope conditions. The theoretical implications of this discussion lead us towards ‘strategic constructivism’. In the conflict management mechanisms that are of most interest, norms and ideational structures matter, but they are related to strategic actors who draw on and orchestrate ‘ideas’ in pursuit of political goals.  相似文献
