山东检察研究与检察改革情况报告

一、检察研究总体情况(一)检察研究成效明显近年来,山东省检察研究工作坚持以邓小平理论和“三个代表”重要思想为指导,以建立科学的中国特色社会主义检察理论体系为目标,坚持基础研究和应用研究“两手抓”,立足服务,深入基层,重点围绕党和国家中心工作、围绕检察制度和检察工作面临的重大理论和实践问题,进行了广泛而深入的调查研究,为强化法律监督、完善检察制度、推进检察事业创造了良好的理论环境,检察研究服务大局、服务检察业务、服务领导决策的职能作用得到了充分的发挥。     

September 11th and U.S. Hegemony—Or Will the 21st Century Be American Too?

The tragedy of September 11 highlights the stark contrast between the real and measurable capabilities possessed by one state, and the almost inevitable resentments which the possession of those capabilities engendered in others. The purpose of this article is not to interrogate the strengths and weaknesses of arguments of American decline. Nor is it to speculate at length about September 11th. It is instead to set the scene and try and identify the underlying causes of America's transition from presumed crisis in the 1970s and 1980s to new self-confidence in the 1990s—a self-confidence that some now feel has been shattered by the events of September. While there were important structural reasons why the United States was unlikely to go the way of other powers, it was a peculiar conjuncture of mainly unforeseen developments that combined together after 1989 to improve the U.S. position within the world. We will then move on to discuss the most effective way of characterizing this position. Here, we will mount a defense of the somewhat contentious notion of "hegemony" While recognizing the problems associated with the idea, it will be argued that as a concept it has serious intellectual advantages over its various theoretical competitors. If nothing else, because it focuses on the American role within the world system, rather than just its statically defined position, it is theoretically more suggestive than the less dynamic idea of unipolarity.

发展主导产业 促进“二圈层”新农村建设——温江区永盛镇建设新农村调查报告

“二圈层”是描述我国城乡地域结构特点的民间用语,反映了城市(城镇)功能幅射区的层次性差别。一般认为,紧靠城市的近郊为”一圈层”,其次为“二圈层”,再次为远郊性质的“三圈层”。在我国,“二圈层”不仅数量巨大,而且因其处于城市功能的“过渡带”,情况复杂,差异性大,不确定     

Third party roles in intimate partner violence incidents and their effects on police response in a statewide rural jurisdiction

Using police narratives and affidavits, as well as incident report forms, this paper examines the neglected research topic of third party involvement in intimate partner violence and reports findings that differ from previous research done on the subject as a secondary topic. After identifying two analytically distinct roles of third parties, those of complainant and eyewitness, the study finds that the presence of complainants and eyewitnesses alone has no effect on police arrest dispositions. However, arrest is increased significantly when eyewitnesses become complainants or provide sworn statements. Other mafor findings of the study were: (1) the importance of the heretofore disregarded role of family members as third party witnesses; (2) the relative insignificance of marital status among cohabiting victim-offender couples on reporting and disposition; (3) the relatively small percentage of witnesses who are victimized; and (4) the greater willingness of witnesses to provide sworn statements against offenders with past versus current relationships to the victim. This paper was presented at panel session on “Domestic Violence and Law Enforcement Interventions” at the 2004 Annual Meeting of the Academy of Criminal Justice Sciences in Las Vegas on March 11. The study was facilitated by a Norwich University Board of Fellows Award and a Norwich University Research Grant. A Longitudinal Study of Modifying Influences in the Relationship Between Domestic Violence and Child Maltreatment

The increased risk of child maltreatment in the presence of domestic violence is well documented, but much remains unknown about factors that modify this relationship. This study investigates the roles of risk and protective factors in the relationship between domestic violence and being reported to the Department of Social Services for child maltreatment. Consistent with the literature, we find a significant overlap between domestic violence and maltreatment. Young maternal age, low education, low income, and lack of involvement in a religious community add to the risk for maltreatment associated with domestic violence. Separation between the maternal caregiver and her partner significantly reduces the risk for maltreatment when domestic violence is reported. A significant reduction in the risk for maltreatment is also found with higher levels of support from the maternal caregiver reported by the child in the context of domestic violence.
