Planung und Gebietsschutz in der Ausschließlichen Wirtschaftszone

Mit § 38 Bundesnaturschutzgesetz (BNatSchG) wurde durch das BNatSchG-NeuRG vom 25. 3. 2002 die Rechtsgrundlage für die Einrichtung geschützter Meeresflächen in der Ausschließlichen Wirtschaftszone (AWZ) geschaffen ¹ . Im Mai 2004 hat der Bundesumweltminister der Europäischen Kommission zehn marine Schutzgebiete zur Aufnahme in das europäische Netz „Natura 2000“ gemeldet, die einen Flächenanteil von 31% der deutschen AWZ umfassen ² . Der im Zusammenhang mit der Novellierung des BNatSchG in die Seeanlagenverordnung neu eingefügte § 3a See- AnlV ermöglicht die Festlegung besonderer Eignungsgebiete für Windkraftanlagen. Sie wird zur Zeit vom Bundesamt für Seeschifffahrt und Hydrographie vorbereitet ³ . Im Rahmen der jüngsten Novellierung des Raumordnungsgesetzes (ROG) durch das Europarechtsanpassungsgesetz Bau (EAG-Bau) ist die Entwicklung einer Raumordnung für die AWZ nunmehr zur Aufgabe des Bundes erklärt worden ⁴ . Die Entwicklung gebietsbezogener Ordnungsvorstellungen für die AWZ scheint sich in den Prozess der „Terraneisierung“ ⁵ der Meere einzuordnen, der mit dem Seevölkerrecht zu synchronisieren ist (I.). Ansätze zur räumliche Ordnung der AWZ durch den Bund stellen sich im Weiteren vor dem Hindergrund der bundesstaatlichen Kompetenzordnung als verfassungsrechtliches Problem dar (II). Schließlich wird man auch die Übertragung terrestrischer Leitbilder und Instrumente auf marine Bedingungs- und Wirkungszusammenhänge mit der gebotenen Vorsicht angehen müssen (III.). 1) BGBl. Thyreoglobulin and violent asphyxia

The concentration of thyreoglobulin (tg) was determined for death caused by hanging, strangulation by ligature, and throttling. Cases of sudden death (traumatic aortic rupture, penetrating wounds of the heart) were used for comparison. The mean values in cases of hanging (149.9±202.3 ng/ml), strangulation by ligature (193.1±173.3), manual strangulation (561.6±173.9) are distinguishable from violent acute deaths (23.3±27.6) and living healthy individuals (17.3±16.1). By means of statistical comparisons, significant differences were found between throttling and strangulation by ligature and between throttling and hanging (adjusted P<0.001). In connection with examination of the bodies high tg values can be regarded as a vital reaction in obstructive asphyxia.     

The state action doctrine and the Local Government Antitrust Act: the restructured public hospital model

This Article analyzes the development and complexities of the antitrust state action doctrine and the Local Government Antitrust Act as these doctrines apply to both "municipalities" and private entities. The restructuring of a public hospital is used as a model to facilitate the antitrust analysis. The restructuring model, which typically involves the leasing of a hospital facility by a public entity to a private nonprofit corporation, offers the unique opportunity to compare the different standards employed under the state action doctrine and the Local Government Antitrust Act. As a practical matter, the Article provides a framework for a public hospital to evaluate the impact of corporate restructuring on its antitrust liability exposure and to develop strategies to minimize antitrust risks.     

The Effects of Local Government Consolidation on Turnout: Evidence from a Quasi‐Experiment in Switzerland

In the last decades, municipal mergers have been one major element of local government reforms in Switzerland and beyond. In this article, we describe and analyze the political effects of this development. We use a quasi‐experimental setting to test the impact of municipal mergers on electoral participation. We find that in merged municipalities, the decrease in turnout is significantly stronger than in non‐merged municipalities. Further, the effect is more pronounced in relatively small localities. There is a temporal dimension to this effect—that is, turnout drops mainly in the first election after the first merger, but not so much after the second or third merger. Hence, the study provides a skeptical yet differentiated perspective on the democratic consequences of municipal mergers and points to further research avenues to develop a more comprehensive understanding of local government consolidation.
