Confusion politique au Congo-Kinshasa

This article, written in February 1998, describes political confusion, contradictions, and ambiguities (institutional as well as ideological) typical of the Kabila’s regime at that time. Political mobilisation as well as political identification were polarised by opposition between “local Zairians,” born from locally-born parents, and “new Congolese” who were born elsewhere or whose parent were born outside of the country. Other factors of political identification were ethnicity, regionalism, and generation. Given the fact that the new political regime suspended all political parties and that Kabila himself did not openly declare himself leader of a political movement, there was no open political activity. The article suggests that the new political crises is coming; it was confirmed by August 1998 rebellion/invasion.     

Do African Manufacturing Firms Learn from Exporting?

We use firm-level panel data for the manufacturing sector in four African countries to investigate whether exporting impacts on efficiency, and whether efficient firms self-select into the export market. Based on simultaneous estimation of a production function and an export regression, our preferred results indicate significant efficiency gains from exporting, which can be interpreted as learning by exporting. We show that modelling unobserved heterogeneity by a flexible approach is important for deriving this conclusion. A policy implication of our results is that Africa would gain from orientating its manufacturing sector towards exporting.     

Scene investigation, identification, and victim examination following the accident of Galaxy 203: disaster preplanning does work

Galaxy Airlines Flight 203 crashed following takeoff from Reno-Cannon International Airport on 21 Jan. 1985. Sixty-eight persons on board the aircraft perished in the initial crash and resultant fire which followed. Two victims expired as a result of crash injuries within subsequent days and one passenger survived. A community disaster response plan was in place and had been practiced by local government agencies before this incident. The successes of this preplanned response, as well as methods of actual recovery, identification, and examination of the victims is presented.     

Networks of European National Human Rights Institutions

This article concerns the networks of European national human rights institutions (NHRIs). It examines how the sharing of best practices takes place through networks and how NHRIs achieve cooperation at both the international and regional levels. The article also analyses NHRI cooperation within three organisations: the United Nations, the Council of Europe and the EU. While cooperation at the international level facilitates their accreditation according to their compliance with the Paris Principles and enables them to participate in the sessions of the Human Rights Council, cooperation at the European level allows them to exchange information on issues of common concern and strengthens their relationship with regional bodies. In Europe, NHRIs cooperate with the Commissioner for Human Rights of the Council of Europe and might also do so with the recently established Fundamental Rights Agency of the EU.     

Factors Influencing the Filing of Complaints,Their Investigation,and Subsequent Legal Judgment in Cases of Sexual Assault

In Geneva, examination of victims of sexual assault is performed by a gynecologist and a medical examiner. 48% of the victims file a complaint and we wanted to investigate the factors leading to file a complaint, those leading the Prosecutor to go to trial, and those influencing a conviction. Between 2006 and 2012, 676 victims of sexual assault were investigated (averaged age 26 year, mean 22). Information on injuries, perpetrators, and circumstances of the assault was collected and analyzed. The attacker being the ex‐spouse or a friend and the presence of semen were factors leading to file a complaint. The assailant being a family member or ex‐spouse and the presence of genital/anal lesions were factors influencing the Prosecutor. The presence of nongenital lesions, the assailant being known by the victim, influenced conviction. This study shows that the medical examiner plays a vital role in the investigation of cases of sexual assault.     

National Human Rights Institutions in Europe

Since the 1990s, the number of national human rights institutions(NHRIs or ‘national institutions’) has been growingin Europe. The aim of these institutions is to help implementinternational human rights at the national level and narrowthe gap between government and civil society. After discussingthe history and role as well as the advantages of creating nationalinstitutions in European states, this article analyses the differentmodels of composition and the principal competences of NHRIsin light of the Paris Principles that provide guidelines forthese institutions. The NHRIs also create networks at nationaland regional levels. The article highlights how NHRIs in Europecan contribute to the implementation of human rights and whatstructure, functions and relationships they may adopt in orderto ensure their effectiveness.
