Der folgende Beitrag befasst sich mit Rechtsfragen, die sich bei einer Inanspruchnahme von naturschutzrechtlichen Kompensationsfl?chen im Sinne von § 19 BNatSchG durch ein sp?teres Vorhaben ergeben k?nnen. Im Mittelpunkt der Betrachtung steht das Verh?ltnis der Kompensationsverpflichtungen der Vorhabenstr?ger. Der Autor spricht sich dafür aus, dass in bestimmten Konstellationen die Kompensationsverpflichtung des Ersteingriffverursachers endet und an ihre Stelle die Kompensationspflicht des Tr?gers des zeitlich nachfolgenden Vorhabens tritt.  相似文献

This paper investigates the relationship between mobility and voting behavior at different spatial levels. To this end, voter turnout in local municipality issues is compared to that in national matters. We find that the difference between local and national turnout strongly correlates with the mobility of a municipality's population. An explanation for the observed negative relationship is that social networks and the sense of duty towards the local community are weaker in municipalities where people are more mobile. In addition to this core result, it is discussed how mobility affects turnout at the local and national level separately, and it is shown how the different measures might be used as proxies for local social capital in a municipality.  相似文献

In this paper we address the role of theveil of ignorance on work incentives andtax rates in a two-person real effortexperiment. We find that effort levelsdecrease with a rise in tax rates. Taxrevenues peak at intermediate tax rates of50% to 65%, supporting the existence of aLaffer curve in taxation. Tax authoritiesdo not exploit their power to tax in full,which is compatible both with revenuemaximizing but also fair behavior. Behindthe veil of ignorance, subjects care morefor efficiency and restrict the power totax more than in case their position(taxpayer or tax authority) is fixed inadvance.  相似文献

Germany has witnessed a veritable television boom over the last ten years. However, the plethora of new private channels masks an underlying duopoly, a concentration of media power that has not been prevented by an elaborate system of regulation. This article maps these developments, particularly the Lander competition for investment, the structural power of the media industry, and the emergence of a media policy ‘Grand Coalition’ between SPD North Rhine‐Westphalia and CSU Bavaria. It assesses the Federal Constitutional Court's role and highlights the public broadcasters’ crucial function to act as a pluralistic counterbalance in the dual public/private broadcasting system.  相似文献

Motivational interviewing (MI) is a communication style focused on enhancing clients’ own motivation towards change. In the justice system MI has evidence to support that it enhances communication and change behaviors in youth. As most MI training is designed for healthcare settings training and implementation of MI must be adapted to fit the juvenile justice model. This includes both rehabilitation and restorative justice. Here we describe the details that allowed one county small county in Pennsylvania to roll out MI training and initial skills review in less than 6 months. The case reviews the details of planning, trainings, and timing of activities. We then discuss what elements of those details fit into a greater implementation plan that may be applied elsewhere. Four key elements were instrumental to implementation: 1) appreciation of JPO time constraints, 2) cost containment 3) using blending to enhance JPO flexibility with MI use, and 4) policies that normalize use of MI. This outline may assist other courts in their own implementation efforts.  相似文献

ABSTRACT

This article explores questions of justice and moral permissibility of state action in counterterrorism through Robert Nozick’s Anarchy, State, and Utopia. Using the case of the Berlin attack in December of 2016 and the ensuing political debate over whether potential terrorists could be put into preventive custody as an illustrative example, it engages Nozick’s argument on prevention, knowledge and justice. In Nozick’s fierce defence of individual rights, the state comes into being as an aggregate of individuals and their inviolable rights, and thus possesses no moral legitimacy of its own. Individual rights must therefore not be violated for the sake of common goods. In conjunction with his emphasis on free will and the ensuing unpredictability of human decision-making, the article highlights the Nozickian position as a powerful account against the justification of preventive custody, thereby providing a moral “fail-safe” in counterterrorism discourses that build on just war theory and utilitarianism.  相似文献

This study investigates the relationship between direct democracy and political trust. We suggest a solution to the controversy in research centering on positive versus negative effects of direct democracy by analytically differentiating between the availability of direct democratic rights and the actual use of those rights. Theoretically, greater availability of direct democratic rights may enhance political trust by increasing citizens' perception that political authorities can be controlled as well as by incentivizing political authorities to act trustworthily. In contrast, the actual use of the corresponding direct democratic instruments may initiate distrust as it signals to citizens that political authorities do not act in the public's interest. We test both hypotheses for the very first time with sub‐national data of Switzerland. The empirical results seem to support our theoretical arguments.  相似文献
