This article is mainly concerned with the notion of value pluralism. In the first section I present it as a theory of the structure of moral normativity in liberal democracies, and defend its greater suitability compared with rival theories in attempting to revise democratic liberalism from the perspective of the cultural, national and normative pluralism of present-day democracies. In the second section, I link value pluralism with multinational federations in order to discuss its role in establishing the recognition of national pluralism, a plurinational division of powers, the participation of the different national collectives in the processes of constitutional reform, and the constitutional regulation of the right of self-determination, following the 1998 decision of the Canadian Supreme Court.  相似文献

Abstract. This article poses three questions related to the current revision of democratic citizenship in plurinational states. The first question focusses on the analytical limits of the term 'multicultural' and on the question of where nationalist movements stand within cultural pluralism. The second question asks whether it is possible to overcome the inherent difficulties in the traditional concept of liberal–democratic citizenship in plurinational states. Finally, the third question asks whether federalism is an adequate framework to regulate a revised concept of democratic citizenship in plurinational states. These three questions are developed in three sections. In the first I put forward a typology that allows us to identify four kinds of cultural pluralism movements that are present within the current liberal democracies. In the second section I identify some of the shortcomings of the traditional concept of citizenship with respect to the plurinational integration of some democracies, making special reference to the standard liberal version by Rawls. I defend the right of the minority liberal nationalisms to be included in a revision of the concept of democratic citizenship for the next century. Finally, I discuss the role of federalism, paying special attention to the case of Catalonia and Spain within Europe, and to possible 'asymmetrical' reforms to the concept of democratic citizenship.  相似文献

The enactment of Law 2/2010 on Sexual and Reproductive Health and on Voluntary Interruption of Pregnancy represents a radical change in the regulation of abortion in Spain. The law moves from the medical indication model that has been in place since 1985 (which established certain cases in which abortion was legal) towards a time-limit model that, with some exceptions, allows free abortion during the first 14 weeks of pregnancy. Along with the hot debate that this fundamental change has caused, other features of the law have also arisen as a source of conflict, including the regulation of the informed consent of underage women for having an abortion and the rules regarding the conscientious objection by healthcare professionals.  相似文献
