"算法权力"的异议与证成

当前算法研究中,"算法权力"这一概念还存在着一些争论.算法是不是一种权力?如果是,算法为什么是一种权力?这既是认识上的问题,也是现实中的问题.学界基于本体论视角和系统视角分别产生了"算法不是权力"和"算法是权力"这两种在形式上对立的观点.理论上,从支配力视角出发可以证成算法权力,支配力是权力的核心要素,那么拥有支配力的算法是权力;实际上,算法具有重要的社会性,它以技术集合的支撑、私人资本的嵌入与公权力的嵌入为基础,生成了算法权力.算法权力生成基础的糅合将产生多种算法权力形式,主要包括算法操纵、算法合格权威以及算法合法权威等算法权力形式.正确认识算法权力及其形式对于全面理解算法、应用把握算法以及治理算法具有重要作用.     

Forensic Application of Analytical Mechanics in Fatal Fall From a Height

Fatal fall from a height initiated with a swinging motion on the sagittal plane of the victim's body is examined. Method of analytical mechanics is adopted to establish the functional relations between the swinging angle of the body and the force needed to sustain the body until release, and the amount of the horizontal displacement that would occur after release. The analysis is applied to support an expert opinion presented in a criminal court in which two accused were convicted of murder for dropping a female victim from a bridge. The results indicate that it is unlikely for the body to locate as recorded by the police investigation report in the case. This study demonstrates that a straightforward mechanical analysis can be utilized to examine uncommon falling scenarios.

Child Sexual Abuse Perpetrated by Women: Case Series and Review of the Literature

The literature on child sexual abuse (CSA) perpetrated by female sexual offenders (FSOs) is exiguous, and many studies have focused on judicial databases. The present retrospective study, instead, analyzed clinical and judicial data of a group of both victims and alleged FSOs, to additionally include women who have not been convicted by the criminal justice system, but who hold strong clinical suspicions of being perpetrators of CSA. The medical records and the Court files of 11 children and their eight suspected FSOs have been collected and critically reviewed in light of the literature to date. This approach allowed for a deeper understanding of the relationship between child and FSO. The authors hypothesize that the victims’ severe psychopathological outcomes were a result of a failure to develop appropriate attachments with their prospective caregivers, which could have been damaged by the pathological relationship with FSOs, who were the victims’ caregivers.     

Representational Altruism: The Wary Cooperator as Authoritative Decision Maker

What drives policymakers to put the interests of others above their own? If human nature is inherently selfish, it makes sense to institutionalize incentives that counter decision makers' temptations to use their positions to benefit themselves over others. A growing literature rooted in evolutionary theories of human behavior, however, suggests that humans, under certain circumstances, have inherent predispositions towards “representational altruism,” i.e., to make an authoritative decision to benefit another at one's own expense. Drawing on Hibbing and Alford's conception of the wary cooperator, a theoretical case is made for such behavioral expectations, which are confirmed in a series of original laboratory experiments.     

从追求宏大理论到走进学校日常生活——对教育学科学化进程的一种系谱学描述

福柯的系谱学对权力／知识的分析对人-社会科学的研究范式与书写方式产生了深刻影响。教育学实践领域也受其冲击而发生了话语的转换。如果我们从系谱学的角度来反思教育学寻求学科化的历史进程，就会扩大对学科这一概念的理解：作为权力／知识实践方式的学科制度不仅是科学化的标志，也是控制现代生活的策略与技术。因此，对作为一门学科形式存在的教育学知识的寻求未必是适当的或必要的。目前，我们似乎更应该走进学校日常生活，由此迈向具体的教育实践。这或许是教育学走出迷茫之路的一条可能的途径。     

Police chiefs’ and students’ attitudes about the Miranda warnings

Several studies had concluded that the police subculture holds values and attitudes that are distinct from the rest of the population. Among these values is a focus on law and order. While researchers agree that police tend to hold different values, they disagree on the source of the attitudes. Some had argued that the attitudes reflected differences regarding who was recruited for law enforcement careers while others said that the differences reflected changes that occurred to individuals after becoming officers. This study examined whether police officers and students enrolled in criminal justice/sociology classes held similar or different attitudes towards the Miranda warnings. The findings suggested that in some ways, the two groups perceived the warnings in dramatically different ways, while in other ways their differences were simply a matter of degree. Implications are provided.     

Cumulative career traumatic stress (CCTS): A pilot study of traumatic stress in law enforcement

The present study measured the existence of traumatic stress symptomatology as reported by certified law enforcement officers within the State of Delaware. A questionnaire was devised which documented age, sex, race, education, years of service, marital status, children, rank, position, and shift work. The questionnaire was divided into parts which assessed the exposure and the frequency of specific traumatic incidents experienced in the line of duty, and the frequency of experienced traumatic symptomatology criteria: re-experiencing, numbing, and arousal.
