Legal proportionality is one of the most important principles for adjudicating among conflicting values. However, rather little is known about the factors that play a role in the formation of proportionality judgments. This research presents the first empirical analysis in this regard, relying on a sample of 331 legal experts (lawyers and legal academics). The policy domain addressed by the experiment is the antiterrorist military practice of targeted killings, which has been the subject of a legal debate. Our experimental findings suggest that proportionality judgments are receptive to normatively relevant facts. We also find strong correlational evidence for the effect of ideological preferences on such judgments. These results are consistent for two proportionality doctrines. We suggest that proportionality judgment is anchored jointly in the experts’ policy preferences and the facts of the case. We outline the implications of the findings for the psychological and legal literature.  相似文献

The idea of a world criminology specialty emerged in response to the increasing magnitude of global social disorder—wars, revolutions, terrorist activities, riots, crimes, delinquency, deviancy. These problems, together with our increasing problems of ecology, overpopulation, starvation, energy, tyranny and injustice, disease, and arms build-up, threaten to produce social disorder the magnitude of which the world has not yet seen. Many scientists have predicted that the next two decades will find the human species submerged under a barrage of severe catastrophes as these unchecked forces repeatedly reach crises proportions.

It is here suggested that criminologists and criminal justice practitioners begin scholarly and applied efforts toward development of a world criminology. This world criminology would take a global approach to the problems of social disorder and attempt to identify universal causative elements as well as universal principles and strategies relevant to the achievement of world order and the advancement of a world civilization. This paper presents and discusses seven assumptions which are held to be vital to the advancement of this new discipline. Further, a series of objectives and questions are posed, which are suggested as a means of encouraging initial exploratory work in world criminology.  相似文献

Polygraph test results are by and large ruled inadmissible evidence in criminal courts in the US, Canada, and Israel. This is well-conceived with regard to the dominant technique of polygraph interrogation, known as the Control Question Technique (CQT), because it indeed does not meet the required standards for admissible scientific evidence. However, a lesser known and rarely practiced technique, known as the Guilty Knowledge Test (GKT), is capable, if carefully administered, of meeting the recently set Daubert criteria. This paper describes the technique, and argues for considering its admissibility as evidence in criminal courts.  相似文献

Abstract

Placed against the backdrop of the recent war in Lebanon, this original analysis of the PLO rests upon the conviction that this movement is not merely a military‐political body, but is a kind of “religious” sect in meaning, intent, and form. This philosophical interpretation of the PLO draws upon a gnostic model in order to uncover the psychological universe of the PLO. In so doing, the author employs the interdisciplinary method of linking religion and politics (which is a view of political culture in the Arab‐Muslim world) to penetrate to the ultimate inner reality of the PLO. In this search, it is difficult to avoid concluding that the PLO represents a highly disorderly force in the Mideastern and global settings.  相似文献

Based on London's theoretical model, results of a developmental study of Israeli children from four subcultures are reported. The impact of child-rearing practices on achievement motivation, hypnotic susceptibility, and brain wave patterns of subjects from Eastern European, Kurdish, Yemenite, and Moroccan backgrounds was tested and compared according to age level. Subjects were 15 children from each subcultural group. Five in each subcultural group were between 7 and 9 years old, five between 9 and 11, and five between 11 and 13. Instruments included a combined EEG-hypnotic scale, six measures of achievement and nAch, and the Winterbottom questionnaire. Subjects of European background, presumably with the highest nAch, had the lowest mean score in hypnotic susceptibility, while children of Moroccan descent, presumably the lowest achievement group, had the highest mean susceptibility score among the four subgroups as expected. It was also found, consistent with previous developmental studies of American children, that hypnotic susceptibility increases significantly with age regardless of subcultural grouping. While the four subgroups differed significantly in their school performance as expected, they did not differ in their need achievement scores. Findings in regard to EEG data are presently not reported because of technical difficulties encountered during recording. Based on the assumption that foreign and defence policy grows out of the domestic political arena, this paper examines the 1988 elections in Israel with a particular focus on the territorial issue of Judea, Samaria and the Gaza Strip. The two major parties, Likud and Labour, share certain fundamental views, and this fact contributed to the formation of a National Unity Government during 1984–88. Yet they also differ markedly in terms of ideological outlook and more specifically in policy towards peace-making with the Arabs and the future of the territories. The election campaign reflected the differences and incompatibilities between the two major parties, while the results indicated a political stalemate. The domestic party arena in Israel has not produced any clear long-term strategy regarding peace and the territories. This deadlock suggests incoherence in the Cabinet, the impotence of the legislature and the likelihood that external events alone can alter the political status quo.  相似文献

This study examines the question: What are the factors that increase the probability of Chinese interference in intrastate wars? Chinese behaviour concerning intrastate wars was examined using multivariate logistic regressions. The analyses included the general behaviour of China regarding interference in intrastate wars, Chinese support of violent non-governmental organizations and of state governments. Both were also studied separately for the Cold War and the post-Cold War eras. Among the covariates that were examined, several emerged as possible explanations for China's behaviour: geographic contiguity, adversary regime type, and China's relative military capabilities. Furthermore, differences were found between Chinese support of violent non-governmental organizations and of governments in intrastate wars. Different results were also obtained for Cold War and post-Cold War eras.  相似文献
