Cross-national case studies have indicated that compared to other economically advanced democracies, American methods of policy implementation and dispute resolution are more adversarial and legalistic, shaped by costly court action or the prospect of it. To what extent are lawyers responsible for creating American-style adversarial legalism? This article argues that while adversarial legalism stems primarily from enduring features of American political culture and governmental structure, the legal profession plays a significant independent role in promoting and perpetuating this mode of governance. 相似文献

Workers Compensation claims are not interpersonal disputes. Almost always they are disputes between individuals and corporations. Compensation insurers are "repeat players" in the system. Workers are often "one–shotters" who have little or infrequent contact with the system. Power inequality between the worker, employer, insurer, and those who are required to facilitate negotiations and resolve and settle disputes under compensation legislation are matters of considerable importance. This paper examines the effects of the implementation, in 1993, of informal dispute resolution processes in the Western Australian workers compensation system under the Workers Compensation and Rehabilitation Act 1981(WA), which excluded lawyers from the process. It argues that preexisting power imbalances have been aggravated by these procedural changes, and in particular, by the exclusion of legal practitioners from the dispute resolution process. Government policy‐making affecting Indigenous communities in Canada has often been met with stiff resistance from Indigenous leadership. We examine multilevel governance as an alternate model for Aboriginal policy‐making by examining a particular case study: the process leading up to the 2005 Kelowna Accord. We find that although multilevel governance may have the potential to produce highly desirable outcomes, its emergence seems to depend heavily on political agency. Meaningful and enduring change to Aboriginal policy‐making will therefore likely require significant institutional adjustments to the Canadian federation. 相似文献

Transition teams are often used to help Prime Ministers and Premiers move into their new roles. At the municipal level, the use of transition teams is relatively new. As such, we know little about what these groups do in comparison to federal and provincial transition teams. In this article, we examine mayoral transition teams and find that the increased use of these groups is a reflection of the enhanced organizational complexity of Canadian local government. Additionally, local conditions and candidate experience often dictate the shape and function of transition teams.
