This article offers an interpretation of lawyers’ reactions to verse judgments, being judicial decisions rendered in rhymed poetry form. While, in recent history, there has been an unexplained break in the close historical connection between poetry and law, some judges nevertheless continue to render their judicial decisions in verse. This has met strong criticism from fellow judges, inevitably, but also from lawyers. However, there is no evidence in academic writing of anyone attempting to explain why lawyers are having these reactions. Endeavouring to fill that void, this research employs hermeneutics to offer an interpretation of lawyers’ reactions to verse judgments. The article analyses the varied opinions uncovered in five qualitative interviews with lawyers of different backgrounds, and contends that a movement of poetry back towards its utilitarian origins would see lawyers change their reaction to verse judgments, instead viewing them as an appropriate form of judicial expression.  相似文献

Allele distributions for 13 short tandem repeat (STR) loci D3S1358, vWA, FGA, D8S1179, D21S11, D18S51, D5S818, D13S317, D7S820, TH01, TPOX, CSF1PO and D16S539 were determined for three Native Alaskan population groups-Athabaskans, Inupiats, and Yupiks. Although genetic diversity is lower in the Native Alaskan populations compared with Caucasians and Africans, almost all loci are highly polymorphic in all three Native Alaskan groups. There was little evidence for departures from Hardy-Weinberg expectations (HWE) in any of the populations. Only two examples of detectable departures from HWE out of 39 locus-population tests performed were observed based on the exact test (Yupik, D8S1179, P=0.030; Yupik, D5S818, P=0.016). The F(ST) estimate overall 13 STR loci is 0.0309 for the Native Alaskan populations. Based on a genetic distance measure, Athabaskans are more closely related to Apaches and Navajos (all of the same linguistic group) than the other Native Alaskan groups. The F(ST) estimate for Athabaskans, Apaches and Navajos is 0.0180 and for Inupiats and Yupiks is 0.0167. The allele frequency data can be used for estimating DNA profile frequencies for Native Americans residing in Alaska.  相似文献

Citizens, especially those who are knowledgeable and care the most about politics, are motivated to defend their beliefs and attitudes in the face of discrepant information. These motivated biases strongly influence the way people think about health care policies and the politicians and parties that propose or attack these contentious policies. Three cognitive mechanisms are identified: a prior belief effect, confirmation bias, and disconfirmation bias. Together, these information processes conspire to produce persistence and polarization of opinion on health care policies.  相似文献

Incarcerated women frequently report initiation of substance use and sexual encounters at an early age, and often engage in high-risk drug use and sexual behaviors as adults. This study examined the timing of first sex, drug use, and arrest, as well as their unique influences on specific risky behaviors in adulthood, among a high-risk population of rural women recruited from jails. Ages of initiation were all positively and significantly correlated, and each independently increased the likelihood of several risky behaviors in adulthood. Implications are discussed for screening, intervention, and treatment targeting high-risk women and girls in rural areas, particularly within criminal justice settings.  相似文献

The Boston Gun Project is a problem-solving policing initiativeaimed at reducing homicide victimization among young peoplein the city of Boston. It represented an innovative partnershipbetween researchers and practitioners to assess the city's youthhomicide problem and implement an intervention intended to havepowerful impacts in the near term. In early 1996, a workinggroup representing a variety of law enforcement and social serviceagencies implemented an intervention that strategically respondedto gang violence, focused enforcement efforts on gun trafficking,and emphasized communication of the strategy to generate deterrence.The intervention is associated with a 60% decline in youth homicidevictimization (i.e., two fewer victims per month). There aresmaller declines in other measures of violence. The declinein youth homicide is sharp and occurs coincident with the introductionof the intervention. Competing hypotheses appear unable to accountfor the decline.  相似文献

In 1870, Ansil L. Robinson was charged with the murder of his mistress, Mary Lunsford, in Mansfield, Ohio, U.S.A. Evidence against Robinson included an attempt to match his teeth to bite marks on the victim's arm. Robinson was acquitted after a 3-week trial despite the evidence linking his teeth to the wounds. This trial represents an early and perhaps the first attempt to admit bite-mark evidence in a court of law in the United States. The acquittal resulted in the obscurity that prevented this case from coming to the awareness of the forensic dental and legal communities sooner.  相似文献

‘‘Revolving-door” lobbyists are individuals who transition from governmental positions into lobbying for private entities. Such lobbyists thrive on the insider connections and political knowledge that they developed while in government. These assets afford former lawmakers more access to and influence over incumbent lawmakers. The value of their connections and knowledge, however, is contingent on former colleagues remaining within the legislature. As new legislators enter the assembly, the connections and knowledge of former members expire and lose value. Whereas increases in turnover or assembly size generate more former lawmakers who might lobby, such increases negatively affect former members’ value as lobbyists. Interest groups accordingly hire fewer former legislators to lobby. Other factors, such as longer cooling-off periods or increased legislative staff resources, produce slight or no substantive effects on rates of revolving. Legislative characteristics mostly determine rates of revolving for former lawmakers.  相似文献

During the 1990s public service industrial relations in South Australia have followed the state's long‐standing practice of being moderate and careful. From 1993 onwards, processes of corporatisation and privatisation that had commenced under the Bannon Labor government were continued and extended under the new Liberal government, in part as a response to financial pressures arising from the State Bank collapse, and in part as a reflection of the same trends that were widespread elsewhere. Where possible the government avoided direct confrontation with unions. There were various contests where the parties explored options in the changing environment, but the most prominent trend was that government policies of financial restraint and outsourcing tended to reduce most unions' bargaining power. Those policies were initially conjoined with agency‐specific enterprise bargaining, but the resulting variations in outcomes finally led to a Wages Parity Agreement to restore consistency.  相似文献
