Reentry and Removal: Implications for Juvenile Confinement Facilities

An important national initiative in juvenile justice is Juvenile Offender Reentry (JOR). The renewed emphasis on offender reintegration has generated significant attention to juvenile justice practices, with the notable exception of juvenile confinement facilities. Juvenile detention and, to a lesser degree, juvenile corrections practitioners are involved but not invested in reentry, having made very few programmatic changes to accommodate JOR initiatives largely because these initiatives have been external to the institution and its staff. Yet, reentry is a powerful concept for juvenile facility practitioners, and the application of reentry principles could have a profound impact on daily operations. This article addresses a range of issues about investing juvenile institutions in reentry practices. Several reentry models are discussed along with their implications for daily operations and programs.     

GENE-BASED EVOLUTIONARY THEORIES IN CRIMINOLOGY *

In the past 20 years, several theories of criminal (and antisocial) behavior have been proposed from an evolutionary perspective, some of which specifically stipulate that people vary in their genetic dispositions toward criminality. It is these theories, herein called gene-based evolutionary theories, that are the focus of this article. Two categories of gene-based evolutionary theories are described. One category is crime specific, pertaining to the offenses of rape, spousal assault/murder, and child abuse neglect. The second category consists of two general theories of criminal and antisocial behavior: the cheater (or cad vs. dad) theory, and the r/K theory. In addition to assuming that genes contribute to variation in criminal (and antisocial) behavior, all five of these theories assume that natural selection has acted on human populations to open up reproductive niches for individuals and groups who victimize others. While the theories are still far too new to have been fully tested, we derive some of the most obvious hypotheses from each theory and explore the relevant empirical evidence. We show that while gene-based evolutionary theories open make predictions similar to strictly environmental theories, they also lead to unique hypotheses, several of which have at least some support.

CHANGE IN THE MANAGEMENT OF PUBLIC SERVICES

This article identifies the main themes in recent changes in public sector management and shows the extent of the challenge to past organizational assumptions. While recognizing the objectives of the changes could bring benefits if realized, it argues that there are a series of issues that are unresolved. The language of consumerism, the development of government by contracts, the form of performance management and the use of quasi-markets are seen as creating problems. These are seen as deriving from an attempt to apply approaches drawn from the private sector to the public domain. It is argued that they need to be balanced by approaches that recognize the values of the public sector.     

Faith‐Based Programs for Reentry Courts: A Summary of Issues and Recommendations

In 2002, the Bush Administration directed the Department of Justice to include faith‐based organizations in its distribution of funds earmarked for programs targeting the prevention and treatment of juvenile delinquency and substance abuse. Among the initiatives most likely to be affected by this new policy are reentry court programs that endeavor to reintegrate juvenile delinquents into their communities by placing them within local neighborhood‐based programs. However, reentry court personnel and leaders of faith‐based organizations are likely to encounter numerous challenges as they try to establish appropriate programming. In this article, we discuss the current understanding of First Amendment jurisprudence governing the federal funding of faith‐based organizations and summarize key issues identified by a National Council of Juvenile and Family Court Judges' workgroup on faith‐based programming that are necessary for including faith‐based organizations within a reentry court's continuum of care. We also discuss several concerns that reentry court personnel and faith‐based organizations should consider as they seek to maximize the impact of their programs.     

THE ENABLING STATE: THE ROLE OF MARKETS AND CONTRACTS

Contracts have been a key element in the recent reform of British public services. Their introduction has formed part of a broader process of change in which the market structures and values have featured prominently. In practice, contracts have both brought benefits and presented problems. More particularly, greater organizational formality has raised some important issues – the role of trust and the form and practice of accountability prominent among them. Evidence from a recent esrc -supported study shows that some services (the simpler ones) have generally gained from the reforms; but the evidence for more complex ones is equivocal at best.
