This article speaks of a debate in contemporary India: that surrounding the validity of enacting a civil code that applies uniformly to all communities and religions in the state. In certain feminist arguments, such a code is seen as possibly providing a sphere of rights to Indian women that is alternative to the rights – or wrongs – given to them by the plural religious laws, which form the basis of the civil law in India. India, however, is a heterogeneous polity, encompassing a diversity of cultures and religions, some dominant and others forming minorities. Given these differences, some critics see the feminist call for a Uniform Civil Code as an essentialist move that prioritises gender over other agendas and politics. They argue that the site of the ‚universal’ in this feminist move is a liberal site that inherently excludes marginalised Others and benefits the dominant subjects in India. In my article, I contest this critique and question whether the site of the universal and its authorial subject in postcolonial India is, in fact, an exclusionary liberal ruse of power. I draw insights from the history of the formation of the postcolonial nation-state in India to posit an experience of the state and the universal within it, which is alternative to the Western liberal model. The aim of this article is, therefore, not so much to debate the in/validity of a Uniform Civil Code, as to address certain contemporary post-structuralist critiques of the site of the universal in postcolonial India and posit a departure from them, based on perspectives drawn from history.  相似文献

Improvisation and Negotiation: Expecting the Unexpected   总被引:2,自引:1,他引:1  
Negotiators must improvise. As the negotiations process unfolds, they work with new information, continually making decisions along the way to achieve favorable results. Skilled improvisational jazz musicians and actors perform in similar ways: they repeatedly practice song chord progressions and notes or scene guidelines before a performance; then, during the performance, they work with the information or the music they hear in order to react and respond, making decisions along the way to produce dazzling music or a compelling scene. In this article, two experts in negotiation, a jazz-improvisation scholar, a former member of an improvisational theater troupe, and a psychotherapist versed in therapeutic improvisational techniques explore the improvisational nature of negotiation.
Several aspects of negotiation are similar to improvisation. Both negotiators and improvisational performers need to have a similar mind-set to be successful, both need to recognize and/or change that mind-set at times, and both must craft creative solutions. But there are some significant differences between improvisational performance and negotiation practice, which this article also notes. For example, personal charisma ("star quality") is a common attribute of successful performers, but not something negotiators may always rely on. Similarly, improvisational artists usually work as a team, while a negotiator is often on his or her own. Nonetheless, the incorporation of improvisation techniques into the negotiation skills repertoire holds great promise for practicing negotiators and is a worthy topic of future negotiation research and teaching.  相似文献

This introduction outlines an aesthetic of refusal as it emerges from instances of racialized exhaustion. Described as an aesthetics of minoritarian inaction and non-reproductivity, refusal challenges the centrality of action and repetition as the central tenets of political performance. Instead, the two valences of performing refusal/refusing to perform name an ethics of relation under racial capitalism, negating the dialectic of assimilation or resistance that shape minoritarian political performance, in favor of tactics such as opacity, imperceptibility, and obscurity.  相似文献

Recent scholarship on sati has stressed the fact that the ‘problem’ of sati is that the problem extends far beyond and begins far before the act itself. One of the things that lies prior to and post the act is language, yet sati is an act that stands in a curious relationship to language. I will examine the relationship between the physical act of sati and the language that surrounds it: the ‘story’ prior to the act which gives the act its meaning; the act itself which stands in an ironic relationship to the story – I will argue that the act is in fact possible only because it displaces the original story, so that every act of becoming sati presents itself not as a radical act in experience, but as an ‘acting out’ of the original story. It is in this acting out of a displaced story, that the boundary between the physical act and language becomes obscured and the body doing the act begins to occupy a liminal position, as it itself begins to function as a language – a language, which in its aspect of an ‘acting out’ obscures its own act. Lastly, I will consider the implications of the symbolic language of sati for the contemporary woman.  相似文献

The majority of studies on risk factors for suicide have been conducted in developed countries, and less work has been done to systematically profile risk factors in developing countries. The current paper presents a selective review of sociodemographic, clinical, and environmental/situational risk factors in developing countries. Taken together, the evidence suggests that the profiles of risk factors in developing countries demonstrate some differences from those in developed countries. In some developing countries, at least, being female, living in a rural area, and holding religious beliefs that sanction suicide may be of more relevance to suicide risk than these factors are in developed countries. Conversely, being single or having a history of mental illness may be of less relevance. Risk factors that appear to be universal include youth or old age, low socioeconomic standing, substance use, and previous suicide attempts. Recent stressful life events play a role in both developing and developed countries, although their nature may differ (e.g., social change may have more of an influence in the former). Likewise, access to means heightens risk in both, but the specific means may vary (e.g., access to pesticides is of more relevance in developing countries). These findings have clear implications for suicide prevention, suggesting that preventive efforts that have shown promise in developed countries may need to be tailored differently to address the risk factor profile of developing countries.  相似文献

The rising awareness of consumers regarding the adverse effects of the ever increasing ecological footprint has given rise to green consumerism. The idea is often encouraged but it can be enhanced only by a collective effort of consumers, firms, and governments. The article builds on the existing literature on green consumerism where it is, by and large, misconceived to be unidirectional—such that the burden of reducing human impressions on ecosystem falls only on the shoulders of consumers. The study reasons about the need for consumer initiatives to be supported with relevant policies and regulations from the government and through socially responsible corporate actions. The authors explore multiple dimensions of green consumerism and analyze in detail the scope and reach of green business practices in our ongoing strive to sustainability. The article highlights the actions required from the firms to make use of the opportunities provided by green consumerist ideas and the evolving consumer base. It explores the ways in which a business can adopt to become socially responsible by reaching green consumers. The article further identifies the need and impact of green marketing for eco-friendly products, to penetrate to the expanding consumer base.  相似文献

India is an ethnographic museum, well-known for its national motto of “unity in diversity”. It is a country of diverse hierarchies where the social reality is intersected by the varied grades of caste and class, among others. Against this backdrop, this article conceptualises the intersections of primordial identities. The concept of intersection underscores how diverse social positions interact in a Tamil village in India. As intersectionality is “the mutually constitutive relations among social identities” (Shields 2008), the interactions of caste, class, and gender in education are conceptualised to understand the formation of capabilities.  相似文献
