This Article examines the issues and questions which underlie the debate over the admission of "medical treatises" into evidence. The admissibility of this type of evidence is at issue most often in litigation involving complex medico-legal issues. This article outlines the evidentiary basis for admission of medical treatises and discusses the quality of medical treatises in an effort to determine what value to the fact-finder these treatises actually hold. The authors contend that there is an inherent untrustworthiness associated with medical treatises, but do not go so far as to suggest that medical treatises should never be admitted. The Article concludes that there is a need for greater caution in determining admissibility and recommends safeguards to better guarantee trustworthiness and reliability. 相似文献

Abstract This paper contrasts the American TC model with that of the United Kingdom, presents an overview and history from 1965 to the present of Therapeutic Community (TC) treatment as applied in the United States particularly to drug using offenders, and it details findings from five scientifically sound studies that this kind of treatment during custody for incarcerated drug using offenders is effective in reducing drug abuse and recidivism. A final section presents the therapeutic principles derived from North American TC research and practice conducive to altering addict-offender lifestyles and improving the likelihood of a positive outcome. 相似文献

This article argues that the five-nation BRICS group has played a significant role in pressing for reforms in the Western-dominated global order, as well as mounting some revolutionary (and as yet unresolved) challenges to that order. However, it also maintains that there is another (underestimated) aspect to the BRICS' role, viz, their conservative or counter-revolutionary challenges to liberal trends towards democracy, human rights and the progressive evolution of international law. It then discusses how ‘the West’ has responded to these pressures from the BRICS, and other rising powers, and points to uncertainties raised by the recent growth of ‘populist’ pressures within the West itself against aspects of the liberal economic, political and cultural order. 相似文献
