The Human Rights Act 1998 finally came into operation on 2 October 2000 for all jurisdictions of the United Kingdom. The Act, which incorporates the European Convention on Human Rights into the UKs domestic laws, means that it will be unlawful for public authorities, which includes the DfEE and LEAs, to act in a way which is incompatible with the fundamental human rights set out in the Convention (found in Schedule 1 to the HRA). Bodies such as schools and their governing bodies, whose functions are of a public nature, are also covered by the legislation. The articles of the Act which have a particular relevance for schools and education are identified. It is probable that pupils and their legal advisers will invoke the Act in disputes over a wide range of educational issues, for example, bullying, exclusions and suspensions. Some of these issues are examined and where possible existing European human rights case law is cited. It is likely that the HRA will create interesting legal challenges involving schools and education, some of which cannot be anticipated at the moment, and that the Act will cause changes to education laws and schools regulatory procedures .  相似文献

This article explores how Constance Maynard understood her sexual emotions as part of her evangelical religion and how, in doing so, she was drawing on an evangelical tradition which placed strong emotion at the centre of religious experience. The article outlines how nineteenth-century women tract writers, missionaries and biographers wrote about female friendship and conversion using emotional rhetoric. The article analyses Maynard's diary entries to identify her use of missionary narrative tropes, arguing that, in the absence of psychoanalytic theories, Maynard turned to missionary narrative to make sense of her relationships with vulnerable women.  相似文献

The California Supreme Court in the case entitled Randi W. v. Muroc Joint Unified School District 1997 ruled that employers may be liable for negligently and intentionally misrepresenting an employee's suitability in their employment references. The case concerned a 13‐year‐old girl student who was allegedly molested by a school vice‐principal, Robert Gadams, in his office. Gadams had been the subject of charges of sexual impropriety involving female students in his three previous teaching posts. The plaintiff sued Gadams, and a range of defendants who had written references recommending him for employment. The Court found that the defendants could be held liable for fraud and misrepresentation because the facts allegedly known about Gadams were not disclosed in the references. The article examines the consequences of the ruling for the provision of employment references. In particular, it examines the ‘no comment’ option, whereby employers only confirm basic employment details about employees.  相似文献

Perhaps largely due to the successful campaigning of a number of pressure groups and social movements, but also due to the established position of related subjects within academia, there is a now almost routine consideration of class, ethnicity, gender and sexuality in relation to citizenship. Disability and the position of disabled people as “citizens” has not, however, received as much attention. It is the assertion of this article that this is a significant fact, for a consideration of disability in relation to citizenship provides useful insights into the strengths and weaknesses of some important theories of citizenship. Further, it demonstrates the need for an approach that takes account of the increasing uncertainty of groups such as disabled people towards their own identities and that conceives citizenship as being a process of “proactive engagement” towards a “reflexive position”.  相似文献
