Designing a Choice Architecture for Regulators

The emergence of behavioral public administration has led to increasing calls for public managers and policy makers to consider predictable cognitive biases when regulating individual behaviors or market transactions. Recognizing that cognitive biases can also affect the regulators themselves, this article attempts to understand how the institutional environment in which regulators operate interacts with their cognitive biases. In other words, to what extent does the “choice architecture” that regulators face reinforce or counteract predictable cognitive biases? Just as knowledge of behavioral insights can help regulators design a choice architecture that frames individual decisions to encourage welfare-enhancing choices, it may help governments understand and design institutions to counter cognitive biases in regulators that contribute to deviations from public interest policies. From these observations, the article offers some modest suggestions for improving the regulatory choice architecture.

对中国腐败问题的深层解构--一个多维视野下的范式和悖论

由于诸多的原因,关于腐败的诸多问题仍然没有得到廓清,对其中一些实质性问题,尤其缺乏实证的研究和深层的探讨。学界似乎因为腐败问题的“马肝式”因素而陷入了一个人为的无知之幕,①这是一个行为选择偏离认知理性的悖论。理论理性的缺席与我国目前腐败发展的严峻形势和腐败控制的迫切需要极不相称,也是人们对腐败问题出现认识偏差以及腐败控制效能阙如的重要原因。笔者拟从政治、法律、社会等多维视角入手,对我国腐败问题作一粗浅的证伪和求解。     

寻衅滋事罪几个问题探究

寻衅滋事罪与其他有关联犯罪所不同的一个显著特征是基于流氓动机而产生的主观随意性、任意性和肆意性 ,其本质是无事生非。在司法实践中 ,认定“事”的有无要考虑被害人的过错情况以及社会观念。行为人实施了本罪四种行为中的三种或两种 ,但每种行为又未达到情节严重的条件 ,是否构成本罪要遵循罪刑法定原则。本罪与故意伤害罪、故意杀人罪在故意的内容上具有复合性和竞合性 ,视情形不同 ,或是无论本罪转化为后两罪 ,还是本罪与后两罪系竞合关系 ,最终以后两罪论处。     

东南亚主要伊斯兰极端组织现状

与中东、南亚一些长期遭受恐怖活动折磨的地区相比，东南亚恐怖活动并不“十分严重”。但2002年印尼巴厘岛爆炸案后，东南亚面临的恐怖威胁急剧增加。一方面，国际恐怖主义的兴起、国内政局的动荡和贫富差距的拉大，使二战后该地区长期存在的分离主义运动日趋激烈；另一方面，中央政府控制力的减弱也使一些国家的恐怖活动无法得到遏制和清除。

流浪未成年刑事被告人作为刑事被告人中的特殊弱势群体，其权利的保障及救济问题正日益突出。与其他未成年型事被告人相比，对流浪未成年型事被告人的权利救济在构建和谐社会、维护司法公正、保障人权、健全少年司法制度等诸方面具有特殊的重要意义。当前对于流浪未成年刑事被告人的救济主要存在“提前干预救济”、“羁押救济”、“监护救济”、“辩护救济”、“实体处罚救济”、“回归安置救济”等突出盲点，应结合我国实际和借鉴国外经济进行相关法规及制度的完善。

东西方文化存在“异”的一面,也存在“同”的一面,即“和”、“同”、“一”的思想。很多俄语词的词义本身就表现出“和”、“同”、“一”的思想,汉语也是这样。从中可以看出俄罗斯民族和中华民族追求的价值取向都离不开“和”、“同”、“一”的思想。     

Total Innovation Management: a novel paradigm of innovation management in the 21st century

Based on an ecosystem view of innovation management and in-depth case studies of firms in China and abroad, a novel paradigm of innovation management—Total Innovation Management (TIM)—is put forward in this paper. This new paradigm draws on three distinct areas of recent research, namely the innovation theory of the firm, the resource-based view (RBV), and the complexity theory. It introduces the theoretical framework of TIM, and presents a tri-dimensional innovation strategy model, which includes all elements of innovation, all innovators, and innovation in all times and spaces, and aims at value added and created.
