Targeting the Motivated? Ethnicity and the Pre‐emptive Use of Government Repression

Research on government repression often focuses on the comparison between states over time and provides little insight about the targets of repression within a state. This article unpacks government repression against different ethnic groups. It argues that non‐democratic governments use pre‐emptive and targeted repression against ethnic groups that are discriminated, strong, or have a history of protest or rebellion in order to prevent future ethnic rebellions. For democratic governments, on the other hand, the cost of pre‐emptive repression is too high. The article tests this argument in a quantitative analysis of government‐group dyads. It finds at least partial support for some implications of the argument: Autocratic governments use more repression than democracies against discriminated groups, but only when they are also weak, and against groups with a history of protest. There is little evidence that regimes of either type respond to previous violent mobilization or group strength with repression.     

County council politicians' attitudes toward suicide and suicide prevention: a qualitative cross-cultural study

The purpose of the present study was to compare county council politicians' attitudes toward suicide and suicide prevention in five European countries. A questionnaire was distributed and here the responses to the open-ended questions are analyzed qualitatively. Considerable differences were found in what the politicians in the five countries believed to be the most important causes of suicide and how suicide can be prevented. There were also differences in to what degree the politicians revealed a judgmental attitude toward suicide, which seemed to be related to the magnitude of the problem in the respective countries. A certain implicit inconsistency in the logic directing the politicians' responses was found when their views on causes to suicide and suicide prevention strategies were compared. The responses indicate a need for increased consciousness and knowledge about suicide and suicide prevention among politicians in all the five countries. This is important since they are responsible for initiating and funding suicide preventive efforts.     

Zulässigkeit der auf WE-Begründung gerichteten Teilungsklage beim sog Mischhaus

§ 35 Abs 2 WEG 2002, dessen Zweck vornehmlich die Sicherung des Bestandes des WE ist, steht der Teilung durch weitere WE-Begründung an Wohnh?usern, an denen schlichte Miteigentumsanteile und WE nebeneinander bestehen (sog Mischhaus), nicht entgegen. Das bestehende WE im Mischhaus wird n?mlich nicht tangiert, kommt es auf dem Weg der "unechten" Teilungsklage doch nur zur WE-Begründung am noch bestehenden schlichten Miteigentum. Einer wirklichen und g?nzlichen Aufhebung der Gemeinschaft durch Zivilteilung nach § 830 ABGB, also einer Aufhebung auch des bereits bestehenden WE stünde § 35 Abs 2 WEG 2002 allerdings unzweifelhaft entgegen.

Der Übergang von der GesbR zur OG gemäß § 8 Abs 3 UGB

Der Rechtsformwechsel zwischen der Gesellschaft bürgerlichen Rechts und den Personenhandels- sowie den eingetragenen Erwerbsgesellschaften war wegen der unterschiedlichen Eigentumsstruktur schon nach altem Recht nicht unproblematisch, wenngleich eine hM und Rsp hier einen identit?tswahrenden Rechtsformwechsel ebenso anerkannt hatten, wie er etwa im Verh?ltnis unter den Personenhandels- und Erwerbsgesellschaften von vornherein au?er Zweifel stand. Das UGB hat die Problematik in dreifacher Weise versch?rft: Zum einen wird den eingetragenen Personengesellschaften nun ausdrücklich die Rechtsf?higkeit zuerkannt, zum Zweiten der zwangsweise Rechtsformwechsel jetzt an einen klaren und relativ niedrigen Schwellenwert geknüpft, drittens schlie?lich der spezielle Fall des übergangs von der Vorgesellschaft zur OG eigens geregelt, wobei aber die gesetzessprachliche Aussage zu den hier einschl?gigen F?llen uneinheitlich und unpr?zise ist.
