This note discusses how far the Supreme Court judgment in Autoclenz Ltd v Belcher and others provides grounds for a purposive interpretation of the contract of employment for employment protection purposes, or whether its scope is limited to the specific issue of considering the validity of boilerplate contractual terms. The author reflects on the approach taken by the Supreme Court and how far issues of inequality and substantive fairness within employment relationships have been addressed. The note concludes that whilst the judgment has extended the context of facts to be considered to include a consideration of relative bargaining power, this in itself does not extend to a consideration of substantive fairness nor does it clarify the standards that should apply to a fair employment relationship. 相似文献

This research makes use of factor analysis to locate important dimensions of individual differences in perceptions of legal punishments. A sample of 152 recently arrested persons provided magnitude estimates of the seriousness of several types and levels of punishment. A factor analysis of the data showed that the major dimensions of individual differentiation were in responses to (a) lengthy periods of imprisonment; (b) several punishments judged less serious, including short periods in jail or on probation; and (c) fines. Regressions of the factor scores on individual characteristics are reported, and the implications of the analysis for deterrence theory are discussed. 相似文献

Both black and white populations from Birmingham, Alabama were analyzed for the frequencies of carbonic anhydrase II (CA II), glyoxalase I (GLO) and esterase D (EsD) isoenzymes. The results compared favorably with published frequencies of these genetic markers in other populations. 相似文献

Writing ink analysis is used in establishing document authenticity and the sources and relative ages of written entries. Most analytical methods require removing samples or visibly altering the document. Nondestructive, in situ analysis of writing inks on paper without visible alteration is possible using mass spectrometry with a new ion source called Direct Analysis in Real Time. Forty-three different black and blue ballpoint, black fluid, and black gel inks were examined. Both dyes and persistent but thermally labile components of the inks contribute to the mass spectra, principally as protonated molecules [M+H](+). Numerous ink components were identified from the spectra. The spectra were placed in a searchable library, which was then challenged with two spectra from each of the 43 inks. The best match for each of the challenge spectra was correct for all but one ink, which matched with a very similar ink by the same manufacturer. 相似文献

Hate, a simple word, is easily understood by young children. But as a concept, hate is vast, complex, and slippery. The study
of hate is not limited to one discipline; it is studied throughout the humanities and social sciences. This paper, which presents
a psychological theory of hating, argues that hate is an understudied psychological construct and has particular relevance
to justice research. Hate can trigger injustice, and injustice has the capacity to trigger derogation, violence, and hate.
Relying on four literatures—justice, psychology, psychoanalysis, and criminal justice—we present a theory of hating that describes
the formation, perpetuation, and expression of this influential emotional state. The Intensification Theory of Hating describes
hate as a dynamic process that moves from antecedents to emotions, cognitions, morals, and behaviors. Hate, we argue, is not
only an emotion; it becomes systemic when interactions among its components unfold over time to intensify hate. We conclude
by proposing research approaches and questions that could address hate in psychological and justice research.
