Public/private information sharing in healthcare fraud investigations

Private insurers have good reason, both in their private interest and in the public interest, for pursuing and rooting out fraud in the healthcare system; moreover, they often have sophisticated data systems, substantial investigative information, and management expertise that can be useful to prosecutors. It makes sense, as a public policy matter, to undertake steps to encourage insurers to be aggressive in pursuing legitimate fraud cases, and to provide a framework for effective cooperation and information sharing with law enforcement. At the same time, prosecutors are responsible for enforcing equal justice under the law; thus, any such relationship must be handled in an appropriate manner, with safeguards to protect privacy and the reputation of investigative subjects. While the courts have not yet explored many of the relevant legal and factual issues in this area, the author surveys existing guidance under governing laws and policies applicable to state and federal prosecutors, and suggests techniques to prevent inappropriate communication or use of such information.     

Legal responses to child sexual abuse cases in the Children’s Court of Victoria: study findings on a case-management approach

Child sexual abuse cases present Children’s Courts with distinctive challenges. The highly conflictual nature of child sexual abuse cases means they do not lend themselves to the usual adversarial court processes that characterise the conduct of Magistrate Court matters in Australia. With this in mind, the Children’s Court in Victoria established for 12 months in 2013 a pilot specialised judicial list (known as the ‘D’ List) which offered an intensive Magistrate-led case management approach to child sexual abuse cases in the Family (child protection) Division of the Court. The operation of the List was evaluated to assess the suitability and effectiveness of this approach, and to investigate the challenges associated with managing and deciding this class of cases. The findings confirmed that the List provided better management of cases and reduced delay. Given this, the Court is continuing the judicially proactive intensive case management approach and dedicated list for child sexual abuse matters and extending it to regional courts; believing it to be a more effective approach to managing and deciding this complex class of cases.     

Capturing the Regional Economic Benefits of University Technology Transfer: A Case Study

Despite a high concentration of brainpower and federally funded research, some universities have been unable to translate these assets into regionally based economic activity. The author uses an ethnographic method interviewing university officials and academic entrepreneurs in New York City, which has a relatively poor record of local start-up creation. The author finds that universities that view the primary objective of technology transfer as a revenue generator for their institutions generate fewer spin-offs than those that incorporate a local economic development component. Internal advocacy and faculty interest, however, can affect university behavior. The author also finds that academic entrepreneurs with a pre-existing affiliation with the licensing institution are more likely to locate in the area than outsiders utilizing the technology. Entrepreneurs exhibit a distinct locational calculus based on a range of variables including real estate costs, founders’ preference and the geographical proximity of key firm relationships.      

Performance management and “undesirable” organizational behaviour: Standardized testing in Ontario schools

Performance management (PM) is a major administrative mechanism for assessing efficiency and effectiveness, and for exacting accountability from organizations and individuals. Many have argued, however, that using PM in such ways creates perverse incentives and may lead to undesirable behaviours, such as the obstruction of accurate performance measurement in an effort to avoid public mortification. By examining the introduction of standardized testing in the Ontario public school system, this article adds to the debate on whether PM leads to undesirable behaviours and distorts the representation of actual performance by public sector employees. It argues that, while PM in the public sector may be well intentioned, it may generate a system that produces undesired results.     

The draw a person test and young state hospital patients

Because of the increasing number of adolescents being admitted to state hospitals, because of the continuing need for appropriate testing materials for these patients, and because of the frequent criticism leveled against the DAP's validity, this study was undertaken in order to provide normative data for the DAP with this particular clinical population. The subjects were 84 male and 66 female psychiatric patients from the Adolescent Unit (AU) at Rusk State Hospital. As each patient was admitted to the AU, he was scheduled for psychological testing, with the DAP, the Revised Beta, and the MMPI being part of this testing. The results of this study indicate that the social factors of Ethnicity and Work Habits are significantly related to DAP test performance by male subjects, while Diagnosis is significantly related to DAP test performance by female subjects. The Admissibility of the R-PAS in Court

The admissibility of the Rorschach has been a concern of forensic psychologists for many years. The focus of this debate has been the Comprehensive System, which is the most researched of the current Rorschach Systems available in the USA. However, recently, a new, competing system has been published: the Rorschach Performance Assessment System (R-PAS; Meyer et al., Rorschach Performance Assessment System: Administration, Coding, Interpretation, and Technical Manual, 2011). Using Heilbrun’s (Law and Human Behavior 16:257–272, 1992) guidelines as a framework, we examine the admissibility of this new system according to the standards outlined in Daubert (1993) and Frye (1923). We conclude that we have reservations about the admissibility of the R-PAS in court at the present time, notwithstanding ongoing work on this system.
