Corporate governance in Germany: The changing role of the banks

The article analyses the different channels ‐ industrial stakes, supervisory board mandates, proxy voting ‐ by which German banks can exert influence on industrial companies. The central thesis is that even where the banks have such influence they do not dominate the companies. A recent empirical study on the effects of the alleged bank dominance over industrial companies with detrimental effects on their performance is shown to contain major methodological mistakes. The relationship between banks and industry is undergoing some distinct changes. Banks have substantially reduced their industrial stakes as well as their representation on supervisory boards, which underlines that they are not striving for industrial leadership. Despite a clear trend in the German corporate sector to pay increasing attention to shareholder value and to provide more transparency in accounting, it seems premature to expect the German capital market, including the corporate governance system, to incorporate fully the Anglo‐Saxon model in the immediate future.     

Whole Plastome Sequences of Two Drug-Type Cannabis: Insights Into the Use of Plastid in Forensic Analyses

DNA is one of the fastest growing tools in forensic sciences, increasing reliability in forensic reports and judgments. The use of DNA has increased in different areas of the forensic sciences, such as investigation of plant species, where plastid DNA has been used to elucidate and generate evidence in cases of traceability of genetically modified and controlled plants. Even with several advances and the practice of using DNA in forensic investigations, there are just few studies related to the identification of genetic tools for the characterization of drug and nondrug-types of Cannabis. Herein, the whole plastomes of two drug-type Cannabis are presented and have their structures compared with other Cannabis plastomes deposited in the GenBank, focusing in the forensic use of plastome sequences. The plastomes of Cannabis sativa “Brazuka” and of the hybrid Cannabis AK Royal Automatic presented general structure that does not differs from the reported for other C. sativa cultivars. A phylogenomic analyses grouped C. sativa “Brazuka” with the nondrug C. sativa cultivars, while the hybrid Cannabis AK Royal Automatic placed isolated, basal to this group. This suggests that the analysis of plastomes is useful toward genetic identification of hybrids in relation to C. sativa.     

Lethal child abuse (through the use of physical force) in the German Democratic Republic during the period 1 January 1985 to 2 October 1990. Results of a multicenter study

No reliable data are available on cases of lethal child abuse (by active force) in the area of the former German Democratic Republic. In a multicenter study we therefore examined the police and court records for such cases occurring in the period 1 January 1985 to 2 October 1990 in the entire area of the former German Democratic Republic. RESULTS: The study center received information on 39 cases of lethal child abuse which correspond to approximately 7 cases per year. However, a low percentage of undetected crimes which cannot be determined more precisely has to be taken into consideration. Almost 40% of the victims were younger than 1 year, 73% of the victims showed indications of repeated ill-treatment. The effects caused by using direct blunt forces, against the head in particular, were by far the most frequent causes of death. The male contact person (the victim's father, brother or stepfather as well as the life companion of the child's mother in particular) killed the child in most of the cases. As far as it is known, 37% of the male/female offenders suffered from chronic alcoholism; 32% of the male/female offenders were under the influence of alcohol when the crime happened. 83% of the male/female offenders who were found guilty made a confession shortly after the crime had happened or during the interrogations. Almost all the male/female offenders were sentenced to prison (the duration of the imprisonment varied between one year and for life). Due to the considerably lower section rate compared to the one in the German Democratic Republic, it is to fear that each second fatal child abuse is not detected in the new federal states.     

Group-specific component imaging from trace material using isoelectric focussing and electroblotting

GC-subtyping was carried out on blood stains, that had been made on glass and stored under room temperature-conditions. Using isoelectric focusing in polyacrylamide gel, followed by transfer to nitrocellulose membrane by semi-dry-electroblotting and detection with enzyme-linked antibody complex the GC-detection was possible even after 64 days. Methodical problems are discussed.     

Is Income Inequality Related to Tolerance for Inequality?

Data from the International Social Survey Programme that includes individual respondents from 34 countries surveyed at four different times show that populations of countries with more actual income inequality also tolerate more income inequality, even after controlling for numerous individual- and country-level variables. Comparisons over time show that actual income inequality predicts later tolerance for income inequality, within 3–4 years, but earlier tolerance for income inequality does not predict later actual income inequality. These analyses therefore indicate that people adapt how much income inequality they tolerate to actual inequality. They contribute to a long-standing theoretical and empirical discussion about whether material structures influence or result from social norms.     

Injuries of the female genitalia in cases of sexual assault

Sexual violence is a global problem that particularly affects women and children. A retrospective analysis of 390 clinical-forensic examinations and 120 autopsies regarding injuries of the female genitalia in cases of sexual violence was performed. In the majority of cases no injuries of the female genitalia were found. Autopsy cases showed significantly more (and more serious) injuries of the genitalia than clinical forensic examinations (43 % vs. 25 %; p = 0.0004). Predominantly found were injuries of the external anogenital area, mostly tears or soft tissue lesions. In the current literature, data regarding the rate of injuries in victims of sexual violence vary strongly and their comparability is limited. Regarding the reconstruction of an offence, a forensic examination with an appropriate documentation of the injuries is evidently crucial.     

Gentechnik im Saatgut – ein wiederkehrendes Problem

Die Europ?ische Union und die Bundesrepublik Deutschland sind hinsichtlich des Anbaus gentechnisch ver?nderter Organismen (GVO) sehr zurückhaltend, w?hrend au?erhalb Europas die Zahl der angebauten gentechnisch ver?nderten Kulturpflanzen stetig zunimmt. Die Anwesenheit von GVO, die nicht zum Anbau zugelassen sind, in Saatgut ist deshalb ein wiederkehrendes Problem mit wachsender Bedeutung. Der Beitrag analysiert die dazu vorliegende Rechtsprechung der Verwaltungsgerichte und demonstriert am jüngsten Fall der Saatgutkontamination (NK603-Spuren in Maissaatgut) die Anwendung des differenzierten Regelungssystems des GenTG, das den Vollzugsbeh?rden anspruchsvolle Ermittlungsund Abw?gungspflichten auferlegt.     

Automated communication and basic rights

Nowadays communication does not necessarily originate from humans, but also from “machines” such as “social bots” or “things” in the Internet of Things. From a basic rights perspective, this phenomenon raises the question if such communication benefits from the same level of protection as communication created by human beings. With regard to the basic rights of the Grundgesetz, the Federal Constitutional Court for years has been excluding some forms of communication from the scope of protection as not needing or deserving protection. The ratio of these decisions must not be applied to cases of automated communication without noticing possible differences. Automated communication can mostly be linked to the human beings or legal entities applying it. Therefore, its prohibition or regulation is a matter of proportionality of infringements with fundamental rights.
