Klagen gegen einen internationalen Sportverband, die auf Feststellung der Unwirksamkeit einer Sperre eines bei einem nationalen Sportverband besch?ftigten Trainers von Wettbewerben dieses Sportverbandes und auf Unterlassung von Handlungen, die eine Akkreditierung verhindern bzw erschweren, gerichtet sind, unterliegen der ausschlie?lichen inl?ndischen Gerichtsbarkeit des Sitzstaates; eine Verbindung solcher Klagen mit einer gegen den nationalen Verband gerichteten gleichartigen Klage ist daher unzul?ssig. – Eine damit zusammenh?ngende Schadenersatzklage gegen den internationalen Verband steht auch nicht in dem von Art 6 Nr 1 LGVü geforderten Zusammenhang mit einer Klage gegen den nationalen Verband wegen Aufl?sung des Trainervertrages aufgrund der Sperre.     

Increasing Evidence-Based Programs in Criminal and Juvenile Justice: A Report from the Front Line

For the past 5 years in the United States, there has been an increased emphasis on evidence-based programs, and, in particular, the promotion of experimental designs as the highest standard of evidence. This interest has been fueled by the Federal government's demand for accountability that links budget allocation with program performance. The National Institute of Justice, the research, development and evaluation agency within the Office of Programs in the U.S. Department of Justice is undertaking a number of efforts to improve the quality of evaluation research and address the need for evidence-based programs. These efforts have focused on making improvements upfront in the grant selection process so that well-designed evaluations will be undertaken and in the management and monitoring of ongoing evaluation research grants so that implementation and design issues can be identified and addressed. Evaluability assessments is a key strategy that NIJ is relying on increasingly to identify programs that have a high likelihood of being successfully evaluated. Whether these efforts will lead to an overall increase in the rigor of NIJ-supported evaluations remains unanswered at this time. The political economy of labor market deregulation during IMF interventions

This study examines the relationship between policy interventions by the International Monetary Fund (IMF) and de jure labor rights. Combining two novel data sets with unprecedented country-year coverage – leximetric data on labor laws and disaggregated data on IMF conditionality – our analysis of up to 70 developing countries from 1980 to 2014 demonstrates that IMF-mandated labor market policy measures significantly reduce both individual and collective labor rights. Once we control for the effect of labor market policy measures, however, we find that collective labor rights increase in the wake of IMF programs. We argue that this result is explained by the impact of union pressure on governments which, in such a context, are imbued with the policy space to respond to domestic interest groups. The study has broader theoretical implications as to when international organizations are effective in constraining governments’ choices.     

Organizational reform and the rise of trust funds: Lessons from the World Bank

Over the past two decades, earmarked funding to international development organizations through special-purpose trust funds has increased greatly. This paper studies the incentives for trust funds from the perspective of multilateral agencies, notably the World Bank. A theoretically intriguing type of funds are so-called “pass-on funds,” in which one unit hosts the fund, then passes on its resources to another type of unit for implementation. Each unit has different preferences for the specific types of activities to be supported by the fund. Interviews with World Bank staff and complementary documents demonstrate the rationale for pass-on funds and the associated division of labor between fundraising network units and implementing regional units. While pass-on funds reflect an efficient division of labor between functionally specialized units, they increase the misalignment between sector-specific global priorities and country-specific needs. Organizational reform drove the sudden explosion of pass-on funds around the millennium turn, facilitated by growing availability of donor monies for specific sectors and by lenient internal regulation. Organizational reform undermined budget autonomy of sector units, causing those units to seek new funds in their areas of expertise. A number of reform features also reduced administrative budgets of country units, increasing their demand for pass-on funding grants. The results contribute to the emerging literature on earmarked funding and highlight the need to consider international organizations as heterogeneous actors.     

Arbeitnehmerfreizügigkeit und Diskriminierung auf dem deutschen Arbeitsmarkt – Europäische Politik,transnationaler Mobilitätsraum und nationales Feld

The paper deals with the interaction of horizontal and vertical European integration. It asks whether the principle of free movement of labour does not only legally but also de facto prevent discrimination of non-nationals in EU Member States. Theoretically, the analysis is framed by distinguishing three interrelated types of social fields: a supranational political field of free movement of labour, national labour market fields and an intermediary transnational space of mobility. Focusing on the German labour market and drawing on comprehensive administrative data the article shows that wage differences are to a large extend caused by differences in relevant labour market characteristics such as age or education. However, for the vast majority of EU non-nationals in Germany is also observed discrimination in payment. Strikingly, positive discrimination is more pronounced than negative discrimination. These differences are understood as hinting at the increasing importance of comparisons between national labour markets in the EU.     

The European Communities’ Pyrrhic Victory: European Integration,Terrorism, and the Dublin Agreement of 1979

This article looks at the European Communities’ efforts against terrorism in the 1970s. It argues that in spite of the high ambitions to improve European legal integration, the attempts to develop an antiterrorism agreement were quite obviously a failure. Although the Dublin Agreement was adopted in 1979 after cumbersome and lengthy negotiations, it fell short of showing the member states’ unity and resolve to fight terrorism, and it never entered into force. The tedious negotiations drained the member states’ energy and willingness to such an extent that no other steps toward judicial integration or antiterrorism treaties were taken.

Some correlates of partisan preference in Greece, 1980: a discriminant analysis

Abstract. The factors underlying patterns of partisan preference in Greece have been the subject of fairly little systematic analysis. This article uses data from a 1980 Euro-Barometer survey, the first to include a Greek sample, to outline the structure of the Greek partisan universe. A number of demographic variables – age, family income, education, occupation, sex, size of community, and household status – together with attitudinal variables regarding both foreign and domestic policy issues are tested as predictors of party identification. The multivariate statistical technique of discriminant analysis is used to measure the relative importance of these predictor variables in influencing the direction of party preferences. The findings show that attitudinal factors for the most part are more important than demographic traits. A stepwise analysis provides a rankordering of the strongest explanatory variables. The impact of recent political and historical developments on the party system in Greece is discussed.
