Transcarceration: Notes on a psychoanalytically-informed theory of social practice in the criminal justice and mental health systems

The application of Lacanian psychoanalytic semiotics to the intersecting categories of criminal justice and mental health is relatively novel. In this paper the phenomenon of transcarceration or the repeated channeling of disordered defendants (subjects) through institutional regimes of discipline and coercion is outlined. Attention is directed at the intra-psychic and intersubjective mechanisms responsible for the structuring of discourse. Lacan's schematization on the constitution of master narratives through the Discourse of the Master is also delineated. The author concludes by demonstrating how transcarceration is fundamentally about language and privileged speech patterns which agents of both systems as well as subjects themselves perpetuate. Der Begriff der „Landeskultur“ im deutschen Recht

Der Begriff der Landeskultur umfasst alle Maßnahmen zur Verbesserung der land- und forstwirtschaftlichen Nutzung des Bodens einschließlich der Erhaltung der Kulturlandschaft. Landeskultur ist somit alles Planen und Handeln mit dem Ziel, die Umwelt als gegebenes Naturraumpotential, insbesondere Wasser, Boden, Luft und die dazugehörigen Natur-, Kultur- und Sachgüter optimal zu erhalten, gestalten und rationell zu nutzen sowie dieses Potential mit bestmöglicher Qualität als natürliche und kulturelle Lebensgrundlage für die Allgemeinheit nachhaltig zu sichern. Landeskultur dient somit auch der Belebung und Werterhöhung der gebauten und gepflanzten Umwelt. Dies schließt auch und gerade die kulturelle Seite einschließlich Kulturlandschaften mit ein. Dabei ist es bis zur Überprüfung durch das BVerfG noch hinnehmbar, dass der Begriff „Landeskultur“ in Art. 89 Abs. 3 GG wegen der Mischkompetenz von Bund und Land vom BVerwG enger ausgelegt wird als in anderen Rechtsvorschriften.     

Analysis of Δ-tetrahydrocannabinol in oral fluid samples using solid-phase extraction and high-performance liquid chromatography–electrospray ionization mass spectrometry

An analytical method using solid-phase extraction (SPE) and high-performance liquid chromatography–mass spectrometry (LC–MS) has been developed and validated for the confirmation of Δ⁹-tetrahydrocannabinol (THC) in oral fluid samples. Oral fluid was extracted using Bond Elut LRC-Certify solid-phase extraction columns (10 cm³, 300 mg) and elution performed with n-hexane/ethyl acetate. Quantitation made use of the selected ion-recording mode (SIR) using the most abundant characteristic ion [THC + H⁺], m/z 315.31 and the fragment ion, m/z 193.13 for confirmation, and m/z 318.00 for the protonated internal standard, [d₃-THC + H⁺]. The method proved to be precise for THC, in terms of both intra-day and inter-day analyses, with coefficients of variation less than 10%, and the calculated extraction efficiencies for THC ranged from 76 to 83%. Calibration standards spiked with THC between 2 and 100 ng/mL showed a linear relationship (r² = 0.999). The method presented was applied to the oral fluid samples taken from the volunteers during the largest music event in Portugal, named Rock in Rio-Lisboa. Oral fluid was collected from 40 persons by expectoration and with Salivette^®. In 55% of the samples obtained by expectorating, THC was detected with concentration ranges from 1033 to 6552 ng/mL and in 45% of cases THC was detected at concentrations between 51 and 937 ng/mL. However, using Salivette^® collection, 26 of the 40 cases had an undetectable THC.

Contribution à une analyse narrative de la théorie institutionnelle

Conclusion Que faut-il penser de la co-existence de trois modèles différents pour interpréter l'élément central de la théorie institutionnelle de MacCormick? Cette pluralité de modèles n'est source de perturbations que pour ceux qui tiennent à défendre l'idée selon laquelle il n'y a qu'une seule forme possible de discours juridique. Dès qu'il est accepté — comme hypothèse de base — que les formes d'organisation de ce type de discours peuvent être multiples, la perspective est inversée.C'est le schéma explicatif — dit schéma narratif — qui est alors unique. Quant aux différentes variantes de la formule de MacCormick, elles représentent les altérations de cette définition en fonction de paramètres identifiables — et identifiés — comme le statut des différents actants et acteurs, la définition de l'objet de valeur final dont ils cherchent à s'emparer et les objets de valeur d'usage dont ils se servent.L'éclatement de la formule de Maccormick ne correspond alors plus à un rejet mais bien à une mise en question. Cette remise en question débouchant sur la reconnaissance de plusieurs schémas narratifs, nous devons nous demander dans quelle mesure notre perception de la phasep correspond à l'idée que s'en fait MacCormick. S'agit-il seulement de la procédure au sens juridique du mot ou de tout un ensemble d'actes permettant de persuader un destinateur comme un juge ou une administration de la coïncidence entre un parcours narratif effectif et le type idéal de parcours narratif qu'ils tirent de la lecture des normes juridiques?S'il s'agit bien de la procédure au sens juridique de ce mot, il faut alors préciser au terme de cette analyse sémio-narrative que l'ensemble des phénomènes pragmatiques — comme les interactions dans le cas d'une procédure orale — ne sont pris en compte ni par la formule de MacCormick, ni par la présente discussion mais qu'ils relèvent d'une recherche particulière sur cette dimension supplémentaire, certes compatible avec la théorie sémiotique mais pas avec la théorie institutionnelle de MacCormick. Pour conclure, nous dirons donc qu'il est possible d'intégrer certains éléments de cette dernière théorie dans un cadre plus général mais qu'elle sera vite transformée à la fois de l'intérieur par la reconnaissance d'une pluralité des formes du discours et de l'extérieur par son intégration partielle dans un schéma plus large qui vise à décrire un phénomène dans son intégralité.     

Looking for Locals: Voter Information Demands and Personal Vote-Earning Attributes of Legislators under Proportional Representation

Proportional representation systems affect the extent to which elected legislators exhibit various attributes that allow them to earn a personal vote. The sources of variation in personal vote-earning attributes (PVEA) lie in informational shortcuts voters use under different electoral rules. List type (closed or open) and district magnitude (the number of legislators elected from a district) affect the types of shortcuts voters employ. When lists are closed, legislators' PVEA are of decreasing usefulness to voters as magnitude (and hence the number of candidates on a list) increases. When lists are open, legislators' PVEA are increasingly useful to voters as magnitude increases, because the number of candidates from which voters must choose whom to give a preference vote increases. As predicted by the theory, the probability that a legislator will exhibit PVEA—operationalized as local birthplace or lower-level electoral experience—declines with magnitude when lists are closed, but rises with magnitude when lists are open .

The article argues that the prohibition of abortion in Chile, other than when the mother's life is in danger, is a form of human rights violation targeting women specifically. The Pro-Birth Policy was established in Pinochet's Chile as a response to the previous government's attempts, under Allende, to encourage family planning and to educate and inform women about their choices. This had been done to put an end to the increase in back-street abortions with the inevitable toll on women's lives. Pinochet's regime reversed these women-oriented family planning policies, and criminalized abortion, on the basis of costs to the state and, more importantly, the need to increase the birth rate for reasons of national security. Women's bodies were used by the Pinochet regime, both by sexual violence and torture, and by the denial of women's reproductive and sexual rights, as a means to impose discipline and order on society. The fact that this is still not acknowledged in the construction of a collective memory indicates that the issue has not yet been resolved in democratic Chile.
