This synoptic article focuses on the origin and functioning of the Office of the Family Advocate as the protector of the interests of minor children in divorce cases. Attention is paid to the general contemporary trend to specialise in judicial decision-making that developed out of an increasing need for expertise in the administration of justice. A number of arguments for and against judicial specialisation are addressed. The origin of the Office of the Family Advocate within the South African judicial system is discussed and a brief exposition of the history of divorce legislation in South Africa is given. This is followed by attention to the functioning of the Office of the Family Advocate with reference to the process followed in investigations of this office and points of criticism against the system are highlighted. The article closes with an indication of the need for research in this regard and possible focus points for future research are identified.  相似文献

This article considers the Bolsheviks’ proposals to militarize labour. While concerned ostensibly to secure a steady supply of disciplined labour during the civil war, this was clearly seen as a means to effect a transition to communism. Labour militarization was understood as an instrument to suppress commodity production, which would help usher in a new form of socialized labour. The theoretical roots of this policy can be found in Marx's writings on commodity production and ideology. Although Marx believed that the commodity form would be overcome through endogenous structural developments, there is no reason to suppose the forceful suppression of commodity production cannot produce the same outcome.  相似文献

Abstract

The global South, as the collective for the peripheries of mainstream development is known, is often regarded as merely a beneficiary of Northern-borne notions in the field of organisational communication. The problem is that the Southern context and circumstance do not always mirror those of the North, meaning that these dominant, revered theories are not necessarily applicable. One Southern context is that of the South African mining and construction industries, which is seen as notoriously dangerous, plagued by various obstacles to internal organisational communication (such as illiteracy and diversity), and what Le Roux and Naudé (2009, 29) refer to as ‘historical baggage’. The research question of this article is whether congenital Northern communication theories can be adequately incorporated into the unique global South, in order to fulfil the important task of communicating safety information to employees. The article explores the appropriate implementation of the principles of the excellence theory, the stakeholder theory as well as the relationship management theory, and the research methodology includes interviews, focus groups and quantitative questionnaires at two organisations. The result of the empirical research is the amalgamation and reworking of these theories’ principles into a model for internal safety communication applicable to the South.  相似文献

This article explores the largely hereunto-ignored perceptions of the offenders within the specialist sex-courts in Bloemfontein, Free State, South Africa. Various factors potentially affecting such perceptions within this group of individuals are identified by way of theoretical orientation. Respondents were inclined to view the Court for Sexual Offences as biased in process and excessively punitive with regard to sentencing. The specialist sex-court was also perceived to be inefficient and slow. Female prosecutors were judged to be overly involved in cases to the extent that their objectivity was impaired. The need for additional research in various related areas is also explored.  相似文献

This article evaluates the functioning of the Court for Sexual Offences in Bloemfontein, Free State, South Africa at the hand of the perceptions of those professionals most frequently involved with the Court. The findings suggest that professionals involved with this court tend to be positive in their appraisals of the sex-court system. However, the ability of the sex-court to remain objective and to reduce secondary victimization is called into question. Misconceptions with regard to the Court's current ability to contribute to the rehabilitation of offenders and the emotional recovery of the victims were exposed. The operational difficulties facing sex-court personnel are discussed and directions for future research are identified.  相似文献

Africanization is generally seen as a renewed focus on Africa-reclaiming what has been taken from Africa--and the emergence of a new sense of pride. With regard to the local curriculum, there is a renewed focus on indigenous knowledge and an African community competing in a global society. In this article the author will reflect on a literature search on Africanization by firstly attempting to create an awareness of the topic by local problems, for example an Africanized curriculum and study material specifically designed for the higher education student in South Africa (who might be in rural or urban) or in the rest of Africa, or even a local student who has migrated to another part of the globe; secondly, looking at relevancy problems that arise when designing local study material on a global platform; thirdly, suggesting ways to design an Africanized environment that not only reflects the underpinning of an African philosophy, but also takes cognizance of the global curriculum. Therefore, an attempt to create an awareness in all communities worldwide of the need is involved in their own curricula by not only looking at problems such as language, culture and values, but also starting at the very beginning, namely with the philosophy behind the design of such a curriculum.  相似文献

This article discusses the endemic nature of violence in South Africa. The authors hypothesize that the culture in South Africa is autocratic in nature. They compare the socialization that occurs between democratic and autocratic families and the relationship this has to later problem-solving and conflict resolution behavior. People raised in an authoritarian culture need to develop skills that will enable them to learn an alternative to violence in conflict and problem-solving situations. The authors describe two educational interventions that followed this model. Available results are presented.

Both historically and today, violence in South Africa is endemic. Examples of South Africans committing violent acts because they feel justified fill today's media. Despite hopes and visions for a new South Africa and examples of goodwill and peaceful common ground between the different political positions, these violent acts emanate from all points of the political compass. Historically, we find examples such as the black tribal wars -- the African/Zulu wars, the Zulu/British wars, and the Anglo/Boer Wars.(1),(2)

Although some positive processes of change occur in the country, a violent approach to problem-solving still remains. It is evident, both through research and perception, that all major population clusters (including whites, Africans, and other populations in South Africa) are predominantly authoritarian by virtue of their origin, their education, and their creed. This authoritarian culture may contribute toward the resistance against democratic processes and possibly heighten the opportunity for violence. The birth of liberation amplifies this dynamic situation. For all parties involved, liberation heightens the “fear for loss”(3) and creates a non-productive power struggle. In this paper, we first explore why we believe that violence is endemic in this country, showing how an authoritarian culture may contribute to this problem. Second, we will describe two OD interventions presented in separate educational settings that were designed to reduce violence.  相似文献

In Kyrgyzstan, as in the rest of Central Asia, recent decades have witnessed a proliferation of distinctions between ‘good’ and ‘bad’ Islam. What is perceived as a growing ‘religiosity’ is often seen as a symptom of post-Soviet chaos and excess, but people equally tend to see Islam as an important source of well-being, for themselves and for society as such. It is argued that a general feature of the Islam many Muslims strive for – and occasionally experience glimpses of – is one that expresses, embodies and enables a balanced existence: a balance between well-being in this world and in the afterlife; a balance between the acceptance of one's fate and the attempt to improve one's situation; or a balance between adherence to abstract dogmas and respect for local moralities.  相似文献
