Semaan et al. (J Forensic Res, 2020, 11, 453) discuss a mock case “where eight different individuals [P1 through P8] could not be excluded in a mixed DNA analysis. Even though … expert DNA mixture analysis software was used.” Two of these are the true donors. The LRs reported are incorrect due to the incorrect entry of propositions into LRmix Studio. This forced the software to account for most of the alleles as drop-in, resulting in LRs 60–70 orders of magnitude larger than expected. P1, P2, P4, P5, and P8 can be manually excluded using peak heights. This has relevance when using LRmix which does not use peak heights. We extend the work using the same two reference genotypes who were the true contributors as Semaan et al. (J Forensic Res, 2020, 11, 453). We simulate three two-donor mixtures with peak heights using these two genotypes and analyze using STRmix?. For the simulated 1:1 mixture, one of the non-donors’ LRs supported him being a contributor when no conditioning was used. When considered in combination with any other potential donors (i.e., with conditioning), this non-donor was correctly eliminated. For the 3:1 mixture, all results correctly supported that the non-donors were not contributors. The low-template 4:1 mixture LRs with no conditioning showed support for all eight profiles as donors. However, the results from pair-wise conditioning showed that only the two ground truth donors had LRs supporting that they were contributors to the mixture. We recommend the use of peak heights and conditioning profiles, as this allows better sensitivity and specificity even when the persons share many alleles.  相似文献

This article investigates political opportunities and constraints associated with incorporating the concept of universal citizenship into migration debates. Analyzing the speeches of Ecuador's president Rafael Correa over eight years, the article argues that Correa strategically crafted a narrative of universal citizenship to undergird politically beneficial policies. Political constraints from constituents and rivals, and the populist nature of his governing style, hollowed out progressive migration policy innovations to the point that universal citizenship became a rhetorical device more than a substantive policy agenda. Through this empirical case, the article develops a more nuanced critical understanding of universal citizenship discourses as sites for negotiating the relationship between states and migrants.  相似文献

This article considers Sections 29–40 of the Employment Act 2002 in the context of post-War developments in labour relations culminating in the National Industrial Relations Court. It considers the development of Employment Tribunal which rather than being the last resort intended by the legislators, has become the first resort of complainants, often for trivial matters by employees; or by employers taking an extremely broad view of Gross Misconduct by employees. Due to the volume of cases and the shortage of Chairs, cases are constantly delayed and postponed. The article posits that these are the principle reason behind the framing of Sections 29–40 of the Employment Act 2002 which introduced a new Section 9(1)(a) into the Employment Tribunals Act 1995. This has given the Chair of an Employment Tribunal the authority to strike out a weak case at a Pre-Hearing Review that will strike the case out once and for all at this juncture. The aim is to encourage employers to have proper procedures and for employees to follow them. This article suggests that in fact the reforms will have the opposite effect; that they have introduced another layer of legal complexity which will further increase the number of cases brought before the Employment Tribunal.  相似文献

A central tenet of medical ethics holds that it is permissible to perform a medical intervention on a competent individual only if that individual has given informed consent to the intervention. Yet it occasionally seems morally permissible to carry out non-consensual medical interventions on competent individuals for the purpose of infectious disease control (IDC). We describe two different moral frameworks that have been invoked in support of non-consensual IDC interventions and identify five desiderata that might be used to guide assessments of the moral permissibility of such interventions on either kind of fundamental justification. We then consider what these desiderata imply for the justifiability of carrying out non-consensual medical interventions that are designed to facilitate rehabilitation amongst serious criminal offenders. We argue that these desiderata suggest that a plausible case can be made in favor of such interventions.  相似文献

This article examines the advancements, barriers, and prospects of the field of public administration as it seeks professionalism through professionalization. Overall, this essay delves into six broad areas of advancement and an equal number of obstacles. The milestones focus on the criteria of a profession and public administration's fulfillment of those standards, far-reaching credentialization, the expanding entry of women and minorities, the development of performance criteria, intergovernmental networking, and an expansion of associations. The impediments to the further evolution of the field toward professional development include the continuing value conflicts over the ultimate purposes of the field; the persistent politicization of the federal workforce; the inability of public servants to affect the uses of privatization; the erosion of national, state, and local governmental human-resource capacity; the confusion over the teaching of ethics and the promulgation of operational codes; and the prevalence of authoritarian administration without significant democratic inroads. The respective enumerations were not intended to suggest an exact symmetry between accomplishments and obstacles in the field--only that progress and deficiencies are prominent and substantial. Nor were these considered lists intended as exhaustive.

The central theme of this article is that, paradoxically, the prospects of this profession are encouraging because of the growing public need for its services despite persistent, widespread unpopularity. This research concludes that public administrators face an ambivalent future in which their emerging profession continues to prosper and expand amidst increasing alienation and frustration from the public whom they serve. This irony may not be alleviated until there is a socially and politically agreed-upon agenda for public servants to execute. If such a consensus is ever forged, then public administrators may become popular as well as professionally effective.  相似文献

The central theme of this article is that the critical stage in the development of the field of public administration—the most concentrated burst—covered the period between 1937-1940. Although this occupation experienced times of diffuse but substantial activity around World War 1 and during the 1960s and 1970s, the most profound changes took place shortly before the second world war. What chiefly sets this period apart from earlier and later periods of fermentation centers not so much on the quantity of innovations but, rather, on their nature (that is, their structural genre) and on their breath (their institutional reach).

This article starts with a perspective so that it may be better understood why this particular time span was instrumental to the growth of public administration. It reviews the contributions of preceding and subsequent eras in the evolution of the field, the article presents a structural synthesis by examining organizational innovations in four areas at the national level: (1) the executive branch, (2) the judiciary, (3) Congress, and (4) the profession of public administration. The paper concludes by exploring the forces that, in our view, made this period the most productive one in this history of the occupation. Finally, the research for this article rests on a reservoir of publicly available primary and secondary materials relevant to this period.  相似文献
