Is globalization promoting regulatory convergence in agricultural biotechnology policies in the South? This article examines the nature and limits of regulatory convergence in the field of agri-biotechnology and investigates the effects that international forces have on biotechnology and biosafety policies in developing countries. Based on detailed case studies of Mexico, China and South Africa this article shows that these three leading biotechnology countries in the South are exposed to powerful international influences but are responding to the regulatory challenges of genetically modified organisms (GMO) adoption in distinctive ways. The existing regulatory polarization between US and EU biotechnology approaches has not forced a convergence around either of these two international models. GMO policies in the South do not simply follow the binary logic of the US–EU regulatory conflict. Instead, they integrate elements from both regulatory approaches and are steering a course that suggests substantial regulatory diversity in the South. The globalization of biotechnology thus goes hand in hand with regulatory diversity in the developing world. Furthermore, regulatory polarization between the EU and US has helped to open up political space in key developing countries.  相似文献

To what extent are European rules complied with, and what are the reasons for non-compliance with EU law? According to an intergovernmentalist perspective, implementation problems should occur when member states failed to assert their interests in the European decision-making process. Focusing on 26 infringement procedures from the area of labour law, we show that such ‘opposition through the backdoor’ does occur occasionally. However, we demonstrate that opposition at the end of the EU policy process may also arise without prior opposition at the beginning. Additionally, our findings indicate that non-compliance is often unrelated to opposition, and due to administrative shortcomings, interpretation problems, and issue linkage. This study is based on unique in-depth data stemming from a ground-level analysis of the implementation of six EU Directives in all 15 member states.  相似文献

Abstract: This paper addresses the five major structural issues on the agenda of the 1996 Intergovernmental Conference of the Member States of the European Union: the option of replacing the treaty framework by a European constitution; the issue of fundamental rights in the Union; the future of the three-pillar structure; the puzzling question of how to allow for variations in European integration without endangering unity; and, finally, the political 'evergreen' of the division of competences between the Union and its Member States. The analysis is based on contributions by EC institutions and prominent groups of experts and scholars published before the political bargaining started.  相似文献

A quantitative and systematic analysis is provided for ubiquitously present template DNA interfering with the quantification of human DNA by PCR. Two sources contributing to DNA background were identified. The first one is interpreted as DNA present in chemicals and on equipment and the second as caused by operator handling. The amounts were equivalent to 2.5 and 8.9 pg per mL of sample, and the estimated frequencies of contamination were 65 and 35%, respectively, resulting in an effective limit of detection of 17.4 pg/mL. Below this level--named effective laboratory background--a result could not be considered as authentic. Knowledge of these parameters is important for laboratories that analyze minute amounts of human DNA by PCR for purposes such as quantification, typing, and sequencing.  相似文献

Testing the insights from qualitative case studies (Falkner et al. 2005 Falkner, G., Treib, O., Hartlapp, M. and Leiber, S. 2005. Complying with Europe. EU Harmonisation and Soft Law in the Member States, Cambridge: Cambridge University Press. [Crossref] [Google Scholar]) in quantitative models is a challenging task (see Thomson 2007). This article argues that in political science, our evaluation standards for quantitative analyses need to go far beyond the sophistication of calculations. They should include the quality of assumptions imputed, of data used, and of reasoning as to the political – as opposed to statistical – significance of regressions. When presenting statistical findings that counter solid qualitative work, scholars therefore are under an obligation also to present reasoned arguments for their case, taking into full account the qualitative findings on processes and mechanisms unveiled in these empirical studies.  相似文献

Abstract

China's agricultural biotechnology policy has undergone a profound transformation over the last decade, from a strongly promotional to a more precautionary approach. From the 1980s onwards, China invested heavily in biotechnology development and in the early 1990s emerged as the leading biotech country in the developing world. In the late 1990s, however, it halted the authorization of new genetically modified crops and introduced stringent safety regulations. This paper investigates this policy shift and argues that international factors have played a central role. Two trends, in particular, are identified as key sources of the move towards greater precaution: China's ongoing international socialization, particularly in the context of the international scientific debate on biosafety and the negotiations on a biosafety treaty; and the growing globalization of agriculture and trade, which has exposed China to international competitive forces and trade restrictions in food trade. As the case of genetically modified food in China shows, political integration and economic globalization can work together to promote a strengthening of the domestic environmental policy agenda.  相似文献
