Women’s Right to Asylum: Protecting the Rights of Female Asylum Seekers in Europe?

Criticisms have been made against international laws and conventions on asylum and refugees, arguing that these have been based on a male model of definition, which have ignored women’s persecutions. This article will argue that recent developments in European asylum policy have the potential to deepen this discrimination and to further reduce the rights of female asylum seekers. Although there have been some positive developments in jurisprudence that have recognised that gender-specific persecution may be the basis for granting asylum, these advances remain relatively sporadic and are undermined by the operation of random and discretionary exercises of power by bureaucrats and decision makers in many cases. Further, although new developments in asylum policy are in theory “gender neutral,” differences in the material circumstances of men and women who arrive to seek asylum may mean in effect that the implications of these policies are deeply gendered.

Urban youth under stress: Empirical identification of protective factors

Explored the influence of life stress as mediated or moderated by locus of control, family environment, social support, and coping style on psychological adjustment and school performance in 164 ninth graders from Baltimore. Gender differences in findings were shown. For boys, family cohesion was the only variable found to protect against the effects of stress. Family cohesion did not serve protective functions for girls, and along with overall social support, was associated with increased vulnerability to school problems. The report of problem-focused coping strategies exerted a number of protective functions for girls only. External locus of control was found to increase boys' and girls' vulnerability to the effects of life stress. Empirical development of interventions to improve the psychosocial adjustment of inner-city adolescents is discussed.Received Ph.D. from Virginia Polytechnic Institute and State University in 1991. The Extension of the Criminal Law to Protecting Confidential Commercial Information: Comments on the Issues and the Cyber-Context

Confidential commercial information is an increasingly valuable commodity and commercial resource which may be inadequately protected by the traditional approach of English criminal law against misappropriation. This paper reviews the nature of the problem and some of the relevant legal issues. Notwithstanding that a global reform of the law in this area is probably not on the cards, the position advocated here is that the direct application of the criminal law is indeed an appropriate vehicle through which to deter the misappropriation of confidential commercial information. However, the scope of any new law must be carefully circumscribed - if it is drawn too wide, the law runs the danger of acting outside of the articulated rationale for criminal liability and endangering other legitimate interests (particularly in the cyberspace context). If it is drawn too narrow, any new law may very well prove ineffective. It is suggested that there are a number of difficulties, both doctrinal and practical, that must be resolved prior to enacting new legislation in this area. Some observations are presented upon the more critical issues for those interested in the implications of law reform in this area for cyberspace.
