ABSTRACT

Like many Republican presidential candidates before him, Donald J. Trump campaigned on a pro-business, anti-regulation platform, and since his election in November 2016, he has directed his administration to move forward with deregulation in many arenas, including consumer financial protections, environmental controls, and workplace safety among others. Past efforts to roll back regulations governing certain industries, such as the savings and loan and the mortgage industries, have had harmful consequences for the general public or for specific interest groups. In this study, we review what the Trump administration has accomplished with regard to deregulation to date. Then, based on past deregulatory fiascos, we theorize the harmful collateral consequences that may result from this most recent swing of the regulatory-deregulatory pendulum.  相似文献

Legal context: The article reviews the commercial risk allocation clauses intypical open source licence terms and discusses their enforceabilityand implications. Key points: The enforceability of warranty disclaimers and limitation ofliability clauses in common open source licence terms is questionable,particularly in a cross-border context, and commercial licensorsshould take additional steps to protect themselves from down-streamrisks. Practical significance: Open source software presents a number of unusual commercialissues, because it is available free of charge and the providerstry to disclaim warranties and liabilities. This paper examines the links amongst the concepts of gender, security and development. In particular, it seeks to examine how each of the concepts can be critically understood independently and as interrelated. Through understanding each of these concepts as socially and discursively constructed, contingent and fluid, the paper examines the consequences of such a theoretical framework for key issues facing gender, security and development practitioners: Trafficking, Resolution 1325 and HIV/AIDS.  相似文献

What is required for sustaining an alliance between union and environmental activists? Applying grounded theory to a case study in the Costa Rican banana sector, this article reveals five historical phases. First, unions and environmentalists identify common opportunity structures for joint action. Second, a preexisting network becomes a resource for mobilization. Third, the new coalition engages in communicative action that leads to shared identity and cultural framing and a foundation for handling exogenous global forces. Market policy changes in the fourth phase stimulate a transnational activist network and framing linkages. Dramatic supply disruptions in the fifth precipitate autonomous organizational approaches that require reframing, identity extension, and flexibility. This study argues that the Costa Rican case can be generalized to other labor‐environmental coalitions if such alliances create simple, open structures that agilely adapt to external opportunity structures and expand frames that encourage collaborative autonomy and dualistic collective definitions.  相似文献

In the late nineteenth and early twentieth centuries, throughout the Pacific Rim, European and American colonizers reorganized indigenous systems of property rights in land to make them look more like European property systems, with disastrous effects for the indigenous people involved. The very first of these schemes, however, was the Māhele of 1845–1855, which took place not in a colony but in the independent Kingdom of Hawaii. Why did the Hawaiians do this to themselves? I argue that the Māhele was a sophisticated and partially successful response to the prospect that Hawaii would soon be colonized. The object of the Māhele was to ensure that in the event of annexation, Kamehameha III and other elite Hawaiians would not be dispossessed of their landholdings. The strategy was to convert those landholdings into a legal form that would be recognized by an incoming colonial government—whether American, British, or French—as private property.  相似文献

The absence of a thoroughly developed, working class critique of criminological theory has resulted in bias in the creation of knowledge regarding crime and deviance. Much as feminist writings illuminated the unique problems related to gender, and works by those discussing racial and ethnic minorities highlighted the special concerns related to race and ethnicity, a working class perspective can expose the particular issues having to do with class. A brief discussion will be presented dealing with the portrayal of working class people in the media, and the complicity of academia in allowing working class stereotypes to persist. A sketch of a working class perspective will then be developed, and it will be used to critique fourteen of the major criminological theories today in terms of their relative sensitivities and considerations of the class factor in crime and justice issues. The final section places each of the fourteen theories on a continuum from those that do not consider the working class experience at all to those that give the working class experience full consideration. In the wake of the 1990 amendments to the Clean Air Act, localities across the United States initiated public information campaigns both to raise awareness of threats to air quality and to change behavior related to air pollution by recommending specific behavioral changes in the campaign messages. These campaigns are designed to reduce the health hazards associated with poor air quality and to avoid federal sanctions resulting from the failure to meet air quality standards. As in many other communities across the country, a coalition of government agencies and businesses initiated a public information campaign in the Atlanta metropolitan region to reduce certain targeted behaviors, mainly driving. A two‐stage model used to analyze data from a rolling sample survey shows that the centerpiece of the information campaign—air quality alerts—was effective in raising awareness and reducing driving in a segment of the population. When the overall information campaign was moderated by employers' participation in programs to improve air quality, drivers significantly reduced the number of miles they drove and the number of trips they took by car on days when air quality alerts were sounded. Public information campaigns can be successful in increasing awareness, but changing well‐established behaviors, such as driving, is likely to require institutional mediation to provide social contexts that support the behavioral change, as well. © 2003 by the Association for Public Policy Analysis and Management.  相似文献
