Selon les archives du tribunalmusulman de Saint-Louis du Sénégal, fondé en 1857, cet article s’intéresse au cas des femmes qui étaient les plus nombreuses à recourir à la médiation des juges musulmans au sein de cette institution judiciaire. A partir d’une analyse des droits de la femme en matière de divorce, nous examinons l’application du droit islamique au sein du Tribunal Musulman. Nous nous interrogerons tout particulièrement sur la politique judiciairemusulmane des cadis de Ndar en ce qui concerne le code familial et les droits de la femme. Mais, en premier lieu, nous abordons les péripéties du TribunalMusulman, qui fut la toute première institution judiciaire publique en Afrique de l’ouest francophone.  相似文献

Abstract

Since China agreed to join the international counter-piracy coalition in late 2008, a watershed development in Chinese strategic policy, Beijing's engagement in Somalia is now following two separate streams. First, China is seeking to engage Somalia as part of its expanding number of African diplomatic partners via its participation in the coalition. Second, China is attempting to demonstrate, on the international level, its growing commitment to developing its naval capabilities, and protecting its maritime trade interests, by engaging in multilateral and coalition-based operations, namely to combat piracy off the Somali coast, in order to deflect criticism from the United States and its allies of China's overall military expansion and modernization.  相似文献

ABSTRACT

Since 2011, Myanmar has undertaken a series of domestic and foreign policy reforms, including democratisation and peacebuilding, before and after the watershed November 2015 elections in the country. These reform processes have called into question whether China, which has been Myanmar's dominant great power neighbour throughout the previous era of military government in the country formerly known as Burma, would find its strategic position eroding as Myanmar further opens to the international community. However, the concept of China ‘losing’ diplomatic ground to other actors, including the West, in Myanmar implies a zero-sum game that does not adequately address Beijing's still-formidable geostrategic presence vis-à-vis its southern neighbour. China has now started to implement a more multi-faceted, ‘resilience network’-building approach to maintaining its special status in Myanmar's foreign policy, a situation which will persist as Myanmar continues its uncertain path towards further reform.  相似文献

Abstract

As maritime trading becomes an increasingly important element of the modern Chinese economy, concerns in Beijing are being raised about the safety of vital sea lanes. Central to this thinking has been Hu Jintao's explanation of the “Malacca Dilemma” in late 2003, which describes the problem of sea routes crucial to China's trade, especially the Malacca Straits, being subject to interdiction from another state. At the same time, the international war on terror has also raised the specter of economic terrorism aimed at disrupting commerce via the Straits. Due to the complex nature of these potential threats, there is the temptation for China to address the “Dilemma” unilaterally as the country modernizes its naval forces. However, it remains in Beijing's interests to work both with littoral states and other great powers in ensuring greater security in the Malacca region.  相似文献
