In this study we examine responses to the recent expansion of information technology in two rural Minnesota towns. One of these towns took a cooperative approach to technology access, developing a community electronic network, while the other town relied on a more individualistic, entrepreneurial model. The present study examines citizens' attitudes concerning social, political, and technological issues in these two communities, with the goal of uncovering what kinds of attitudes and resources citizens need to have in order to help support and sustain a community electronic network. Structural equation modeling is used to specify the relationships among individuals' economic, political, and social resources, technology ownership and use, and awareness of and support for the community network. Drawing on a theory of social capital, we consider the relative importance of privately- oriented social engagement versus publicly- oriented political engagement in relation to collective outcomes. Our analysis shows that in the town with the broadly- based community electronic network, individuals' political as well as economic resources are linked to knowledge and use of computer resources, whereas in the comparison community, economic stratification alone drives computer access. The implications of these findings for issues of equity, access to technology, and the development of strong community ties are discussed.  相似文献

Most American jurisdictions follow either asubjective or anobjective approach to the entrapment defense. In order to test some of the differences between the two approaches, student jurors viewed a videotaped cocaine trial and were presented with either subjective test or objective test instructions. The admission of prior conviction evidence was also varied. The jurors deliberated, returned a verdict, and then completed a questionnaire that measured their understanding of the instructions and trial facts. Results show that, first, juror comprehension of the principal features of the objective test is very poor. It is suggested that an effort be made to simplify instructions describing the objective test. Should simplification not improve comprehension, it is argued that the judge, not the jury, should decide the entrapment defense when the objective test is used. Second, admission of a prior conviction has a significant impact on verdicts in the subjective test condition, but not in the objective test condition. This finding suggests that the subjective test instructions are effective in encouraging jurors to use prior convictions as evidence of guilt. The content of the objective test instruction may also account for part of the difference in impact. Jurors in the objective test condition were instructed not to take the defendant's predisposition into account, and a substantial minority of the jurors under-stood this aspect of the instruction.  相似文献

Expert testimony on rape trauma syndrome has been used in sexual assault cases to corroborate the victim's complaint and to educate the jury. One of the primary arguments against the admissibility of this testimony is that it is not helpful because most jurors are adequately informed about rape and rape victim behavior. To test this assumption, a Sexual Assault Questionnaire (SAQ) was administered to experts on rape and post-traumatic stress disorder (PTSD) and two nonexpert comparison groups. Results indicated that the nonexperts were not well informed on many rape-related issues and were significantly less knowledgeable than the expert groups. The data also showed considerable consensus among the experts about the current scientific database on rape trauma. The implications of these results for the use of expert psychological testimony on rape trauma syndrome in court are discussed.  相似文献

We contend that political context is important to consider when analyzing social capital and that context has an important but neglected impact on understanding the consequences of civic activity. Our focus is on the influence of rural, local leadership in two Minnesota communities and policies that these elites have developed to bring Internet connectivity to their citizens. One city developed a community electronic network and the other opted for an individualistic, entrepreneurial approach to information technology. Using a quasi-experimental research design and four-wave panel data, we find that elite policy approaches interact with civic activity to predict technology use among citizens, even long after the policies’ initial implementation. In the city with a community network, residents who are integrated into civic life are able to harness these political resources to become more technologically sophisticated.

Modifications occur when interviewers contradict statements made by witnesses or imply that witnesses provided information that they (interviewers) did not provide. Because of their suggestive nature, modifications threaten the reliability of investigative interviews. This study investigated developmental differences in witnesses' responses to modifications during interviews as well as in inclusion of modified misinformation in subsequent answers. Preschool, elementary school, and college students were interviewed about a video presentation. In the experimental conditions, the interviewer contradicted information about the video provided by the participants. Participants then answered two sets of follow-up questions: one immediately following the interview and another 6–8 days later. Results indicated that participants were more likely to ignore modifications than to correct or agree with them. Adult participants were most likely to disagree with modifications. Preschoolers were most likely to incorporate modified misinformation into subsequent answers. Implications of these findings for investigative interviews are discussed.  相似文献

Since 1975, 40 states have enacted “rape shield” statustes which limit the admissibility of a rape victim's prior sexual history in court. These reforms have assumed that jurors regard prior sexual history evidence as much too probative of a victim's credibility and moral character, and that such perceptions have a prejudicial impact on the outcome of the jury decision process. The present research adopted an attributional analysis in order to examine the extent to which the types of legal reform affect social perception of the victim as well as the conviction rate in a videotaped consent defense rape trial. A large-scale jury simulation experiment was conducted with qualified jurors from the Minneapolis-St. Paul metropolitan area. Jurors either viewed an Improbable or Probable Likelihood of (victim) Consent version of the trial, with admission of prior sexual history evidence governed by one of three types of exclusionary rules. The results lend credence to the reformist contention that a rape victim is “on trial” along with the accused. Jurors were reluctant to convict when any testimony about prior sexual history was introduced. Moreover, jurors' close scrutiny of the victim's credibility and moral character was directly related to the conviction rate. Only the most restrictive evidentiary rule, when applied to an Improbable Consent case, curtailed the inference of victim consent, enhanced victim credibility, and increased the likelihood of conviction. Some of the legal and attributional implications of these findings were discussed.  相似文献

The present research examined psycholegal assumptions about specific acts evidence as a method of character proof. On the basis of “fireside induction” (Meehl, 1971) and social psychological research on inferential processes, it was expected that the logic behind the presumption against specific acts testimony would receive empirical support. In the context of a videotaped automobile negligence trial, nondeliberating experimental jurors were presented with character evidence expressed either in terms of specific acts or in terms of general reputation. Mode of presentation and the amount of testimony also were varied. Only post hoc support for the logic behind the presumption against specific acts testimony was obtained, and several factors that may have constrained its impact were considered.  相似文献

We presented participants with syndromal, witness credibility, or anatomically detailed doll evidence to determine (a) whether these different types of expert evidence exert differential influence on participants' judgments and (b) whether the influence of this evidence could be better explained by the relative scientific status or the probabilistic qualities of the research presented. Additionally, we investigated whether a strong or weak cross-examination of the expert would be more successful in discrediting the information provided in the expert's testimony. Findings suggest that participants are less influenced by expert testimony based on probability data (i.e., syndromal evidence) than by expert testimony based on case history data (i.e., credibility of anatomically detailed doll evidence). Participant responses did not differ as a function of the strength of the cross-examination of the expert. As expected, women were more likely to respond in a pro-prosecution direction than were men. Implications for the use of expert evidence in child sexual abuse cases are discussed.  相似文献

The present experiment examined some of the key psychological issues associated with electronic media coverage (EMC) of courtroom trials. Undergraduate student subjects served as eitherwitnesses orjurors in one of three types of trials:EMC, in which a video camera was present; conventional media coverage (CMC), in which a journalist was present; or, ano-media control, in which no media representative or equipment was present. Students who served as witnesses first viewed a 5-min videotape of a reenacted armed robbery. Days later, these students testified as witnesses to the crime in front of a jury of peers. Measures assessed the following: witness and juror attitudes toward EMC, witness report and juror perceptions of nervousness and media distraction, juror perceptions of witness testimony, and witnesses' ability to accurately recall aspects of the crime event. Results showed that EMC witnesses and jurors had significantly more favorable attitudes toward EMC than participants in the other two conditions. And, although EMC witnesses and jurors both reported greater witness nervousness, distraction, and awareness than those in the CMC condition, the EMC experience did not impair witnesses' ability to accurately recall the details of the crime or witnesses' ability to communicate effectively. The psychological and legal policy implications of these findings are discussed.  相似文献
