This paper, drawing upon qualitative data produced through interviews with custody officers (COs) at two custody suites in England, examines how the vulnerability of children and young people is conceptualised generally, within the criminal process, and then, more specifically, in police custody. It uses the appropriate adult (AA) safeguard under Code C to the Police and Criminal Evidence Act 1984 as the point of reference and explores, firstly, how childhood is conceptualised and, secondly, how childhood vulnerability is understood by COs. The responses of COs are perhaps indicative of a wider issue within the criminal process – the construction of youth and childhood and, accordingly, the criminal law response to children and young people. Within this paper, whilst it is accepted that childhood and vulnerability are non-static concepts, it is nevertheless contended that children and young people are vulnerable, particularly when facing the criminal process. 相似文献

Implementation of minority rights norms is an important step for integration. The ultimate aim of norm diffusion is internalization, that is, when a norm is being taken for granted. This article seeks to develop an understanding of socialization beyond formal compliance and suggests that material and ideational structures at both the elite and societal levels mutually reinforce one another. The framework is applied to the case of the integration of the Russian minority in Estonia, 1991–2016. The concepts of recognition and solidarity help to theorize and explain this socialization process and the constraints of both materialist and identity dimensions. 相似文献

This article reports on a case study of a mid-programme capacity building evaluation within a large education aid programme collaboration between non-governmental educational organisations in Malawi and US university literacy faculty. The article outlines the programme context and its formal and informal capacity building inputs. Analyses of data collected on capacity building at the midpoint of the programme are offered. The authors argue that capacity is built along the life of large programmes, and evaluating capacity building development (and understanding its challenges) before the end of the programme can help cross-national teams of administrators and implementers in modifying programme operations. 相似文献

When a defendant pleads guilty to a criminal charge against them their conviction may be justified on the basis of autonomy rather than accuracy. In this context, autonomy can make the difference between a legitimate conviction and the breach of fundamental rights. However, autonomy in this context is not clearly defined. This article argues, based on philosophical conceptions of autonomy and empirical realities, that true autonomy is an ideal rather than a practical reality. It considers the level of autonomy necessary to legitimise a criminal conviction via plea, and suggests that current conceptions of autonomy are inadequate since they rely on a formalistic autonomy ‘myth’, presuming autonomy in the absence of threats. An analysis drawing on original empirical data from two studies demonstrates how autonomy may be being depleted to unacceptable levels in the current system. Results are reported from a study of shelters for abused women in Ontario, Canada, suggesting that what clients, managers, and frontline workers value most in shelter services is based on a care perspective in which ongoing relational support is seen as essential to effective service delivery. Presently, government-required metrics used to assess shelter services not only reflect a narrow, justice perspective where “fairness” is defined as equal access to publicly supported services, but reveal a New Public Management emphasis on efficiency in which the focus is more on the “what” than the “how” of practice. Findings are discussed in terms of their implications for the design of accountability systems for evaluating government-contracted social services. 相似文献
