The rising number of referendums on EU matters, such as the Brexit and the Catalonian independence votes, highlight the increasing importance of referendums as a problem‐solving mechanism in the EU. We argue that the Swiss case provides essential insights into understanding the dynamics behind referendums, which are often lacking when referendums are called for in the EU. Referendums in EU member states on EU matters differ substantially from those in the Swiss context. Nevertheless, proponents of more direct democratic decision‐making regularly cite the Swiss example. Our systematic analysis of why referendums are called, how they unfold and their effects in the EU and Switzerland reveals that the EU polity lacks the crucial conditions that embed direct democracy within the wider political and institutional system. The comparative perspective offers fundamental insights into the preconditions required for direct democracy to function and its limitations in the EU.  相似文献

This study explored the effects of judges' personal characteristics (gender, race, age, and political affiliation) and case characteristics on the outcomes of federal cases of hostile environment sexual harassment. Results revealed that even after controlling for the effects of relevant case characteristics (e.g., severity of the harassment), judges' personal characteristics influenced case outcomes. Specifically, younger judges and Democrat judges were more likely to find for the plaintiff (the alleged victim of harassment). The probability that the decision would favor the plaintiff was only 16% when the case was heard by an older judge but 45% when heard by a younger judge. The probability that the decision would favor the plaintiff was only 18% when the case was heard by a judge who had been appointed by a Republican president but 46% when the judge had been appointed by a Democrat president.  相似文献

The regulation of intellectual property rights takes place in a range of international venues. This proliferation of international venues greatly enhances the potential for venue shopping. We argue that different levels of domestic regulation and differing degrees of judicialization account for actors' preferences over institutional venues. We take into consideration two scenarios. Conceiving of judicialization as the delegation of adjudication to an independent third party and the enforcement through multilaterally authorized sanctions, we show that: (i) upward regulatory harmonization leads actors preferring weak regulatory intellectual property rights standards to strive for venues with low degrees of judicialization, whereas those favoring stringent intellectual property rights protection prefer highly judicialized venues; and (ii) downward harmonization leads to the opposite constellation of institutional preferences. We show how these expectations hold by way of in‐depth case studies of two instances of global intellectual property rights regulation: the regulation of plant genetic resources and intellectual property rights for medicines.  相似文献

Divorce education programs first surfaced over four decades ago. Today, many states mandate parents to participate in a divorce education program before their dissolution can be finalized. Changes in the technological landscape have allowed innovative practitioners to create online divorce education programs, yet these programs have not been formally evaluated for quality. Adapting a research design for evaluating face‐to‐face programs, we created an online divorce education review form and reviewed online divorce education programs that parents use to meet court‐mandated requirements. Results reveal that online programs have significant potential to help divorcing parents, yet there are areas of online program content and instructional strategies that can be improved. Program content that includes legal and court focused topics or modules, or that offer advice for families facing special circumstances such as domestic violence, could be enhanced. Additionally, most of the instructional strategies were passive. With this research, recommendations were made for improving program content and instructional strategies for online divorce education programs.  相似文献

The relationships between age at menarche, preparation for menarche, and initial experience of menarche, were assessed in a retrospective questionnaire administered to 97 college-aged women. The more knowledgeable a girl was prior to menarche, the more adequate she perceived her preparation for menarche to have been; and the older she was at the time of menarche, the more likely she was to report a positive initial experience. These data support clinical anecdotes describing initial responses to menarche, and provide information about the factors which can moderate the extent to which menarche is experienced as a traumatic and disruptive event.Portions of this research were presented at the annual meeting of the Eastern Psychological Association, Hartford, Conn., April 1980.Received Ph.D. in psychology from Tufts University. A group of 153 sixth-, seventh-, and eighth-grade girls and a group of 95 college women produced human figure drawings. Comparisons were made between early and late adolescents and, within the group of early adolescents, between pre- and postmenarcheal girls, of the frequency with which secondary sexual characteristics, namely, breasts, were explicitly depicted on the female figures. Early adolescents were found to represent breasts more explicitly than late adolescents. Parallel results were found for pre- and postmenarcheal girls in the seventh grade. The results suggest that early adolescents emphasize and are preoccupied with body parts whose changes signal the beginning of puberty, while later adolescents, being past the period of most rapid growth and change in body contour, have a more integrated body image.This research was supported in part by Wellesley College Faculty Development Awards to each of the two authors.Received Ph.D. in psychology from Clark University. This study sought to compare the relative importance of subjective and objective timing of menarche for initial menstrual experience. Objective timing is defined as when an event occurs relative to a person's actual chronological age. Subjective timing is when a life event occurs relative to social norms for the timing of its occurrence, and has been cited as being of importance in determining the events' psychological significance. In this study, college women completed a survey in which they recorded their age at menarche, an estimate of the number of their peers reaching menarche before them, and their memory of their initial experience of menstruation, on a 7-point scale ranging from 1 (completely positive) to 7 (completely negative). The assumption was that girls who reported early menarche in relation to peers subjectively experienced themselves as early maturers, the converse being true for girls reporting late menarche. Since a curvilnear relationship between subjective timing and objective timing has been reported for girls by other studies, linear relationships were not considered; instead, a chisquare analysis and a measure of the relative strength of each relationship were performed on the date, the results indicating that subjective timing was significantly related to menarcheal experience, but objective timing was not, with girls who experienced themselves as early remembering a more negative menarche than girls who experienced themselves as "on time" or late. The results validate the importance of the concept of "social clocks" in adolescent development and suggest that future studies of the importance of pubertal timing should include measures of subjective as well as objective timing.  相似文献

In the United States, federal law and many state laws differentiate between marijuana and industrial hemp through delta-9-tetrahydrocannabinol (THC) levels, whereby the latter is defined as ≤0.3 percent THC on a dry weight basis. Many traditional cannabis identification methods employed by crime laboratories cannot accurately determine total THC quantities in accordance with federal and state regulations, or do so with increased time, labor, and risks of instrument damage. In order to quickly distinguish positive marijuana samples, a method was developed to identify plant material with a total THC level >1%. This novel, automated dispersive pipette extraction (DPX) method uses tip-based technology and an automated liquid handler to enable fast, hands-free selective isolation of THC and its precursors for downstream gas chromatography–mass spectrometry (GC-MS) analysis. The workflow proceeds with no repetitive manual effort and reduced need for instrument maintenance while enabling crime labs to legally identify marijuana through the detection of total THC above 1%. Recovery of THC using the DPX extraction method was 93% at 30 µg/mL and 78% at 500 µg/mL. Similarly, THCA-A recovery was 100% at 30 µg/mL and 74% at 500 µg/mL. Samples evaluated in a blind study (proficiency, hemp, and nonprobative case samples) were all accurately identified as greater than or less than 1% THC, with samples containing <1% THC being identified as “cannabis” and subjected to more discriminative analysis as needed.  相似文献
