In this article, we draw on data obtained in interviews with District Judges about the factors which they say influence the exercise of their discretion in possession proceedings. Analysing the data set enabled us to create three ideal types of judicial decision—making which we have labelled 'liberal', 'patrician', and formalist'. We discuss the differences between each ideal type across five different variables: the District Judge role; approach; view of occupiers; the problem; behaviour of occupiers. Our data demonstrate a set of reasons to explain different approaches and outcomes between different District Judges (as well as the perhaps unlikely identification of a 'maverick' or 'idiosyncratic' style of judging). We conclude by suggesting on the basis of our data that, despite calls to structure or remove the discretion from District Judges, any such changes are unlikely to have much effect. 相似文献

While research on the influence of divided government upon legislative outputs is available, relatively little identifies the effects of divided government on legislative control of bureaucratic discretion. Some suggest that inter‐branch conflict between the President and Congress leads legislators to seek to retain legislative control over the bureaucracy. As a result, periods of divided government increase statutory control and reduce agency autonomy. Close examination of statutes creating each federal agency between 1946 and 1997 reveal that divided government increases specificity of statutory control. In addition, the particular type of divided government involving split partisan control between the chambers of Congress fosters greater specific statutory control when new government agencies are created. 相似文献

The relations between normative beliefs about different forms of aggression and corresponding aggressive behaviors were investigated in 2 studies of adolescents. In Study 1, we revised an instrument designed to assess normative beliefs about aggression to include beliefs about the acceptability of relational aggression, and we examined the psychometric properties of the instrument. In Studies 1 and 2, the unique associations of normative beliefs about relational and physical aggression with self-reported relational and physical aggression were examined. Findings across both studies revealed that beliefs-behavior associations were specific to aggression forms. In other words, beliefs about relational aggression were uniquely associated with engagement in relationally aggressive acts, whereas beliefs about physical aggression, but not relational aggression, contributed unique information about adolescents’ level of physical aggression. No gender effects were found. Results are discussed within a social-cognitive framework, and implications are explored for future prevention and intervention efforts to reduce aggressive behaviors.Assistant Professor in the Department of Human Development at Washington State University, Pullman, Washington. We have carried out experiments to investigate the aging of latent fingerprints deposited on black PVC over a period of 4–15 weeks. A thumbprint was used in each case and before deposition of the print the donor rubbed their thumb around their nose to add sebaceous deposits. We have studied the effect of heat, light, and moisture and we find that moisture is the most significant factor in the degradation of the latent print. We have attempted to enhance these latent prints by dusting with valine powder or powders composed of valine mixed with gold or red fluorescent commercial fingerprint powders. To make a direct comparison between “treated” and “untreated” prints, the prints were cut in half with one‐half being “treated” and one‐half not. Our studies show the best results being obtained when powders of valine and red fluorescent powders are applied prior to cyanoacrylate fuming. 相似文献

This is a report of postmortem false-positive reactivity using an enzyme-multiplied urine phencyclidine (PCP) immunoassay (EMIT II+) due to a single-agent fatal tramadol overdose. An autopsy of a 42-year-old male who died alone at home revealed no identifiable lethal anatomic abnormalities, thus leading to toxicologic analysis. Femoral blood was obtained for drug testing by high-performance liquid chromatography (HPLC) and showed a tramadol level of 14.0 mg/L, 2 orders of magnitude greater than the therapeutic range (0.1 to 0.3 mg/L). Urine was also obtained and EMIT II+ immunoassay revealed positivity for PCP at 88 mAU/min. However, confirmatory testing by HPLC failed to identify PCP in either the urine or serum. To verify the suspicion that this was a false-positive PCP result, stock solutions of tramadol and its major metabolite (O-desmethyltramadol) at concentrations of 100 mg/L in 10% methanol/H2O were compared with a blank solution (10% methanol/H2O) for EMIT II+ PCP reactivity and demonstrated reactivities of 44 mAU/min and 27 mAU/min, respectively. While these individual results were below the cutoff reactivity for a positive EMIT II+ PCP result (ca. 85 mAU/min), they were much more reactive than the blank calibrator (set at 0 mAU/min). Therefore, we conclude that the immunoreactivity of tramadol and its metabolites in aggregate is responsible for the PCP immunoassay interference and false-positive result. 相似文献

Abstract This article examines the discursive landscape of anti-piracy campaigns run by the Business Software Alliance (BSA) on behalf of major global software companies. Using semiotic techniques, rhetorical analysis and critical discourse analysis, the article demonstrates the primacy of new capitalism in reinforcing the public understanding of global knowledge economy. But the BSA's strategies and tactics are also found to offer mixed discursive messages, possibly attenuating a major objective of any communication campaign: social behaviour change. 相似文献
