2013年10月21日至25日,第十轮中美投资协定谈判在美国华盛顿举行,这是中美双方自今年7月第五轮中美战略与经济对话期间商定进入实质性谈判后举行的首轮谈判。从2008年开始,中美之间已启动双边投资协定谈判。此前的九轮谈判中,中美双方已完成了核心议题,并就双方各自关注的问题进行了初步讨论和技术性磋商。双边谈判为两国提供了良好的机遇,对推动两国外商投资、开放市场、增强对两国投资者的保护有很大的积极作用。尤其对2012年已成为全球第三大对外直接投资经济体的中国而言,同与美国在内的其他经济体缔结投资协定,确立更高层级的法律框架,从而切实提升中国投资者权益保障水平,促进对外投资,意义极为重大。今年11月,中欧投资协定谈判正式开启,鉴于此前入世时的谈判经验,中美谈判进展对中欧投资协定亦有相当的参照性。本期特选取中远香港集团张力行、黎军的稿件,分析国际投资法律框架和美国投资保护协定计划,解读中美双边投资保护协定实质性谈判的焦点。
